An Accra High Court has dismissed a case brought before it by two aggrieved persons of the New Patriotic Party (NPP) to have an injunction placed on the October 18, presidential primaries.
The two; Rexford Agyei Frimpong and Oppong Kyekyeku said the party breached some aspects of its constitution in setting October 18 for the congress.
They subsequently sought an order to compel the National Council to comply with the provision of the party’s constitution and fix a new date for the congress.
[contextly_sidebar id=”n01Vr6UMOPRAUZiNqSCqzWsqyNUV3zaS”]The application followed calls from flagbearer hopefuls, Alan Kyerematen and Francis Addai Nimoh that the party’s leadership should reconsider the date for the congress.
The court ruled on Friday that the applicants lacked the capacity to sue the party since they could not prove their membership with the party. A GhC5,000 cost was also awarded against the plaintiffs.
By his ruling, it means that October 18, still remains the date for the NPPs congress in which three persons including Nana Akufo-Addo, Alan Kyerematen and Francis Addai Nimoh will be contesting with the hope of leading the party in the 2016 Presidential election.
One of the plaintiffs Rexford Agyei who spoke to Citi News after the ruling said the court’s decision will in future create despondency in the rank and file of the party.
“I think there is a cardinal injustice here and the right to appeal on this particular aspect is not in merely in my interest but in the interest of the majority of members of the NPP who have worked over the years. To me it is an affront and a disincentive that we need to cure otherwise it can create a great deal of despondency in the rank and file of the party, ”
He however expressed dissatisfaction about the ruling saying that he will appeal against it.
He explained that “right now I am being set up as somebody impersonating a member of the party which I am not. And I cannot allow or accept that. I intend to pursue further on this particular issue because they tried to establish that I am not a member of the party after 20 years in the leadership of the party, to me it is an affront and a disincentive that we need to cure otherwise it can create a great deal of despondency in the rank and file of the party.”
