Supreme Court hears Zanetor’s case today

The Supreme Court will today [Tuesday] hear an application filed by the NDC’s Parliamentary Nominee for the Klottey Korle constituency, Dr. Zanetor Rawlings over her candidature.

She is challenging the capacity of a High Court hearing the case in which her candidature is being contested.

This follows an adjournment last week due to the unavailability of the judges empanelled to hear the case.

[contextly_sidebar id=”dwP6ZnPQnlF8sqy3AckzPhBPhhY4wEMF”]The incumbent Member of Parliament for the area, Nii Armah Ashietey is in court challenging his defeat in the party’s primaries, citing some constitutional breaches.

According to him, Dr. Zenetor Rawlings did not qualify to be elected as the parliamentary nominee, since at the time of the contest; she was not a registered voter.

This he said, is a serious constitutional breach but lawyers for Dr. Zanetor believes the high court is not an appropriate forum to adjudicate the matter.

She is thus seeking a restraining order to stop the judge hearing her case at a High Court.

The writ filed by lawyers of Dr. Rawlings is seeking “an order of prohibition directed to the His Lordship Kwaku T. Ackah Boafo  of the High Court…restraining him from proceeding to hear the dispute between the applicant and the interested parties pending a decision in the instant application.”

Dr Zanetor has subsequently registered as voter ahead of the November 7 polls but lawyers of incumbent Nii Armah Ashietey say that will not exonerate her.
