Francis Xavier Sosu, the legal practitioner who appealed the sentencing of the gunman who went to president Mahama’s church with a gun has said the writ filed by the Attorney General is needless.
This Sosu said is because; he had earlier filed a similar application which will be decided by the court on Friday.
[contextly_sidebar id=”cVmxbxlEUlE2Pm7fnHrHV3UQy56efVoV”]He added that, should the court upheld his appeal to have the earlier ruling which jailed the gunman, Charles Antwi, for 10 years, that of the AG “would become pointless or needless.”
The lawyer, Francis Xavier Sosu had prayed the court to declare that Charles Antwi is a mental patient and must be sent to the psychiatric hospital for treatment.
Meanwhile, the Attorney General on Thursday filed a similar application at the Accra High court seeking to set aside the judgment by the circuit court that sentenced Charles Antwi.
According to the state, the trial judge, justice Obiri erred in his judgment because there was an error on the face of the record.
The state is further asking for a retrial and a thorough examination of the convict.
Speaking p on Eyewitness News, Francis Xavier Sosu welcomed the AG’s decision.
“It was so patent that it would have been so surprising that the state’s legal forces would not notice such an error. That was the basis for which we filed the certiorari application, which is due to be heard tomorrow [Friday]. So if now the Attorney General has filed an appeal on the same grounds that we are raising I think it is a welcome news,” he added.
In a related development, another private legal practitioner, Godwin Adjei-Gyamfi has petitioned the Amnesty International to investigate the manner in which Charles Antwi was sentenced.
