Lawyers for former GYEEDA boss, Abuga Pele and Chief Executive Officer of Goodwill International Group, Philip Assibit have indicated that they will file a motion of no case in the ongoing trial of their clients.
According to the lawyers, they are resorting to such action because the prosecution has failed to provide credible evidence to compel their clients to open their defense in the case.
Mr. Abuga Pele and Philip Assibit have been charged with willfully causing financial loss to the state and defrauding by false pretenses and dishonestly causing financial loss to public property respectively.
[contextly_sidebar id=”iEudYA6FpVQ6e1tocEKrPLdReOovyiTn”]Speaking to Citi News, one of the lawyers for the accused, Raymond Bangnabu said his clients are innocent of the charges.
“We are saying that looking at the various charges that the accused persons have been charged with and looking at the evidence that have been adduced by the prosecution so far, from our perspective, we think they have not succeeded in pointing out the various ingredients for the offenses for which we’ve been charged and for that matter we should not be called upon to open our defense.”
“That is why the court has asked the accused persons to put in their submission of no case in a written submission which will be done then the state will also respond and then the judge will rule on the matter,” Raymond Bangnabu added.
Meanwhile the judge sitting on the case, Justice Efia Serwaa Botwe has set May 19, 2015, to rule on the submission of no case.
