Naba Joseph Apakre and the seven royal clans contesting the legitimacy of Naba Raymond Alafia Abilba as paramount chief of the Bolgatanga traditional area, have described as unlawful the ruling by the judicial committee of the Upper East Regional house of chiefs declaring Naba Raymond Abilba as legitimate chief of the Bolga traditional area.
According to them, the purported ruling by the Judicial committee was unlawful, contrived and self-seeking by members to incite violence in the Bolgatanga traditional area.
Naba Raymound Abilba and Naba Joseph Apakre were both enskinned by elders of the Bolgatanga Traditional Council and the overlord of Nalerigu, Naa Bohagu Abdulai Sheriga, respectively in May, 2015.
Mr. Abilba was enskinned as Naba Awogeya-Lebna while Joseph Apakre also enskinned as Naba Abeka Noge Buuri Maltinga.
This resulted in litigation over who had authority to the skin but the Judicial Committee of the Upper East Regional House of Chiefs declared Naba Raymond Alafia Abilba as the legitimate paramount chief of the Bolgatanga traditional area on 25th of October,2016
But Speaking at a press conference the spokesperson for Joseph Apakre said, the ruling by the judicial committee is not binding until a final determination of the matter by the Bolgatanga High court.
Bertrand Asamannaba cited the committee for contempt for ruling on the matter at a time when the Bolga high court had adjourned to the 9th of November sit on a motion filed by the Nayiri for judicial review challenging the jurisdiction of the Upper East Regional house of chiefs to adjudicate the matter.
“This capricious, unlawful and bias decision of the Judicial committee to give an unlawful ruling though our lawyer was not heard and the ruling by the committee was not also dully communicate to our lawyers”
Mr. Asamannaba said, they have instructed counsel for the plaintiff Naba Joseph Apakre to immediately initiate the appropriate legal processes to ensure justice prevails.
