The Special Prosecutor, Martin Amidu, has objected to an application by Bolga East MP, Dr. Dominic Ayine, to file a supplementary statement to the original case challenging the former’s eligibility to occupy the office of the Special Prosecutor on the basis of old age.

In a fresh application to the Supreme Court dated March 23, 2018, Dr. Ayine filed an application of leave from the Supreme Court to make available some aspects of the parliamentary debate that preceded the passing of the Office of the Special Prosecutor Act, with a view of assisting the court in its determination of the case.

[contextly_sidebar id=”SmwFAYp7xMCMp8YqqGrmWC5nqdgKLGf0″]But in response to the application, Martin Amidu argued that the rules of procedure at the Supreme Court do not allow Dr. Ayine and his lawyers to file such an application.

In a response to Dr. Ayine’s move, Martin Amidu said the fresh application was in bad faith.

While insisting that Dr. Ayine’s process was alien to the rules of the Supreme Court, he stressed that, the “Plaintiff in filing this application for leave to file Supplementary Statement of Case is unknown to any provision under PART FOUR of the Supreme Court Rules, 1996 (C. I. 16) , particularly Rules 46 and 48 thereof or any other Rules of the Supreme Court dealing with the invocation of its Original Jurisdiction.”

Martin Amidu said it was wrong for Dominic Ayine to seek to improve his cause after the defendants; himself and the Attorney General, have entered their defences without amending their statement of case.

“I believe that the Plaintiff caused the application for leave to be filed in bad faith and with the sole object of substantially changing the content of the plaintiff’s Writ and Statement of Case without allowing the Defendants an opportunity to answer same in an orderly manner in an amended Statement of Defendants’ Case or challenge same for introducing a new cause of action all together,” Martin Amidu said.

‘Amidu too old to serve’

Dr. Dominic Ayine, in February 2018, filed a suit at the Supreme Court, contending that Martin Amidu, who is 66 years of age, is too old to hold public office as Special Prosecutor based on Articles 190(1)(d), 199(1), 199(4), and 295 of the 1992 Constitution.

In his argument, he said the Office of the Special Prosecutor falls under the broad category of public officers who by the constitution must retire by age 60, or latest by age 65, via an extension.

But Martin Amidu, who has been vetted and approved by Parliament and also sworn-in by President Akufo-Addo, in his response to the suit, said Dominic Ayine had failed to “point to a single provision in the Constitution or Act 959 that states that the Special Public Prosecutor’s office shall be a public office and shall retire at the age of 60 years as was the case in Appiah Ofori’s case.”

He explained that Section 13 of Act 959 of the Office of the Special Prosecutor Act is not amenable to the provisions of Article 199 of the 1992 Constitution, which deals with the retiring age of public servants “because the Special Prosecutor and the Deputy Special Prosecutor are not appointed under Chapter 14 of the Constitution.”

The first hearing of the substantial case is yet to be held.

Today, March 23, 2018, is exactly a month since Martin Amidu was sworn in by President Nana Akufo-Addo as Ghana’s first Special Prosecutor.

It is difficult to identify which one drew the most excitement from Ghanaians; first, the announcement by President Akufo-Addo and then, his arguably sterling performance at the seven-hour-long vetting by Members of Parliament’s Appointments Committee.

He is from the opposition National Democratic Congress’ fold, yet, he agreed to serve in the opponent’s camp.

As expected, there was anger and a feeling of betrayal from that camp. That notwithstanding, the Minority Chief Whip Muntaka Mubarak, among other NDC MPs, said Martin Amidu was the best among all those he has met.

Martin Amidu pulled no punches during his vetting

Soon after, he was sworn into office by the President, in fulfillment of his pledge and Martin Alamisi Burns Kaiser Amidu, the man who earned the nickname Citizen Vigilante, took the oath of office with a pledge to smoke out corruption.

Many hailed Mr. Amidu’s appointment as the solution to Ghana’s fight against corruption as many consider him as one of Ghana’s cleanest and uncompromising public servants.

But the government may be shooting itself in the foot because of its own failure to resource the Special Prosecutor.

It appears everything ended after the day he was sworn in. As symptomatic of many of our issues, talk about the Special Prosecutor has long died down. The excitement has made way for a deafening silence from the government.

In the scorching sun, I visited Labone in Accra. Among the buildings, I found a facility that looked like a private residence, unlike any government building.

The unmarked house has a compound too small to accommodate more than one vehicle. The interior of the one-storey house boasts of a few bedrooms that have been converted into offices fitted with desks for prosecutors and investigators needed for the job.

The Special Prosecutor himself has a small room stuffed with chairs and a dining table which will serve as his office. A few more tiny rooms and cubicles seemed like offices for other staff. The boys’ quarters at the back of the house was just big enough to accommodate other administrators.

All around, the house is dwarfed by bigger houses that look directly onto the tiny compound, raising questions about the safety and security of the people who will man this delicate office.

The infrastructure generally looked incomplete and unprepared for the intended task. On the administrative level, nothing has happened more than a month after the Special Prosecutor was sworn into office.

He still lives and handles all issues relating to the office, from his private residence. He uses his personal car, although Citi News understands he has been allocated a driver and a bodyguard.

Citi News is also aware that several members of the diplomatic corps and civil society groups have made attempts to hold meetings with the Special Prosecutor, but this has been postponed several times as the office is not fully ready for use.

According to the law establishing the Office of Special Prosecutor, a board must be appointed to assist with policy direction. A month on, this has not been done.

President Akufo-Addo once said he was a man in a hurry but beyond hurriedly announcing the nomination, it appears he is rather too slow in giving his appointee the requisite tools to help fight corruption. To begin with, the board cannot be complete without the nomination of a Deputy Special Prosecutor- something the President is yet to do.

For now, the much-talked-about and celebrated Special Prosecutor still remains an idea yet to hit the ground.

If perchance, you wanted to submit a petition to his office for investigation and action, you may have to wait a little longer because it is unclear if the “Born Before Computer” Special Prosecutor even has a postal address to receive your letters.

Indeed, he may not even have a letterhead to reply to your letters.

There are several people with integrity still within the opposition National Democratic Congress (NDC), however the majority who wield influence within the party are without integrity.

This is the belief of former President Jerry John Rawlings.

According to the former President and NDC Founder, some media propagandists sponsored by individuals within the party deliberately twist the truth in what he says to court disaffection for him.

In an address delivered at a Town Hall meeting of cadres and NDC activists at the Arts Centre in Accra on Saturday, Mr. Rawlings extolled Martin Amidu’s virtues as a man of integrity.

He said, “When people in NDC and NPP are equally angry about the appointment of Martin Amidu, what should it tell you? Martin should have been used by us (NDC) but no, we checked him in, when he is an embodiment of what we stand for.”

Making reference to his recent tweets on the spate armed robberies in the country, which had courted some controversy, the former President said “if such reports come out and we cannot analyze them properly then people would always outwit us and our own people would also do the same.”

The former President said he had witnessed a lot of negative actions during the Kufuor, Mills and Mahama periods, noting that, if such negative actions against him come from the NPP he would not have been surprised but coming from his own people was difficult to take.

He said “just as we have many psychiatrically challenged personalities holding bibles with many followers, so do we have in politics too. And if we don’t recognize them quickly and find a way of pushing them out then we are destined for failure.”

‘Marwan Traboulsi’

Responding to allegations by a leading member of the New Patriotic Party (NPP) that he was protecting Marwan Traboulsi who has a large-scale cargo operation at the Kotoka International Airport, Mr. Rawlings brushed off the business link and described Mr. Traboulsi as a brilliant and efficient personality who turned around cargo handling operations at the airport.

“I will defend him any day as one of the most efficient and brilliant minds that I have come across. He was one of the first to go into large-scale farming and the export of pineapples during the revolution. Others did the same but his operations were so efficient that he was doing much better than some of the others. He later secured an aircraft that not only exported his produce but that of other farmers,” Flt Lt Rawlings said.

Traboulsi later left farming and diversified into cargo handling where his efficiency won him a bid to manage cargo handling at the airport.

“His efficiency level was so high we could beat South Africa by 30 minutes in cargo handling operations. Today, some want to spoil the names of good people just like we do in our party,” the former President stated.

Other speakers at the event were Mr. Antwi Boasiako-Sekyere, Dr. Hussein Inusah, Professor Kodzo Gavua, Dr. Donald Agumenu and Dr. Benjamin Kunbuor.

Special Prosecutor, Martin Amidu, is in the Upper East Region to see to the final transition and the exit of his mother, Atiisah Amidu, who died on 6th March 2016 in Bawku.

The late Atiisah Amidu, had been a resident of Bawku for 60 years, and was buried at her hometown of Kadema on 7th March 2016, from this physical world into the ancestral world.

Mr. Amidu, who’s yet to officially resume full duties as Ghana’s first Special Prosecutor, is holding the significant traditional ceremony alongside his brother, Professor Assibi Amidu of NTNU Norwegian University of Science and Technology, Norway.

The event, which started on 6th March 2018, culminates with the final transitional and farewell rites today, 9th March 2018.

Professor Assibi Amidu and Martin Alamisi Amidu expressed their gratitude to all those who supported and sympathized with them during her death and final transition and farewell ceremony in accordance with Bulsa custom and tradition.

They acknowledged the Bawku-Naba for generously supporting their mother during her illness, death and transition.

The Auditor General, Daniel Domelevo, says his desire for prosecutorial powers from the Attorney General has abated a little following the appointment of Martin Amidu as Special Prosecutor.

According to him, under section three of the Special Prosecutor’s Act, the Office can investigate alleged corruption and corruption-related offences, which are submitted to Parliament and the Attorney General by the Audit Service.

[contextly_sidebar id=”mfKcP9S3m2AO7YgjSsOfwFXR4Obr9rNA”]He added that given the extensive mandate of the Special Prosecutor, it is imperative that they allow the new Office to commence its work fully in order to assess its capacity.

Mr. Domelevo had earlier placed a request to the Attorney General for prosecutorial powers to enable his outfit deal with persons and institutions indicted in the annual audit reports.

However speaking on Point Blank Eyewitness News on Monday, Mr. Domelevo said: “Even that position I’ve relaxed it a bit because of the coming into office of the Special Prosecutor. I want the Special Prosecutor to also take off and let us see. For all you know, he may have enough capacity to cover the cases. Section 3 of the Office of the Special Prosecutor Act actually requires that he takes some of our recommendations and prosecute so that link has been established by law. It’s good we wait a bit and see how the Special Prosecutor’s Office is going to be. If they have enough stomach and energy to drive all that, they can go ahead with prosecution.”

‘Helping hand’

News of the request from the Auditor General for the prosecutorial powers was met with widespread commendation from Civil Society and the general Ghanaian public.

Many people praised Mr. Domelevo for his desire to ensure that persons who misappropriate state funds are made to face the law.

However, after some suggestions that his request was an indictment on the Office of the Attorney General for their failure to prosecute persons cited in the audit reports, Mr. Domelevo chastised the media for exaggerating his call.

He reiterated his assertion that he wasn’t in dire need of prosecutorial powers on Eyewitness News, adding that he was merely “offering a helping hand” to the AG.

“What we want to do is to hold people accountable. To be honest, prosecution is not my responsibility. My predecessor actually applied for [prosecutorial powers]. People think I want to use my auditors to go and prosecute I have a legal department which is staffed by professional legal practitioners. When they brought it to my attention, I thought that to get them occupied and with the AG saying she has 300 instead of the 600 [lawyers] that she may need to run her office, I thought that why not ask the AG that if it pleases her, we can help in prosecution,” he said.

“But that is not something I am in dying need of. My job is to audit and I have the mandate to audit. I am only extending a helping hand to the AG. If it pleases her and she says I should come on board, then I’ll go.”

Mr. Domelevo stated that although the AG had acknowledged receipt of his request, they have not responded to it because “at the time they said they didn’t have a Board or Council which has to considerate. I hope they have it now.”

Amidu sworn in

Mr. Amidu was sworn in on Friday, February 23, 2018 at the Flagstaff House by President Akufo-Addo in the presence of the Vice President, Mahamudu Bawumia; Chief of Staff Frema Opare; Attorney General, Gloria Akuffo and other government officials.

The former Attorney General received unanimous approval from Parliament, and was widely acclaimed by the Ghanaian public for his performance at his vetting.

Former President Jerry John Rawlings has suggested that retirement age for public officers may need to be changed after a suit was filed challenging the appointment of Martin Amidu as Special Prosecutor.

In his response to the contentions, Mr. Rawlings intimated that it was even an insult to think that Mr. Amidu was incapable of executing his duties because he was over 60 years of age.

“Have the judges stopped thinking? Judges can stay until they are 70. The President is above 70. I am 70. That is an insult. Maybe there is something wrong that needs to be changed as far as those figures are concerned,” the former President remarked.

Mr. Rawlings also reiterated his approval of the appointment of Martin Amidu as the country’s first Special Prosecutor, stating that the former Attorney General will restore the integrity of governance in the country.

Ayine’s suit

The Deputy Ranking Member on Constitutional Affairs, Dr. Dominic Ayine, is currently before the Supreme Court seeking a declaration that Mr. Amidu, who is 66-years-old, is not qualified for the position.

He filed his suit on February 12 ahead of the vetting of Mr. Amidu by Parliament.

In his argument, he said the Office of the Special Prosecutor falls under the broad category of public officers who by the constitution must retire by age 60 with a possible extension to 65 years.

Mr. Amidu has since received unanimous approval by Parliament and was subsequently sworn in as Ghana’s first Special Prosecutor on Friday.

Amidu not served with lawsuit

Meanwhile, Mr. Amidu has said he has not received any writ from the Supreme Court supposedly challenging his eligibility for the position.

“I wish the public to know that nobody has served me personally with any writ or statement of case or injunction challenging my nomination, approval and appointment so as to restrain me from accepting this appointment,” he said during his swearing-in on Friday.

Mr. Amidu said the lack of any writ or injunction against his role gives him the opportunity to serve in the position without any hindrance.

Martin A.B.K. Amidu was sworn into office on Friday, February 23, 2018 by President Nana Addo Dankwa Akufo-Addo at the Flagstaff House.

Amidu at the swearing in ceremony thanked the Attorney General and the President for appointing him, and promised to fight corruption in the country without fear or favour.

Martin Amidu, also promised not to fail in delivering on his mandate, saying not even claims that he will embark on a political witch-hunting drive will not deter him from working.

Your Excellency the President of the Republic of Ghana

Members of the Press

Ladies and Gentlemen

I wish first and foremost to thank Your Excellency, Mr. President, for the very fact of considering me as a fit and proper person for this position even though I come from the opposite pond of social democracy and in the past, we have been very strong and robust professional adversaries in the development of the constitutional law of our dear country from its inception. Your Excellency’s invitation to me to confirm my acceptance to be Special Prosecutor and my acceptance of the offer demonstrates a fundamental democratic principle and belief to your credit that few people have adhered to for the past twenty-five years. Namely, that adversaries are not enemies and must collaborate for national development by putting Ghana First.

I would not have accepted to come to this job if I did not trust Your Excellency’s integrity and honour from our long years of association from opposite sides at the Bar. I have also given Mr. President my word of honour that I will discharge the duties of the burdensome office you have entrusted to my care with similar integrity and honour, with your support and assistance.

Mr. President, I wish to assure you that the propaganda about witch-hunting will not daunt me from prosecuting all corruption crimes without reference to political considerations, as you had yourself admonished, once a suspected offender is established by investigations to have committed offences prosecutable in the national interest. I will treat crime as crime and nothing else.

I thank you, Mr. President, and the Honourable Attorney General sincerely for the trust you both have put in me and in my capabilities. Above all I also wish to thank and assure Ghanaians that I will do my best to vindicate the trust that the whole nation put in me at my nomination and nomination approval hearing.

As an aside I will wish the public to know that nobody has served me personally with any Writ or Statement of Case or injunction challenging my nomination, approval, and appointment so as to restrain me from accepting this appointment.

Before concluding, Mr. President, I wish to use your presence to acknowledge a senior citizen from Accra without whom I might not have been available for this job.

Professor J. N. D. Dodoo was my former Hall Tutor at Commonwealth Hall and was formerly of the Department of Modern Languages, Legon.

He ensured that I was not cheated out by the exclusion of my name from the LL.B class at the Faculty of Law after my First University Examinations when I had qualified for placement on the programme by merit.

His actions almost 43 years ago contributed in no small measure to my passion for the defence of truth, fairness, integrity, transparency and merit in public life and must be publicly acknowledged for once.

The General Legal Council may have a lot to learn from him at this time of the problems at the Ghana School of Law.

Thank you, once more, Honourable Attorney General and Mr. President. Thank you to all Ghanaians who stand against corruption. Let us put Ghana First!

Former President John Rawlings has reiterated his approval of the appointment of Martin Amidu as the country’s first Special Prosecutor, stating that the former Attorney General will restore the integrity of governance in the country.

Mr. Rawlings chided the NDC governments under the late Atta Mills and John Dramani Mahama for failing to take full advantage of the expertise and abilities of the outspoken anti-corruption campaigner.

[contextly_sidebar id=”YM36wjpOcpPo3c9jMp7xilAb5dqQDbHa”]He commended President Akufo-Addo for appointing Amidu to head the new office, stating that the new Special Prosecutor possessed the qualities needed to root out corruption in the government.

“To think we could have utilized somebody like Martin Amidu many years ago from Prof. Mills to our friend John Mahama. Instead we avoided him, we ostracised him the way we do with people like my wife and me. It takes somebody from a party completely opposed us, Nana Akufo-Addo to come and appoint him, not as a Minister of State but as [Special] Prosecutor. We ought to give him credit,” he told journalists at the State House during the final funeral rites of the late mathematics and science Professor, Francis Allotey.

“[Martin Amidu] will help to clean up the situation. He’s going to help us restore integrity back into governance that you can’t get into government and with impunity, steal and corrupt institutions and get away with it. If you don’t trust Martin Amidu, then don’t trust anybody.”

Mr. Amidu was sworn in on Friday, February 23, 2018 at the Flagstaff House by President Akufo-Addo in the presence of the Vice President, Mahamudu Bawumia; Chief of Staff Frema Opare; Attorney General, Gloria Akuffo and other government officials.

The former Attorney General received unanimous approval from Parliament earlier this week, despite a pending suit at the Supreme Court over his eligibility for the position.

The Deputy Ranking Member on Constitutional Affairs, Dr. Dominic Ayine, is seeking a declaration that Mr. Amidu, who is 66-years-old, cannot hold public office because he has exceeded the mandated age limit per the 1992 constitution.

But the former President dismissed those claims, describing it as an insult to suggest that Martin Amidu’s age could stop him from carrying out his mandate.

“Do judges stop thinking? Judges can stay on till they are 70. The President is above 70 and I am as well. It’s an insult. Maybe there’s something wrong that needs to be changed as far as those figures are concerned. He’s a man to be very proud of,” he said.

‘Integrity and honour’

Following his swearing-in, Martin Amidu promised not to fail in delivering on his mandate to fight corruption in the country, saying that not even claims that he will embark on a political witch-hunting drive will deter him from working.

“I have given Mr. President my word of honour that I will discharge the duties of the burdensome you have entrusted to my care with similar integrity and honour with your support. Mr. President, I want to assure you that the propaganda about witch-hunting will not daunt me from prosecuting all corruption crimes without reference to political considerations…I will treat crime as crime and nothing else,” he assured.

President Akufo-Addo also reassured Martin Amidu, that the independence of his office will not be compromised by the executive or any other arm of government.

He said the office will be provided with the needed assistance to effectively deal with corruption and eliminate same.

“I want to assure him that not only will the Executive including the Attorney General respects scrupulously the independence of his office, but will also provide him with whatever assistance is required to enable him to discharge his high duties effectively in the interest of the Ghanaian people,” he said.

About the Office

The setting up of the office of the Special Prosecutor was one of the key campaign promises made by President  Akufo-Addo ahead of his election victory in 2016, and it is aimed at tackling corruption effectively.

The Special Prosecutor’s office will be independent of the Executive, which observers believe will allow it to adequately deal with corruption-related issues which have plagued past governments.

The office of the Special Prosecutor has the mandate to investigate and prosecute cases of alleged corruption under the Public Procurement Act 203 Act 63 and other corruption-related offences implicating public officers, political office holders and their accomplices in the public sector.

The Prosecutor is also be mandated to trace and recover the proceeds of corruption.

Former President John Rawlings has lauded the New Patriotic Party government for leveraging Martin Amidu’s drive to fight corruption by appointing him as Ghana’s Special Prosecutor.

Mr. Rawlings said this was in contrast to Mr. Amidu’s own National Democratic Congress which only demonized the man nicknamed the citizen vigilante.

He remains confident that Mr. Amidu “is going to help us restore integrity back into governance.”

‘Something wrong with retirement age’

Mr. Rawlings also downplayed the lawsuit challenging Mr. Amidu’s qualifications for the office due to his old age.

The Deputy Ranking Member on Constitutional Affairs, Dr. Dominic Ayine, is seeking a declaration that Mr. Amidu, who is 66-years-old, cannot hold public office because he has exceeded the mandated age limit per the 1992 constitution.

In his argument, he said the Office of the Special Prosecutor falls under the broad category of public officers who by the constitution must retire by age 60 with a possible extension to 65 years.

Bur Mr. Rawlings asserted that “Judges can stay until they are 70. The President is above 70. I am 70. That is an insult. Maybe there is something wrong that needs to be changed as far as those figures are concerned.”

Mr. Rawlings and Mr. Amidu have a shared history that dates back to the early months of the Provisional National Defence Council (PNDC) after December 31, 1981, revolution.

After civilian rule was established in the Fourth Republic in January 1993, Amidu continued to serve in the government of Jerry Rawlings as Deputy Attorney-General. This he did for both terms lasting eight years until January 2001.

Ghana’s first Special Prosecutor, Martin Amidu, threw a subtle jab at the General Legal Council (GLC) during his swearing in on Friday.

During his acceptance speech, he recalled the support of his Hall Tutor at Commonwealth Hall who essentially saved his law ambitions.

[contextly_sidebar id=”slUrFESCOefIiJ8nrCaccnSeplTuSIWm”]Expressing his gratitude, Mr. Amidu recounted his experience with this lecturer, Professor J.N.D. Doodoo, “without whom I may not have been available for this [Special Prosecutor] job.”

“He ensured that I was not cheated out by the exclusion of my name from the LLB class list at the Faculty of Law after my first university exams when I had qualified for placement on the programme by merit… His actions almost 43 years ago contributed in no small measure to my position, my passion for the defence of truth, fairness, integrity, transparency and merit in public life, and he must be publicly acknowledged for once.”

“The General Legal Council may have a lot to learn from him [Professor J.N.D. Doodoo] at this time with the problems at the Ghana school of Law,” he concluded.

General Legal Council under fire

Mr. Amidu’s story comes in the wake of increased tensions between students and the General Legal Council over issues having to do with admissions into the Ghana School of Law and the Legal Profession Regulations LI before Parliament.

A group calling itself the Concerned Law Students, has threatened to seek redress at the Supreme Court if Parliament fails to withdraw the controversial Legal Profession Regulation.

The Association of Law Students has also petitioned President Nana Akufo-Addo over the matter.

The regulation, which will determine qualifications procedure into the Ghana School of Law, has been met with fierce resistance from the law students.

The students have described the LI as a deliberate attempt by the council to frustrate them in violation of their rights.

But the General Legal Council, which oversees legal education in Ghana, has argued that the exams and interviews are to ensure higher standards in legal education.

Law School SRC angry after over 80% fail exams

The Student’s Representative Council [SRC] of the Ghana School of Law, has called for the school’s Independent Examinations Board to be scrapped, describing it as a threat to legal education in Ghana, after only 91 of the over 500 students passed the May exams in 2017.

Protocol dictates that these students re-sit the exams, but the SRC has demanded that the results are scrapped, to allow the students to proceed with their six-month internship in March.
