Prosecute Afari Gyan for causing financial loss to the state – Group

Pressure group, Movement for Change is calling on government to prosecute the Chairman of the Electoral Commission, Dr Kwadwo Afari Gyan and his deputies for causing financial loss to the state.

[contextly_sidebar id=”vPQiFeaKTjlHqPpBBTm090qTLfKZ3tbe”]They claim negligence on the part of the Electoral Commissioner led to the cancellation of the District Assembly Election by the Supreme Court.

Members of the group are of the view that the law must guide heads of public sector institutions and make them accountable to the citizenry.

The Supreme Court last Friday declared that the EC was organizing the District Assembly Election with an immature Constitutional Instrument (CI) describing it as unconstitutional and ordered the EC to start the processes afresh.

According to the Movement for Change several persons including the Minority Leader, Osei Kyei-Mensah-Bonsu as well as Chairman of the subsidiary Legislation committee, Osei Bonsu Amoah cautioned the Electoral Commission on the implications of taking such action.

The Movement for Change in a press release argued that the State, as well as candidates who had put themselves up to contest have suffered huge losses, which cannot be swept under the carpet hence their call.

“It is extremely unfortunate to note that because of the recklessness and irresponsible act of Afari Gyan & Co Six thousand, one hundred and 56 (6,156) electoral areas across the country that are covered under the new C.I. have been affected badly,” the group added.

Arguing their  request out, the group further quoted the Criminal Code, 1960 (Act 29), which states that “Any person who by a willful act or omission causes loss, damage or injury to the property of any public body or any agency of the State commits an offence.”

“We  therefore call for the immediate resignation of Mr Afari Gyan & Co. They must further be prosecuted for willfully causing huge financial loss to the state.”
