The Bolgatanga High Court has impounded vehicles of the Talensi District Chief Executive (DCE) and the Coordinating director for non-payment of the full contract sum for a project  awarded to Tomore and Sons Company Limited.

The Talensi District Assembly contracted Tomore and Sons limited on October 3, 2011 to construct a three(3) unit classroom and a store, Four (4) KVIP seater and two (2) unit urinal at Woog town at a cost of GHC60,000.00.

Upon completion, Tomore and Sons Ltd  wrote to the assembly for inspection of the project and also requested for the payment of the remaining GHC 51,000.00, but the payment delayed compelling the plaintiff to seek redress in court.

At the Bolgatanga a High Court , counsel for defendant (Talensi Assembly) Theodora Adimazoya admitted owing  the plaintiff  but argued that, at the time the contract was awarded, the Talensi District was then Talensi/Nabdam District Assembly and prayed the court to have  the plaintiff sue the Nabdam district assembly instead.

However the High court Judge, Justice F.K Opoku did not find favor in the defendant.

Justice Opoku ruled that, the defendant  pay a total debts of GHC 81,345.00 with interest from October 2012 to july  2014 and cost of 10% on principal inclusive.

The court also impounded the Talensi DCE’s Nissan Patrol with registration number GN-1791-11 and the coordinating director’s vehicle with registration number GT-3591-11 awaiting  full payment by defendant.

It is to be noted that, after one month, if defendant  fails to make full payment, the impounded vehicles could be auctioned to defray the debt.
