I won’t settle NDC case out of court – Njonolah

It seems the regional elections of the governing National Democratic Congress (NDC) is likely to drag as lawyers for the aggrieved member, Linus Njolona who sued the party say they will not withdraw the case.

The NDC as part of measures to resolve the case amicably as suggested by the court, postponed its regional elections and also scrapped a controversial clause in the party’s election guidelines.

NDC’s Deputy General Secretary in charge of administration, Kofi Adams in an interview on Eyewitness News, expressed optimism that since the party has scrapped the controversial clause, Njonolah is likely to withdraw the case.

But lawyer for Linus Njonolah, Felix Datsomor insisted that they will not withdraw the case because they are contending the entire guidelines and not just the clause that has been removed.

He argued that “they [NDC] cannot decide on what to do without involving us. In the first place we are not just challenging the provision or the paragraph in the guideline that is not the only thing we are challenging.”

“We are even saying that the guideline in its entirety is null and void because the National Executive Committee (NEC) does not have the power to even promulgate those particular guidelines in the first place.”

He said if the party really wants to be fair then it should also declare the entire election guidelines null and void.

The said clause triggered a wave of anger among some party supporters who felt some executives were unduly excluding them from becoming party executives.

There were several court cases over this matter as some of the aggrieved members secured court injunctions in some regions.
