A Fast Track High Court on Friday threw out an interlocutory injunction filed by three persons seeking to restrain National Democratic Congress (NDC), Greater Accra Regional Committee from holding elections at the Kpone Katamanso Constituency.
Patience Boakye, King Estie and Setordjie Wilson were vying for positions including women’s organiser, deputy youth organiser and executive members at the Constituency.
They were however disqualified, a move which angered them to seek redress in court.
[contextly_sidebar id=”NlLqzHR2w2N7JONSfNlbxuuViAvQrG5m”]The court presided over by Justice Mustapha Habib Logo dismissed the application noting that the plaintiffs had failed to demonstrate to the court whether they would suffer irreparable damage should the election go on.
The court however did not award cost against any of the parties.
Mr Gordon Tamakloe who represented the plaintiffs prayed the court to grant them an interlocutory injunction to restrain the party from holding election in the Constituency.
He noted that although the plaintiffs were vying for positions in the party, it was the Chairman of the Regional Executive who informed them of their disqualification.
According to the plaintiffs if the injunction was denied them it would be very difficult to get delegates to come back and vote for them.
Plaintiffs argued that they were going suffer additional cost pointing, which could not be quantified.
Mr A .W. Tamakloe, Counsel for the defendants prayed the court to dismiss the interlocutory injunction as they had failed to demonstrate the kind of damages they were going to suffer.
