NSS case: AG prays for more time to file defense

The Attorney General has prayed an Accra High Court for more time to file its defence in a case involving a dismissed district director of the National Service Scheme. (NSS)

Madam Afua Abam from the AG’s office said they needed more time to go through the the writ so as to respond.

The district director, on May 5, filed an application for judgment in default of the defence, after the AG failed to file its defence in a matter in which the director have sued for his reinstatement.

The NSS staff is demanding reinstatement in a case filed in April this year after he was disengaged in February this year by the new administration.

The plaintiffs were represented in court by Ms Serwah Sarfo Mensah who held the brief of Theodore Adimazoya.

The plaintiff is of the view that his dismissal was illegal, and asking for an order directing the NSS to reinstate him.

The employee is asking for perpetual injunction restraining the NSS from permanently replacing them or offering his position to any other person.

The plaintiff is asking for payments of all salary arrears and allowances from the date he was dismissed until his reinstatement.

The plaintiff’s case is that the defendant failed to give him prior notice and that the Ag Director of NSS, Mr Usif Mustapha, should have known that they were properly employed, having attended interviews and subsequently given letters of employment.

The plaintiff case is that the withdrawal of his employment by their employers was an alien and unknown procedure for cessation of employment.
