Mining company sues Multimedia Group, Captain Smart for defamation

A mining company C&G Aleska, has sued the Multimedia Group, owners of Accra-based radio station Adom FM and one of its presenters Blessed Godsbrain Smart over alleged defamatory comments made on his show.

According to a writ seen by citifmonline.com, C&G Aleska decided to take legal action after some defamatory remarks were made by someone claiming to be the Assemblyman of Juabo and Emmanuel Aidoo, the Executive Director of an NGO, on his ‘Dwaso Nsem’ programme on November 30.

C&G Aleska said they had attained a license from the government and a permit from the Forestry Commission to operate in the Upper Wassaw Forest Reserve.

They added that following the commencement of operations in the area, hordes of illegal miners had trespassed on the concession, forcing the company to seek the help of national security personnel to flush them out.

“Some of the galamseyers, peeved by the conduct of the Company and the security agencies resorted to defamatory broadcasts about the Company and its directing minds. One such defamatory broadcast occurred on Tuesday 30th November, 2016 when Captain Smart interviewed a gentleman claiming to be the Assemblyman of Juabo and one Emmanuel Aidoo, who described himself as the Executive Director of the ECO Justice, an NGO; on his DWASO NDEM programme,” the writ said.

C&G Aleska accused Adom FM and Captain Smart of failing  to “get the side of the company and proceeded to broadcast various defamatory statements about the Company and its operations, which they ought to have known were false”

“The company is seeking among other things, a declaration that the words and statements complained of by Plaintiffs and broadcast in the course of the Dwaso Nsem programme on the 30th day of November are defamatory of the Plaintiffs.”

They have also asked for a retraction and an unconditional apology from the station and the hosts for the ‘defamatory’ comments that were made on the show.
