Hearing of the suit filed by fourteen (14) of the implicated circuit court judges and magistrates seeking to halt the work of the committee investigating the corruption scandal is expected to continue today.
The suit, filed at the Fast Track Division of the Accra Circuit Court is seeking that the court declares as unconstitutional, the composition of the five- member committee of inquiry formed by the Chief Justice to establish the truth. They are also seeking that the court declares as unconstitutional, the process embarked on by the committee of inquiry.
[contextly_sidebar id=”qqylfa5L9kDR4f78qtWjnjI9CPbsiE7o”]The court presided over by Justice Gertrude Torkonoo on Tuesday adjourned the hearing of the case to Friday September 25.
Her reason for the adjournment was to allow lawyers for the magistrates to respond to an application filed the Attorney General (AG) asking for the entire suit filed against the Chief Justice and the Judicial Council to be dismissed.
The decision was arrived at despite the request for an abridgment of time by the AG for the case to be heard on Wednesday instead of the mandatory three days after an affidavit is filed.
Meanwhile the eight judges and magistrates at Wednesday’s sitting staged a walk out protest in a bid to express support for the class action taken by the 14 of their members.
The committee had earlier on suspended sitting following what they referred to as a litany of court cases that has been filed in relation to their work in establishing the truth.
In a related development however, one of the 12 implicated High Court Judges, Paul Derry on Tuesday dropped a decision to secure an injunction to prevent Anas and his team from premiering the video.
The premiere was subsequently held at the Accra International Conference Centre (AICC) despite a court notice served on the management of the facility.
