A Fast Track court has granted an application for substituted service filed by a judge, Paul Dery against investigative journalist, Anas Aremeyaw Anas.

Lawyers for the judge told the court on Tuesday, Anas and his investigative team Tigereye PI have been unavailable in their offices to be served the two writs, although all other defendants have been served.

Justice Paul Dery on September 14, 2015 filed a writ of summons and an interlocutory injunction seeking to stop Tuesday’s premier of the video, which allegedly captured him and other judges, taking bribes.

[contextly_sidebar id=”v63IPRKfy1zB8oL99agJ3sK64YnNoX7C”]Today’s ruling means that Anas would be deemed to have been served the writs when it is posted on the doors of the offices of Tigereye PI and on the notice board of the High Court.

The ruling may also prevent the premiering of the video until after the interlocutory injunction is heard.

Reliefs Justice Dery is seeking

Justice Dery is seeking a declaration that the intended public screening of the contents of the audio visual recordings to the public by Tiger Eye P I at the AICC is prejudicial to the plaintiff’s right to a fair hearing.

He is also seeking an order restraining the defendants and their agents from making the AICC available for the intended public screening of the said video from September 22 to September 23, 2015.

“A perpetual injunction restraining the defendants and their agents from publishing the contents of the illegality and unlawfully procured audio visual recordings at any of its facilities.”

“A perpetual injunction restraining the defendants and their agents from carrying out or making the AICC or any of its facilities available for public screening of the said illegally and unlawfully procured audio visual recordings.”

“Cost including legal fees and any other order (s) that the honourable court may deem fit to make.”
