Francis Xavier Sosu, the lawyer for the 12-year-old girl who was allegedly defiled by a police officer, is calling for the arrest and prosecution of the accused, Lance Corporal Emmanuel Bartels.

The police officer allegedly defiled and impregnated the girl seven months ago.

In an interview with Citi News, Francis Sosu referred to the Criminal and other offences ACT 29 and the criminal procedure Act 30 and revealed that due to the nature of the crime, the accused should have been arrested and brought before court.

“So when a person commits crime such as the one that has been allegedly committed, the person must be arrested and sent to court after the person has been cautioned and charged,” he added, “even if the Attorney General is yet to give advice.”

He further explained that because the offence is not bailable, the person should be on remand now.

Lawyer Sosu said that though the prosecution welcomed the interdiction of the accused, that was not enough.

“The police officer should not be walking about freely as we speak now so it is not enough for him to be interdicted,” he stated, “He must be arrested and sent to court and let the court processes take place.”
