Tema Port based Freight Forwarder, Michael Kweku Gyan, is back in court with fresh lawsuits targeted at stopping the planned West Blue deal with the Government of Ghana.
In the new law suits filed in Accra on Thursday, lawyers for Mr. Gyan are asking for a court injunction that will restraint the Mahama administration from engaging the services of West Blue Ghana Limited until the substantive case, which was also filed today, is determined by the same court.
[contextly_sidebar id=”PNmUhr2KXBOUsE98PyqLXtmNfAUz3svm”]It came just days after Citi News published exclusive details of a leaked Ghana Revenue Authority letter in which the revenue agency asked the various Destination Inspection Companies to prepare to hand over Classification, Valuation and Risk Management functions at Ghana’s ports of entry to West Blue Ghana Limited and GCNET.
Mr. Gyan after filing the suit explained that “there is a lack of transparency in the transition process leading to the implementation of a single window platform, which leaves much to be desired.”
“In spite of my filing of a process today in court for the enforcement of my fundamental human rights, I call on the president of the republic to give equal opportunity to me and all those interested in the implementation of this noble project and live up to the true meaning of the rule of law and due process.”
“I being a citizen of Ghana must feel reassured that equal opportunity is available to all in assessing government contracts and projects. By so doing, Ghanaians and other foreign investors will not only have confidence in our economy but will see a manifest assurance of a level playing field for all. The decision to sole source West blue Ghana limited for the single window project and a planned exclusive use of their software put up by Ghana Custom is just unacceptable,” Mr. Gyan added.
He further noted that “I have every confidence that I will get justice in the law court not fearing any intimidation from the might of the state.”
Two earlier lawsuits filed by Mr. Gyan to stop the government from sole-sourcing the Services of West Blue Ghana Limited were thrown out on July 31 this year, by an Accra court.
In this judgment, the trial judge held that the plaintiff had the capacity to bring the action and that the jurisdiction of the court was properly invoked.
The judge however, dismissed the suits for what he called “non-disclosure of reasonable cause of action.”
