Lawyer for Nathaniel Nortey, the victim of the CAL Bank shooting incident is threatening to petition the Judicial Secretary if the docket on the case is not found.
Nathaniel Nortey was accidentally shot in the leg when a police officer on duty at the Derby Avenue branch of CAL bank opened fire on him and another customer because he was angry.
Nathaniel Nortey who sustained injuries had to be operated upon with the risk of amputation.
According to the lawyer Francis Xavier Sosu, the case has not been heard because the docket cannot be found.
This he says is frustrating their efforts at getting justice.
“The case has been dragging on for some weeks now. We filed a case and had it served on the Attorney General, the Inspector General of Police and the police officer who was involved in the shooting and after twenty one days we expected that they would have entered appearance so we can set the case down for trial but unfortunately our search at the registry shows that they have not entered appearance ,” Lawyer Sosu stated.
Mr Sosu also expressed his displeasure with the progress of the case saying “we do not have any set date for court attendance and we as plaintiff are supposed to set the matter down for appearance but this is not happening because, all attempts on our part to even get our searches answered by the registry of the court have proved futile and that is frustrating our efforts.”
“We have been to the court continuously for over two weeks now and every time out clerks go there, they are told the docket cannot be found .We are however hoping that in a few days the docket is found so the matter can be set down for hearing because we cannot set a date if it is not found. We are however reliably informed that the attorney general has not been able to file a defense in this matter,” Mr. Sosu added.
