Hassan Ayariga’s case ruling May 2, 2014

Hassan AHis Lordship Justice Ofori Atta of an Accra Fast Track High Court will deliver his judgement on a lawsuit brought against national Treasurer of the Peoples National Convention (PNC), Hon. David Apasera by the PNC 2012 Presidential candidate, Mr. Hassan Ayariga.

The expected judgement will determine if Mr. Ayariga’s lawsuit met the requirements of defamation as enshrined in Order 57 rule 2 of CI 47 of the 1992 constitution.

Mr. Hassan Ayariga in his law suit prayed the court to award him compensation for damages and alleged defamation of his character.

According to Mr. Ayariga, the PNC National Treasurer accused him of absconding with GHC 1.6 million meant for the party’s 2012 campaign activities.

However, Counsel for the PNC National Treasurer, Lawyer Eric Osei Mensah prayed the court to dismiss the complainant’s law suit arguing that it was deficient of the requirements of defamation.

Counsel for Mr. Hassan Ayariga, Lawyer Chris Ackumey filed his client’s application in opposition to the accused person’s call for dismissal of the case.

Lawyer Ackumey maintained that his client’s law suit satisfied all the requirements of defamation for which reason the case should be upheld.
