The Executive Director for the Center for Democratic Development (CDD), Professor Emmanuel Gyimah-Boadi has stated that the Commissioner for the Commission of Human Rights and Administrative Justice (CHRAJ) is incompetent.<\/p>\n

\u201cShe does not qualify to occupy the position not by performance of the Commission under her tenure and certainly, not in comparison to her predecessors in the same position,\u201d he said.<\/p>\n

He remarked that Lauretta Vivian Lamptey has within a space of three years, run down the institution and the high reputation which was achieved by her predecessors; Anna Bossman and Justice Emile Short.<\/p>\n

\u201cCHRAJ over the years achieved such heights in the minds of most Ghanaians. It was a very impressive level of performance. They tackled all forms of demons in our governance. Where is CHRAJ today and where is the CHRAJ Commissioner?\u201d<\/p>\n

Ms Lamptey has been accused of spending thousands of dollars on accommodation<\/strong><\/span><\/a>\u00a0while the Commission struggles to undertake its duties with the scarce resources allocated to them by the government.<\/p>\n

Many have criticized CHRAJ for failing to independently investigate and prosecute persons indicted in a high number of corruption scandals which have emerged in recent years.<\/p>\n

Financial Analyst, Sydney Casely-Hayford last Saturday admonished the President, John Mahama to sack Ms Lamptey<\/strong><\/span><\/a> for her incompetence.<\/p>\n

However, on Tuesday, Ms Lamptey told Citi New<\/strong>s that 95% of the Commission\u2019s mandate<\/strong> <\/span><\/a>is to deal with human rights issues while the remaining 5% tackles issues of corruption.<\/p>\n

But speaking on the Citi Breakfast Show<\/strong>, Prof. Gyimah-Boadi questioned the criteria she used in determining which of the mandate the commission must concentrate on.<\/p>\n

He further chastised her for failing to carry out her constitutional mandate by concentrating on the human rights aspect to the detriment of ridding the country of corruption.<\/p>\n

\u201cIf she decides to focus on areas for which there are other equally good state service providers and ignores the aspects of her mandate where by virtue of its constitutional independence, is uniquely placed to discharge, that I will consider to an abuse of power,\u201d he remarked.<\/p>\n

According to him, Ghanaians do not politicize the activities and investigations of CHRAJ unlike that of the Economic and Organized Crime Office (EOCO), the Ghana Police Service, the Criminal and Investigation Department (CID), the Attorney General (AG).<\/p>\n

\u201cWhen they conduct investigations, they tend to be politicized so CHRAJ does have a constitutional locus that should enable it to do a much better and great independence to do a better job,\u201d he said.<\/p>\n

The CDD boss asked Ms Lamptey to examine how her predecessors, Anna Bossman and Justice Emile Short were lauded for \u201cdoing work which we all appreciated and how can she have sort refuge in the softer side of her mandate.\u201d<\/p>\n

He is therefore calling for an urgent review to be made to the processes through which heads of constitutional bodies such as CHRAJ are appointed saying, \u201cI think we need to revisit the leadership of these institutions.\u201d<\/p>\n

He stressed that the review is needed because \u201cthe performance of this lady calls into question the Council of State at the time which consulted in the making of this appointment and what did they know that made the approve it.\u201d<\/p>\n

Prof Gyimah-Boadi bemoaned the growing trend where the filling of important state constitutional bodies \u201cis increasingly becoming a unilateral decision by the Presidency. What background check was done?\u201d<\/p>\n

\u201cWould anybody have appointed this lady for her to be an Appeals Court judge which is the equivalent of the position that she currently occupies?\u201d he asked.<\/p>\n

He continued saying, \u201cwhen you put somebody at her age in a position like that, then that person performs abysmally and would not allow herself to be corrected\u2026 for these reasons alone, I think that we have to revisit this whole process of appointing\u2026because once you have them, you have to live with them.\u201d<\/p>\n
