{"id":45051,"date":"2014-09-05T12:39:43","date_gmt":"2014-09-05T12:39:43","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=45051"},"modified":"2014-09-05T12:54:08","modified_gmt":"2014-09-05T12:54:08","slug":"court-throws-out-bitter-ndc-member-casecourt-throws-out","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/2014\/09\/court-throws-out-bitter-ndc-member-casecourt-throws-out\/","title":{"rendered":"Court throws out &#8216;bitter&#8217; NDC member case"},"content":{"rendered":"<p id=\"yui_3_16_0_1_1409813968179_278185\">A High Court in Accra has dismissed a suit filed by an aggrieved member of the National Democratic Congress (NDC) who attempted to place an injunction on the Greater Accra Regional elections.<\/p>\n<p>The plaintiff, Bossman Oduro-Fosu,\u00a0<span style=\"color: #666699;\"><a href=\"http:\/\/4cd.e16.myftpupload.com\/2014\/08\/24\/ndc-member-drags-party-to-court\/\" target=\"_blank\"><span style=\"color: #666699;\"><strong>sued the NDC for flouting aspects of the party\u2019s constitution<\/strong><\/span><\/a> <\/span>on the election of party executives.<\/p>\n<p>In his statement of claim, Mr Oduro-Fosu asked the court to declare the results issued by the National Executive Committee (NEC) for the election of party executive officers for 2014 as unconstitutional.<\/p>\n<p>[contextly_sidebar id=&#8221;FH6nN3ZpqTc1VQSbSP3eij04d8pHchAG&#8221;]He also argued that the supposed addition was in direct conflict with Article 42 (1) of the NDC constitution.<\/p>\n<p>Mr. Oduro-Fosu again sought revocation of paragraph 6 (c) VI of the party\u2019s constitution which states that\u00a0\u201cIn addition, a member of the party shall not qualify to vie for a regional executive committee position unless the member has prior to seeking elections, held an executive position in the constituency.\u201d<\/p>\n<p id=\"yui_3_16_0_1_1409813968179_278261\">But the court after hearing arguments from the both counsels dismissed the case saying, it lacked merit.<\/p>\n<p>The ruling means the party can now go ahead to organize its constituency and regional elections.<\/p>\n<p>This will pave way for the national congress for party delegates to elect national executives.
