{"id":360933,"date":"2017-10-11T05:50:33","date_gmt":"2017-10-11T05:50:33","guid":{"rendered":"http:\/\/citifmonline.com\/?p=360933"},"modified":"2017-10-11T05:50:33","modified_gmt":"2017-10-11T05:50:33","slug":"exton-cubic-finally-sues-amewu-over-withdrawal-of-permit","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/2017\/10\/exton-cubic-finally-sues-amewu-over-withdrawal-of-permit\/","title":{"rendered":"Exton Cubic finally sues Amewu over withdrawal of permit"},"content":{"rendered":"<p>After a number of threats, the embattled mining company, Exton Cubic Group Limited, has sued the Minister of Lands and Natural Resources over the Ministry\u2019s revocation of their mining permits.<\/p>\n<p>The Minister, John Peter Amewu, revoked the company\u2019s leases and licenses to prospect in the Nyinahini bauxite concession of the Tano Offin Forest Reserve, describing the company\u2019s operations there as illegal because of invalid mining leases.<\/p>\n<p>[contextly_sidebar id=&#8221;HNz8ywxTH05SbMrwbo4pv1PG9wcAIJBz&#8221;]Prior to this, the Environmental Protection Agency (EPA), had indicated that Exton Cubic reneged on\u00a0commitments to submit a liability estimate of environmental degradation, among others.<\/p>\n<p>But Exton Cubic, in an application for a review of the decision at the High Court, has argued that the Minister\u2019s decision was unreasonable, unjust, and an abuse of his powers.<\/p>\n<p>The company, among others, is seeking a declaration that &#8220;the Minister of Lands and Natural Resources acted ultra vires [beyond] his statutory powers when he revoked Exton Cubic Group Limited mining leases.\u201d<\/p>\n<p>It also contends that, revoking of its license was \u201cbreach of the rules of natural Justice\u201d, and in breach of the company\u2019s \u201crights to administrative justice and property.\u201d<\/p>\n<p>Exton Cubic is further seeking an order quashing the minister\u2019s decision to revoke the mining leases, and \u201can order of injunction restricting the Minister of Lands and Natural Resources or his agents from interfering with Exton Cubic\u2019s rights acquired.\u201d<\/p>\n<p>Aside from this, the company also wants to protect its rights to the concession, and is thus seeking an order of injunction preventing the Ministry \u201cfrom granting the rights acquired by Exton Cubic Group to any other person.\u201d<\/p>\n<figure id=\"attachment_348394\" aria-describedby=\"caption-attachment-348394\" style=\"width: 620px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" class=\"size-large wp-image-348394\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2017\/08\/Sammy-Gyamfi-1024x683.jpg\" alt=\"Sammy Gyamfi, PRO of Exton Cubic\" width=\"620\" height=\"414\" \/><figcaption id=\"caption-attachment-348394\" class=\"wp-caption-text\">Sammy Gyamfi, PRO of Exton Cubic<\/figcaption><\/figure>\n<p>Since the start of this saga in August\u00a02017, Exton Cubic <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/citifmonline.com\/2017\/09\/05\/well-sue-govt-over-withdrawal-of-exploration-permit-exton-cubic\/\">has threatened<\/a><\/strong><\/span> to use available legal means to overturn government\u2019s revocation of its license, although Mr. Amewu maintained that, the mining company\u2019s processes in acquiring the lease were questionable.<\/p>\n<p>\u201cThe processes leading to the grant of the license were not quite clear and were not transparent, very opaque. So it called for a lot of questions.
