Former Attorney General, Martin Amidu, may not get the opportunity to orally examine Alfred Agbesi Woyome in the GHc 51 million judgement debt saga today [Thursday] according to a private legal practitioner, Yaw Oppong.<\/p>\n
Martin Amidu, was scheduled to interrogate the embattled businessman over how he intends to pay back the GHc 51 million judgment debt unlawfully paid \u00a0him.<\/p>\n
[contextly_sidebar id=”j6jEkjLpd2yFNb9DLLG2GFMCdo9fLseF”]But on Wednesday Mr. Woyome\u2019s lawyers filed two writs in the Supreme Court seeking a review of an earlier decision that would have allowed Mr. Amidu to examine Alfred Woyome.<\/p>\n
Commenting on the development on Eyewitness News<\/strong>, Mr. Oppong said \u00a0the \u00a0latest application may hold the court up.<\/p>\n He explained that, \u201cgenerally, when there is an application pending, when a decision is given in the course of hearing a matter in an interlocutory application for injunction for example, and the person is aggrieved by or dissatisfied with it and the person files an appeal, the person can then fill an application for a stay of proceedings.\u201d<\/p>\n \u201cWhen that is brought to the notice of the judge, who was hearing the original case may then find himself or herself held up pending the final determination of the interlocutory appeal before the court,\u201d Mr. Oppong stated as he noted that some Judges find that once such a writ is filed and brought to their notice “their hands are tied up by it.\u201d<\/p>\n One of these applications is praying the Supreme Court to review the ruling of the court presided over by Justice Enin Yeboah a week ago that permitted the oral examination. The second application is a request for a stay of proceedings to enable the court to determine the motion for review.<\/p>\n A stay of proceedings is a ruling by the court in civil and criminal procedure, halting further legal process in a trial or other legal proceedings.<\/p>\n Justice Yeboah had approved Martin Amidu’s request to orally examine\u00a0Alfred Agbesi Woyome, the man at the centre of the controversial GHC 51 million judgement debt saga.<\/p>\n
