An Accra High Court has dismissed the suit filed against the government over its plans to cede part of the operations of the Electricity Company of Ghana (ECG) to a private company.<\/p>\n
According to the ruling delivered by Justice Norvice Aryene, the plaintiff lacked capacity in bringing the suit to court as they failed to show how the privatization will affect him personally.<\/p>\n
The plaintiff, Saaka Salia, who is also member of the opposition New Patriotic Party\u2019s (NPP) communications team sued\u00a0the Millennium Development Authority(MiDA), arguing that it is not fit to participate as an adviser in the concession arrangement for the ECG because its conduct\u00a0breached Ghana\u2019s laws after it authored and circulated a draft tariff methodology.<\/p>\n
Mr. Salia\u2019s writ asserted\u00a0that, the PURC, not MiDA is the body with exclusive mandate by law to provide guidelines for determining tariffs and levels of tariffs, and in doing so in the manner prescribed by Act 538.<\/p>\n
But the Justice Aryene dismissed the case emphasizing that Mr. Salia\u00a0lacked the capacity in bringing the suit to court as he failed to show how the privatization affected him.<\/p>\n
MiDA described suit as incompetent\u00a0<\/strong><\/p>\n Speaking to Citi Business News earlier, the Chief Executive Officer of MiDA, \u00a0Ing.
