{"id":263994,"date":"2016-11-01T12:30:02","date_gmt":"2016-11-01T12:30:02","guid":{"rendered":"http:\/\/citifmonline.com\/?p=263994"},"modified":"2016-11-01T12:30:02","modified_gmt":"2016-11-01T12:30:02","slug":"withdraw-supreme-court-lawsuit-akoto-ampaw-urges-ec","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/2016\/11\/withdraw-supreme-court-lawsuit-akoto-ampaw-urges-ec\/","title":{"rendered":"Withdraw Supreme Court lawsuit &#8211; Akoto Ampaw urges EC"},"content":{"rendered":"<p>A private legal practitioner, Akoto Ampaw has urged Ghana\u2019s Electoral Commission (EC) to withdraw its lawsuit challenging the judgement by an Accra High Court on the disqualification of the flagbearer of the Progressive People\u2019s Party (PPP), Papa Kwesi Nduom from the presidential elections.<\/p>\n<p>Speaking on The Ghana Report TV show on Monday, Mr Ampaw expressed shock at the move by the Commission, given the limited number of days to the country\u2019s general elections.<\/p>\n<p>He told host, Bernard Avle that, \u201cthe principles for &#8216;certiorari&#8217; when you apply to the high court to quash a decision of an inferior tribunal like the Electoral Commission (EC) are not the same as the principles required to quash a decision of the High Court by the Supreme Court.\u2019\u2019<\/p>\n<p><a href=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/11\/14938094_1199775430097477_5012431871876821047_n.jpg\"><img loading=\"lazy\" class=\"aligncenter size-full wp-image-264081\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/11\/14938094_1199775430097477_5012431871876821047_n.jpg\" alt=\"14938094_1199775430097477_5012431871876821047_n\" width=\"600\" height=\"400\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Mr Akoto Ampaw suggested that the EC may not succeed in its bid to have the judgement overturned at the Supreme Court.<\/p>\n<p>He argued that the superior courts are assumed to know the law hence such cases against its judgement at the Supreme Court can only be won on the grounds of conditions including the lack of jurisdiction or the principles of natural justice.<\/p>\n<p><strong>\u2018PPP floors EC in court\u2019<\/strong><\/p>\n<p>On Friday October, 29, an Accra High Court ruled in favour of the flagbearer of the Progressive People\u2019s Party (PPP) Dr. Papa Kwesi Nduom who challenged his disqualification from the presidential contest in the 2016 elections by the Electoral Commission.<\/p>\n<figure id=\"attachment_249735\" aria-describedby=\"caption-attachment-249735\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" class=\"size-full wp-image-249735\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/09\/Nduom-EC-1.jpg\" alt=\"(PPP Flagbearer, Dr. Paa Kwesi Nduom, and EC Chair, Charlotte Osei).\" width=\"600\" height=\"400\" \/><figcaption id=\"caption-attachment-249735\" class=\"wp-caption-text\">(PPP Flagbearer, Dr. Paa Kwesi Nduom, and EC Chair, Charlotte Osei).<\/figcaption><\/figure>\n<p>The EC had disqualified Dr Nduom due to some errors it had identified in the latter\u2019s nomination forms but the court, presided over by Justice Eric Kyei Baffour directed the commission to allow Dr. Nduom correct the errors on the nomination form and be afforded the opportunity to contest in the elections.<\/p>\n<p>The court noted that the EC erred in its decision and disobeyed its own rule stated in Regulation 9 in the CI 94.<br \/>\n<strong>\u2018EC runs to Supreme Court over High court judgement\u2019<\/strong><\/p>\n<p>Electoral Commission on Monday [October 31], said it will appeal the High Court judgement that quashed Dr Nduom\u2019s disqualification from the December 7\u00a0presidential polls.<\/p>\n<p>A statement signed by the Head of Communications at the EC, Kofi Dzakpasu, said the commission has filed an application for review of the ruling at the Supreme Court to seek clarity on the matter.<\/p>\n<p>The statement said its decision to disqualify the aspirant, is in the interest of public policy and credibility of the electoral process.<\/p>\n<p>\u201cIn the interest of public policy and the credibility of the electoral process, the Commission has today [Monday, October 31, 2016] filed an application at the Supreme Court to quash the High Court decision and seek clarity on the relevant aspects of the law on candidate nominations,\u201d the statement said.<\/p>\n<p>&nbsp;<\/p>\n<p>&#8211;<\/p>\n<p>By: Gifty Tracy Aminu\/citifmonline.com\/Ghana<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A private legal practitioner, Akoto Ampaw has urged Ghana\u2019s Electoral Commission (EC) to withdraw its lawsuit challenging the judgement by an Accra High Court on the disqualification of the flagbearer of the Progressive People\u2019s Party (PPP), Papa Kwesi Nduom from the presidential elections.
