{"id":261620,"date":"2016-10-25T12:02:30","date_gmt":"2016-10-25T12:02:30","guid":{"rendered":"http:\/\/citifmonline.com\/?p=261620"},"modified":"2016-10-25T12:02:30","modified_gmt":"2016-10-25T12:02:30","slug":"court-to-rule-on-ppp-case-on-friday","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/2016\/10\/court-to-rule-on-ppp-case-on-friday\/","title":{"rendered":"Court to rule on PPP case on Friday"},"content":{"rendered":"<p>The Accra High Court hearing the lawsuit filed by the Progressive People\u2019s Party (PPP) seeking to restrain the Electoral Commission (EC) from proceeding with the balloting for positions of presidential candidates will give its judgement on Friday, October 28, 2016.<\/p>\n<p>The PPP is\u00a0also challenging the EC\u2019s <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/citifmonline.com\/2016\/10\/10\/ayarigas-apc-ppp-pnc-others-disqualified-from-2016-polls\/\">decision to disqualify<\/a><\/strong><\/span> its presidential aspirant, Dr. Papa Kwesi Nduom, from the presidential race.<\/p>\n<p><a href=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/10\/Nduom-PPP-Court-Case-agaisnt-EC-4.jpg\"><img loading=\"lazy\" class=\"aligncenter size-full wp-image-261663\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/10\/Nduom-PPP-Court-Case-agaisnt-EC-4.jpg\" alt=\"nduom-ppp-court-case-agaisnt-ec-4\" width=\"600\" height=\"337\" \/><\/a><\/p>\n<p>The party has since said <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/citifmonline.com\/2016\/10\/25\/ppp-to-go-to-supreme-court-if-lawyer\/\">it will go to the Supreme Court<\/a><\/strong><\/span> if the High Court hearing its case against the EC\u00a0fails to rule in its favour.<\/p>\n<p>In response to a query on what the party would do if the judgment on Friday does not go the PPP&#8217;s way, Lawyer for the party, Ayikoi Otoo simply said, \u201cwe will go to the Supreme Court.\u201d<\/p>\n<p><img loading=\"lazy\" class=\"size-full wp-image-261758 aligncenter\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/10\/ppp-at-ghana-high-court-3.jpg\" alt=\"ppp-at-ghana-high-court-3\" width=\"768\" height=\"512\" \/><\/p>\n<p><strong>Background<\/strong><\/p>\n<p>Dr. Nduom was disqualified along with \u00a012 other presidential aspirants after anomalies were cited in his filed nomination forms.<\/p>\n<p>At the last hearing of this case on October 20, the court <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/citifmonline.com\/2016\/10\/20\/ppps-case-against-ec-moved-to-october-25\/\">granted an application<\/a><\/strong><\/span> by the EC to abridge the time for the hearing of the injunction suit from going ahead with the processes to conduct elections in December.<\/p>\n<p><img loading=\"lazy\" class=\"size-full wp-image-261759 aligncenter\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/10\/ppp-at-ghana-high-court-4.jpg\" alt=\"ppp-at-ghana-high-court-4\" width=\"768\" height=\"431\" \/><\/p>\n<p>According to its writ, the PPP is seeking an order of prohibition to restrain the EC from proceeding with balloting for position of presidential candidates for the 7th December elections.<\/p>\n<p>The plaintiff is also seeking \u201c\u2026a further order directed against the 1st Respondent in her capacity as Returning Officer for Presidential elections to grant the Applicant the opportunity to amend and alter the one anomaly found in his nomination papers as well as accept his nomination papers as amended or altered to enable him contest as a Presidential Candidate for the 7th December 2016 elections.\u201d<\/p>\n<p><img loading=\"lazy\" class=\"size-full wp-image-261763 aligncenter\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/10\/ppp-at-ghana-high-court-1.jpg\" alt=\"ppp-at-ghana-high-court-1\" width=\"768\" height=\"456\" \/><\/p>\n<p>The suit has Dr. Papa Kwesi Nduom as the exparte applicant, Charlotte Osei, the EC Chairperson, as the first respondent, and the EC as the second respondent.<\/p>\n<p>The writ noted that, \u201cHon.
