{"id":224400,"date":"2016-06-22T06:05:52","date_gmt":"2016-06-22T06:05:52","guid":{"rendered":"http:\/\/citifmonline.com\/?p=224400"},"modified":"2016-06-22T06:05:52","modified_gmt":"2016-06-22T06:05:52","slug":"petitioning-chraj-over-mahama-ford-gift-needless-ndebugri","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/2016\/06\/petitioning-chraj-over-mahama-ford-gift-needless-ndebugri\/","title":{"rendered":"Petitioning CHRAJ over Mahama Ford gift needless &#8211; Ndebugri"},"content":{"rendered":"<p>A private legal practitioner, John Ndebugri, believes any potential investigation by the Commission for Human Rights and Administrative Justice (CHRAJ) into President John Dramani Mahama\u2019s acceptance of a Ford Expedition gift from a Burkinabe contractor,\u00a0will be an exercise in futility.<\/p>\n<p>\u201cIf the petitioners are seeking to condemn the President for misconduct or bringing the name of the republic of Ghana into disrepute, I doubt if the investigations by CHRAJ will lead to anything useful,\u201d Mr. Ndebugiri stated on <strong>Eyewitness News<\/strong>.<\/p>\n<p>On Tuesday, CHRAJ revealed it has initiated steps that could lead to an\u00a0investigation of President Mahama, following the<span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/citifmonline.com\/2016\/06\/21\/chraj-confirms-receipt-of-petitions-to-probe-mahamas-ford-gift\/\"> receipt of two petitions<\/a><\/strong><\/span> pertaining to the Ford Expedition gift given to him by a Burkinabe contractor.<\/p>\n<p>The two petitions were forwarded\u00a0to the Commission by\u00a0the youth league of the Convention People\u2019s Party (CPP) and a private individual.<\/p>\n<p><strong>Petitioners would be better off seeking impeachment<\/strong><\/p>\n<p>Bearing in mind Article 57, Chapter 5 of the constitution which indicates that the President shall not be personally liable to any civil or criminal proceedings in court, Mr. Ndebugri said the petitioners would have been better served pursuing President Mahama with Article 69 of the constitution which deals with the removal of presidents.<\/p>\n<p>\u201cThen why will they not go straight away to article 69 and invoke those provisions to remove the president so that it will be constitutionally sanctioned,\u201d he opined.<\/p>\n<p>Mr. Ndebugri also intimated that, the Supreme Court may have to be involved for a definite interpretation for Article 57:5 saying \u201cthe right place to go and get a definitive pronouncement on this Article 57: 5 will be the Supreme Court and not CHRAJ.\u201d<\/p>\n<p><strong>CHRAJ investigation hopeless<\/strong><\/p>\n<p>That notwithstanding, Mr. Ndebugri does not see much coming out of the petitions which he said will ultimately prove futile as the constitution would keep them from doing anything decisive to President Mahama.<\/p>\n<p>\u201cWhen CHRAJ comes out with the decision that it was wrong for the president to accept the Ford Expedition, what next? What can CHRAJ then do?
