Barely 24 hours after an Accra High Court dismissed his contempt case against some media personalities in the country; Justice Paul Uuter Dery has returned to the court to file an appeal.

He argued that the judge who presided over the matter, Justice Gertrude Torkonoo “erred” in dismissing the case which according to him, was scheduled to be heard on October 12th 2015.

[contextly_sidebar id=”c1GWPoIVuyIhnpj9u5JeCU9be77ZBjMg”]Justice Dery also insisted that he was not informed about Tuesday’s hearing and “thus breached his right to be heard.”

He also added that all the four persons cited in the contempt case have not yet been served with the said application and that “the judge [also] erred when she dismissed the Appellant’s Contempt Application on the ground that the Appellant had withdrawn his Interlocutory Injunction Application.”

Justice Dery is praying the court to reverse the decision of the earlier ruling.

Mr. Dery had prayed the court presided over by Justice Gertrude Torkonoo to convict and punish the Chief Executive Officer of Starr FM, Nathaniel Kwabena Anokye Adisi [Bola Ray], the Acting Editor-In-Chief of the New Crusading Guide, Samuel Frempong Addo, Deputy Editor of the New Crusading Guide, Ernest Addo and the Executive Director of the Media Foundation for West Africa (MFWA), Sulemana Braimah.

He had sued them for various roles they played in publicising the screening of the video which allegedly captured him and other judges taking bribes.

But the judge struck out the case saying the applicant had withdrawn the substantive case against the showing of the Anas video hence her ruling.

Justice Dery had through his lawyer, Nii Kpakpo Samoa Addo, petitioned the Judicial Council to investigate the dismissal of his contempt application
