The Supreme Court has dismissed Martin Amidu’s claim that President John Dramani Mahama personally ordered the discontinuation of the application by the Attorney-General to examine businessman Alfred Woyome, over the repayment of the ¢51 million judgment debt paid to him.

The former Attorney General in his application praying the court to allow him to orally examine Woyome last week, alleged that the Attorney General’s decision to discontinue the oral examination of Mr Woyome in court, was upon an order by President Mahama.

Martin Amidu said after Woyome was informed of the AG’s decision to orally examine him, he threatened the President he will reveal the names of all those who benefited from the judgment debt booty if nothing is done to prevent the oral examination.

According to Martin Amidu, that led to the President’s order to the AG to discontinue the case.

However, the Attorney General in an opposing application described the allegation as “scandalous, offensive, malicious and deliberate falsehood.”

“The President never suggested, directed or instructed me to discontinue the request of this office to orally examine the judgment debtor. The only reason this office has discontinued its request to orally examine the 3rd Defendant [Woyome] is because of a request made by the 3rd Defendant [Woyome] to pay the judgment debt by installments.”

The Supreme Court on Wednesday, November 17, granted Martin Amidu his request to orally examine Mr. Woyome on his assets with regards to the retrieval of the GHc51.2 million judgment debt paid to him.

The court in its ruling said Mr. Amidu has a right under Article 2 of 1992 constitution, to invoke the original jurisdiction of the Supreme Court especially as he was a party to the case.

It however, struck out the allegations made against the AG, Marietta Brew Appiah-Oppong and President John Mahama.

AG stopped Woyome case to consider settlement’

The President also described Martin Amidu’s allegation as falsehoods; brewed for the “purposes of political propaganda.”

He disputed his involvement in the Attorney General’s decision to discontinue the case.

Speaking at the Ghana Broadcasting Corporation’s presidential encounter series on Wednesday, he explained that, the AG put in the application for oral examination, but at the same time, “discussions had been ongoing in respect of a settlement and before that happened, a terms of settlement was granted.”

The National Organizer of the National Democratic Congress (NDC) has said that former Attorney General. Martin Amidu’s recent legal challenges and utterances regarding the GH¢51m Woyome judgement debt are borne out of jealousy.

Kofi Adams described Martin Amidu’s action as deliberately seeking to discredit the efforts of the current Attorney General, Marrietta Brew Appiah-Oppong.

Martin Amidu, a former Attorney General, was recently granted a request at the Supreme Court to orally examine businessman, Alfred Agbesi Woyome who is currently facing legal actions to repay some GH¢51 million wrongfully paid to him by the state in 2010.

Martin Amidu who welcomed the Supreme Court ruling in a statement suggested that the money cannot be retrieved from Woyome if Ghanaians do not vote out President John Mahama.

But according to the party’s organizer, Kofi Adams, such comments were mere out of jealousy of the hard work of the current AG who has achieved more than Martin Amidu did during his tenure as AG during the erstwhile President Attah-Mills administration.

Speaking on Eyewitness News on Thursday, November 17, Kofi Adams said: “We are talking about an Attorney General today who has saved this country millions of cedis or dollars that we would have paid as judgement debt. What did he [Martin Amidu] do as an Attorney General? There was nothing much to his credit as an Attorney General.”

“For someone who has been a Deputy Attorney General before, maybe we would have expected much more, [but] we say nothing, so what he is doing is that; ‘this woman is doing so well and I [Amidu] was a disaster as an Attorney General so let me attempt to discredit her.”

Kofi Adams accused Martin Amidu of fabricating lies against the current Attorney General to create public disaffection towards her and her office.

“You should clearly see that Martin Amidu is up to an agenda. He is not speaking based on truth, he is speaking based on lies. The current AG has done so well that Martin cannot match [up to] her,” Kofi Adams said.

‘NDC won’t waste time on Amidu’

The 2016 NDC campaign Coordinator, Kofi Adams has also said the party would remain focused on its bid to win power as the election day draws closer and would not waste time in focusing attention on Amidu.

“At this moment, we don’t want to spend time on Martin Amidu. We are very focused. We will tell our stories. Our story is out there. The great job of President Mahama and his government is out there; and that is what the people will be looking at to vote,” he said on Eyewitness News.

Pressure group, OccupyGhana has lauded the Attorney General (AG) for its latest action on recovering some GH¢51 million wrongfully paid to Alfred Woyome as judgement debt.

It also urged the AG’s department to pursue the case to its logical conclusion to ensure Woyome repays the full amount.

The Attorney General in a writ to the court prayed that it orders Mr Woyome to be examined orally on his assets.

This comes after Woyome failed to pay the judgement debt to the country despite a Supreme Court order to pay back the GH¢51million judgement debt in 2014.

A former Attorney General, Martin Amidu challenged the legality of the payment of the judgment debt to Mr Woyome, Waterville and Isofoton, leading to a court action to demand that the money be paid back to the state.

OccupyGhana in a statement on Tuesday said it was “gratified” to learn of the developments on the matter.

“This step can be very effective because it is not only intended to be a mere examination of the debtor, but a cross-examination, and that of the severest kind, as to his means. Thus, a debtor would be compelled by the court to disclose where all of his assets are, and if they have been sold or paid out, how that happened. If the debtor does not disclose the assets or tells lies, he could be imprisoned for contempt or worse, tried and sentenced for perjury,” it said.

OccupyGhana said although the AG’s action has been long overdue, it will help bring to book persons who have unlawfully received money from government.

It said, “We believe that for the people of Ghana, this will be an opportunity to discover exactly what happened to our monies that were wrongfully paid to Woyome, and to recover those monies”

“While expressing our satisfaction with the latest and drastic step, however belated it has been, we wish to notify the Attorney-General that we are monitoring this process and the execution of the court order very closely. We believe that the Attorney-General is taking all of these steps, however belatedly, in a genuine attempt to recover the monies that Woyome still owes to Ghana. We also believe that this process will be followed through without fear or favour, or any delays or attempts to vacate the court order or discontinue this crucial enforcement step,” it concluded.
