Lawyers of the five interdicted principal officers of the University of Education, Winneba, have written to the University Council, demanding their immediate reinstatement.

They have threatened to go to Court if their demands are not met within 7 days.

The officers, including the Vice Chancellor, Professor Mawutor Avoke and Finance Officer, Dr. Theophilus Senyo Ackorlie, were directed by the University Council to step aside for investigations into allegations of financial malfeasance against them.

This follows legal actions involving the university, the local chapter of the teacher union, and some private citizens.

But the lawyers in a letter to the University’s Council, argued that the Council has a calculated agenda to frustrate the officers.

They thus demanded “An immediate and unconditional reinstatement of the Affected Officers, especially (Ing. Daniel Tetteh, Ms. Mary Dzimey, Mr. Frank Owusu Boateng, Dr. Theophilus Senyo Ackorlie and Prof. Mawutor Avoke,) to their various offices to perform their functions in accordance with law.”

The lawyers also demanded an an immediate and unconditional restoration of the salaries, allowances and privileges attached to the various offices of the Affected Officers, which have been withdrawn as well as an “immediate payment of all outstanding salaries and allowances withheld from the affected officers together with interest thereon.”

Below are other reliefs sought by the lawyers:

  • An immediate cessation of all acts and practices calculated to frustrate the Affected Officers in the performance of their functions and/or remove them from office.
  • An immediate dissolution of the Fact-Finding Committee and an immediate halt to any investigations by the said Committee.
  • Definitive steps to ensure that the Chairperson of the Council and the Pro ViceChancellor are not involved in the setting up of any Committee to investigate the contracts, the subject matter of the court action, or any other contract in which they were involved in its promotion, negotiation, award, execution, payment or commissioning.
  • Definitive steps to ensure that any person or body of persons set up to consider the report of any Committee in respect of the said contracts does not include the Chairperson of the Council or the Pro Vice-Chancellor.

Background

In a 23rd May 2017 writ issued, the plaintiff [Supi Kwayera] adduced that the university’s council’s mandate had expired in November 2013, but the Education Ministry failed to constitute a new Governing Council for the university, and rather allowed and permitted the defunct Governing Council which had no mandate whatsoever to continue the functions of a properly constituted Governing Council as if same had been properly constituted.

This Mr. Kwayera insisted was unlawful, and hence his legal action against the University of Education, Winneba.

However, before the substantive claims were looked into, the University, through its counsel, applied to the court to dismiss the suit on the three counts, but the application was dismissed.

The University’s branch of the University Teachers’ Association of Ghana (UTAG) as a respondent subsequently applied to join the application.

In June this year, the plaintiff prayed the to effect an interlocutory injunction restraining the 1st Respondent, its assigns, agents, officers and all other persons acting through the 1st Respondent or claiming to be the lawful representatives of the 1st Respondent from authorizing any payment to any contractor or supplier whose contract is the subject matter of the substantive application before the court.

Again,the injunction was to restrain the 2nd Respondent from recognizing any supposed Principal Officer or any person whose mandate as an officer of the 1st Respondent emanated from the defunct Governing Council as the lawful representative(s) of the 1st Respondent until the final determination of the substantive application.

The injunction also sought to restrain the 1st Respondent and its lawful representatives from making any payment to Ghana Highway Authority or any third party entity including Larmas Construction (GH) Ltd in respect of a Memorandum of Understanding with Ghana Highway Authority for road maintenance until the final determination of the substantive application.

The Supreme Court today [Wednesday], overturned the ruling of a High Court against the University of Education Winneba (UEW) and two of its Principal Officers; the Vice Chancellor Professor Mawutor Avoke, and the Finance Officer, Dr. Theopholus Senyo Ackolier.

The High Court last week ruled that, the two officers of the University are guilty of procurement offences and other financial irregularities.

It also awarded eight thousand cedis in damages against the University, and ordered the retrieval of monies paid to one Paa Nii Lamptey.

But the Supreme Court today [Wednesday], hearing an application for certiorari by the UTAG Winneba branch, took the view  that the High Court did not have the jurisdiction to hear the matter.

A Former UTAG President, Samuel Bekoe, who made this known Citi News said : “Today at the Supreme Court, our application for certiorari and passion for the ruling has been granted by the Supreme Court which therefore means the ruling given by the High Court on the 14th of July, which is the injunction application, and then the 14th of December, the ruling on the substantive case, no longer holds because the very roots of the case is what has been quashed, and so technically there was no case before the judge for the judge to rule on it. We are very excited about the ruling. This is all that we were seeking to do . We wanted the right thing to be done and today the Supreme Court has upheld our argument.”

He was however quick to add that, the case had not “ended” yet, as the “University Council based on this issue and the High Court issue, has also come out with some decisions that should be taken.”

The Governing Council of the University of Education, Winneba (UEW), has rejected claims that its decision to ask six top officials of the institution to step aside pending the outcome investigations into an alleged misconduct, is prejudicial to a pending court case.

The Council in a statement signed by its Chairman, Prof. Emmanuel Nicholas Abakah, said “The stepping aside is without prejudice to the outcome of the issues at the courts.”

“We urge the general public to crosscheck their facts before making pronouncements on the decisions taken by the governing council of the University of Education, Winneba,” the statement added.

The school is currently under investigation after a complaint was filed by one Supi Kofi Kwayera, alleging financial and procurement irregularities.

Some persons, who are keenly interested in the matter have however criticized the decision saying it could be prejudicial against the case in court.

Prof. Abakah further explained that, asking the six officers in question to step aside was in respect of the ongoing investigation.

“We wish to put on record that the recent decision of the governing council to request six (6) of our officers to step aside was purely in respect of the on-going investigations by EOCO, BNI and the Governing Council,” the statement added.

The affected UEW officers are:

1.Prof. Mawutor Avoke, Vice Chancellor

2.Dr. Theopilus Senyo Ackorlie, Finance Officer

3.Mr. Frank Owusu Boateng, Deputy Finance Officer

4.Ms Sena Dake, Internal Auditor

5.Ms. Mary Dzimey, Ag. Head of Procurement

6.Ing. Daniel Tetteh, Ag. Deputy Director of Workds & Physical Development

The local chapter of the University Teachers Association of Ghana (UTAG), at University of Education, Winneba (UEW), has threatened to sue the Governing Council of UEW, over its decision to interdict the school’s Vice Chancellor and four other top officials.

The officials were asked to step aside after it was discovered that some files at some offices under investigation in the school, had gone missing.

Interdiction was unfair

[contextly_sidebar id=”Nx9Qwyti2GaURZ2hythVNV9rVEuF8InB”]Speaking on Eyewitness News however, Secretary of the local chapter of UTAG at UEW, Dr. Ahmed Jinapor said the interdiction was “unfair ”, since the High Court of Winneba had placed an injunction on the Vice Chancellor to stay away from work  since July 14.

He also indicated that, the interdiction was flawed, given that Mr. Jinapor was not given a fair hearing.

“The Vice Chancellor has been asked to step aside by a competent court of jurisdiction over this whole issue. The issue of financial malfeasance, misappropriation of funds is before a competent court of jurisdiction and the High Court based on its hearings from both sides of the pendulum has come to the conclusion that we are going to give a verdict on the 28th of November, so why come out with this letter telling him to step aside again on an allegation that he has not even been questioned.  He was never given an opportunity to defend himself,” argued Mr. Jinapor.

Mr. Jinapor believes the UEW Council could have resorted to a more suitable approach if it was indeed established that the officials had a hand in the development.

“Since July 14, the Vice Chancellor was asked to step aside and he never went to the office and if he never went to the office how could he have pulled files from the office? And if he did that, will amount to contempt of court? The best way to go about this is to fight him for contempt. Our fear and our hope and our prayer is that, this decision does not lead the Winneba  High Court in its decision. If it is anything of that sort, I can tell you for a fact that UTAG is going to resist it. If it means going to court to challenge it, why not?” he said.

“We are very unhappy about this, and we think that Counsel should as a matter of urgency, revisit the decision that has been taken, and they should more or less see their stance in terms of the impasse that is going on in the University. The Council should be the body that anybody can fall on if anyone is being maltreated,” Mr. Jinapor added.

The Governing Council of the University of Education, Winneba, has asked its Vice Chancellor and four other top officials to step aside, after it emerged that some vital documents at some offices at the centre of an ongoing investigation had been removed at night.

However a statement, which was signed by the Chairman of the Governing Council, Prof. Emmanuel N. Abakah, and copied to the acting Vice Chancellor and acting Registrar, indicated that, “whilst the above-mentioned investigations are in progress, the Council has been informed of alleged removal of vital documents from files at some offices that are at the centre of the investigations at dead night.”

The statement indicated that, the move will allow EOCO and other stakeholders conduct their investigations without compromise.

“Thus, at its meeting held on 31st October, 2017 to discuss the interim report of the fact finding committee, the Governing Council decided that to enable the Committee, EOCO and BNI to do a thorough work without being impeded, undermined, compromised and or shipwrecked, with immediate effect, you and the following officers should step aside while investigations are ongoing”

Members of the University Teachers Association of Ghana (UTAG), will today [Monday], embark on an indefinite nationwide strike to protest over a court ruling which directed the Vice Chancellor of the University of Education, Winneba (UEW), to step aside temporarily.

The strike is in solidarity with the UTAG-UEW, whose members have already laid down their tools since July 2017.

Justifying their decision, President of UTAG, Harry Agbanu, said the protest is aimed at fighting the “menace of unwanted interference in University education.”

“The court in its pronouncement asked that the man should step aside until the governing council is formed, so the governing council has the right to vary the decision of the court, and this is the case that the governing council is not doing that, and this same governing council has written to withdraw the case from the court so where do we go?”

Background

A Winneba High Court in July ordered the Vice Chancellor of UEW, Professor Mawutor Avokeh, to step aside until a case brought against him and the University’s Governing Council is determined.

The order also affected the institution’s Finance Officer.

The order was made in a case brought before the court by Supi Kofi Kwayera who insisted that the Vice Chancellor and the Finance Officer were operating under the institution’s defunct governing council.

The plaintiff held that the University’s Council’s mandate had expired in November 2013, but the Education Ministry failed to constitute a new Governing Council for the university, and rather allowed and permitted the defunct Governing Council which had no mandate whatsoever to continue the functions of a properly constituted Governing Council as if same had been properly constituted.

This, Mr. Kwayera insisted was unlawful, and hence his legal action against the University of Education, Winneba.

UTAG PRESS RELEASE ON THE UEW ISSUE

The National Executive Committee (NEC) of the University Teachers Association of Ghana (UTAG) at an emergency meeting held at University of Professional Studies, Accra (UPSA) on September 11, 2017 has asked UTAG-UEW to continue with the strike action embarked upon on July 14, 2017 following a court order instructing the substantive Vice Chancellor to step aside.

NEC further directs that UTAG members in all the other public Universities throughout the country should withdraw their teaching services beginning Monday, September 18, 2017 in solidarity with UTAG-UEW. It is our firm belief that the issue at UEW is an attack on academic freedom and, thus, affects all public Universities in Ghana. The National Executive Committee, however, appeals to all members to diligently perform all other duties placed on them by their appointments. This decision has become necessary as a result of the following:

The recently inaugurated Governing Council of University of Education, Winneba (UEW) does not seem to be interested and for that matter serious in resolving the issue. Particularly, the posturing of the Council Chairman, who has rather made matters worse by writing to the University lawyer to withdraw the whole appeal process by the University from the Appeals Court and the Stay of Execution of the injunction order issued by the High Court. This is a clear case of ill intention in pursuit of sabotaging the substantive Vice Chancellor.

The imposition of an Acting Vice Chancellor by the High Court on UEW, as against UEW’s Act and Statutes, is an act considered as an element of attack on Academic Freedom.

The lack of interest exhibited by the Ministry of Education in the matter; it may interest the Public to know that there has not been any representation from the Ministry since the court processes started although it is listed as the Second Respondent. This unconcerned posturing was further exacerbated by the decision of the Minister of State in Charge of Tertiary Education not to facilitate a meeting with some personalities in an attempt to resolve the issue amicably. This idea was initiated by UTAG and communicated to the Minister following the President’s call on UEW’s Council to resolve the UEW impasse amicably.

The resolve of UTAG to at all times protect and preserve the sanctity of Academic Freedom and the sanity of the working environment of its members on all of its constituent campuses.

NEC also gives a one-week ultimatum within which the current impasse in UEW should be resolved. Considering what happens, however, NEC will review its decision at the up-coming UTAG Congress, to be held on September 22, 2017 at the University of Cape Coast.

The Minister of State in-charge of Tertiary Education, Professor Kwesi Yankah, yesterday inaugurated the Governing Council of the University of Education, Winneba (UEW) with a charge on the members to use their vast experience to restore calm on the campuses of the university.

The council, chaired by Prof. Emmanuel Nicholas Abakah, is expected to champion, among others, the implementation of the core objectives of the university, promote income-generating activities, establish committees or boards considered necessary and assign any responsibilities that it might consider necessary.

Members of governing council

The members of the council are the Vice-Chancellor of UEW, Prof. Mawutor Avoke; Dr Efua Esaaba Agyire-Tettey, Mr John Darko and Neenyi Ghartey VII, all government nominees.

Others are Most Rev. Matthew Kwasi Gyamfi representing the Ghana Education Service (GES); the Director-General of the GES, Prof. Kwasi Opoku-Amankwa; Mr Christian Addai-Poku from the Professional Teacher Organisation, Prof. Mohammed Salifu from the National Council for Tertiary Education (NCTE), Mr Bruno Bajuaose Chirani, Dr Samuel Ofori Obuobisah Bekoe, Prof. Yaw Serekye Annor and Prof. Stephen Jobson Mitchual, all Convocations.

The rest are Ms Theresa Ackon representing the Teachers and Educational Workers Union (TEWU), Mr Emmanuel Osei Sarpong representing the alumni, Mr Stephen Osei Akyiaw representing the Graduate Students Association of Ghana (GRASAG) and Mr Patrick Agyei representing the Students’ Representative Council (SRC).

Research fund

Prof. Yankah announced that the government was committed to establishing a research fund for the sole purpose of funding relevant and sector-specific research work in institutions of higher learning.

“This is in addition to the book and research allowance,” he said, explaining that the move was part of efforts by the government to deal with the problem of funding higher education in the country.

Prof. Yankah noted that adequate funding of higher education had been one of the challenges for successive governments, especially at the graduate level.

He announced that a draft bill for the establishment of the research fund was near completion and consultations for stakeholder inputs into the bill were currently underway.

“We are hopeful that sooner than later, the fund will be established to offer an appropriate funding regime for research in our institutions of higher learning.

“We place huge emphasis on the continuous linkage of academia with industry and the world of work to ensure curriculum relevance, thereby reducing graduate unemployment,” Prof. Yankah said.

Response

Prof. Abakah expressed gratitude for the confidence reposed in them as members of the council, describing their appointment as “a call to duty”.

He pledged that the council would work hard in collaboration with all stakeholders to push the developmental agenda of the university.

Prof. Abakah acknowledged that the council was inaugurated at a time the university was in a “monumental crisis” and charged the council to immediately find ways for an amicable solution.

He immediately convened an emergency meeting scheduled for today to address the current crisis.

The University Teachers Association (UTAG) has described the court decision ordering the Vice Chancellor of the University of Education, Winneba and Finance Officer to step aside as an attack on academic freedom.

According to the Association, their members at the UEW campus who are currently on strike are being forced to work under what it described as “court imposed management.”

Speaking on Eyewitness News on Monday, President of UTAG, Dr. Harry Agbenu said they will resist such attacks.

[contextly_sidebar id=”NikqGPAE9GOOzYauYqShyRpo56YgCt09″]“The situation that we are having now is that our members in Winneba are being forced to work under a court imposed management against the rule, against the status. And for us we consider that as an attack on academic freedom.”

“So our principle is that…once academic freedom which is the prerequisite for any serious academic work in any university or anywhere in the world is under attack, we as members of UTAG have vowed to ourselves that we will resist that; even if it is the court, presidency, or anybody, whether it is political or whatever, that is not what we are thinking about,” he added.

But the lawyer for the plaintiff in the case, Alex Afenyo Markin who earlier argued that the lecturers are in contempt of the court over their strike while speaking on Eyewitness News rejected claims that the court’s decision is an attack on academic freedom.

“If UTAG is so dissatisfied, they should file an appeal. Academia holds our conscience as a society. They must not do anything that would undermine judges. They talk about freedom; they must understand that judges have freedom. UTAG is acting in bad faith. UTAG is setting a bad example for society,”  Afenyo Markin who is also the Member of Parliament for Efutu added.

This, Mr. Kwayera insisted was unlawful, and hence his legal action against the University of Education, Winneba.

However, before the substantive claims were looked into, the University, through its lawyers, applied to the court to dismiss the suit on the three counts, but the application was dismissed.

The University’s branch of the University Teachers’ Association of Ghana (UTAG) also applied to join the application but it was turned down.
