Contrary to suggestions that the Office of the Special Prosecutor may not achieve much because there’s likely to be some executive influence, President Akufo-Addo has reassured Martin Amidu, that the independence of his office will not be compromised by the executive or any other arm of government.

The President gave the assurance when he swore in Mr. Amidu today [ Friday] at the Flagstaff House, as the country’s first special prosecutor.

He said the office will be provided with the needed assistance to effectively deal with corruption and eliminate same.

“I want to assure him that not only will the Executive including the Attorney General respects scrupulously the independence of his office, but will also provide him with whatever assistance is required to enable him to discharge his high duties effectively in the interest of the Ghanaian people,” he said.

[contextly_sidebar id=”OCfYVdeR3aag5wU571bboceIiqjMCI6x”]The president reiterated that, the office of the Special Prosecutor will work line in with the citizens’ wishes to fighting corruption by discharging its duty without fear or favour.

“The establishment of this office is for a high purpose and must not under any circumstance be used as an avenue for persecution and acts of vengeance, the office will be required to do justice to all manner of persons,” he said.

He congratulated him on his appointment and wished him well for the task ahead.

“I congratulate him fully on his deserved appointment and wish him God’s guidance in the effort he will undoubtedly be making to try to instill integrity and accountability in the governance of our country,” he said.

“I have given Mr. President my word of honour that I will discharge the duties of the burdensome you have entrusted to my care with similar integrity and honour with your support. Mr. President, I want to assure you that the propaganda about witch-hunting will not daunt me from prosecuting all corruption crimes without reference to political considerations…I will treat crime as crime and nothing else,” Mr. Amidu assured after he was sworn in.

On the case at the Supreme Court challenging his eligibility for the position because of his age, the Special Prosecutor said he has not received any lawsuit to that effect, hence nothing bars him from accepting the job he described as “burdensome.”

“I wish the public to know that nobody has served me personally with any writ or statement of case or injunction challenging my nomination, approval and appointment so as to restrain me from accepting this appointment,” he added.

The setting up of the office of the Special Prosecutor was one of the key campaign promises made by President  Akufo-Addo ahead of his election victory in 2016, and it is aimed at tackling corruption effectively.

The Special Prosecutor’s office will be independent of the Executive, which observers believe will allow it to adequately deal with corruption-related issues which have plagued past governments.

The office of the Special Prosecutor has the mandate to investigate and prosecute cases of alleged corruption under the Public Procurement Act 203 Act 63 and other corruption-related offences implicating public officers, political office holders and their accomplices in the public sector.

The Prosecutor is also be mandated to trace and recover the proceeds of corruption.

The former Attorney General received unanimous approval from Parliament earlier this week, despite a pending suit at the Supreme Court over his eligibility for the position.

The Minority Leader, Haruna Iddrisu, has raised further questions with the swearing-in of the Speaker of Parliament, Professor Mike Oquaye as acting-President by calling for an amendment to the schedule of oaths for an acting President.

Mr. Iddrisu called for Oath of Allegiance to be removed from the schedule after the Speaker took the oath of office to act as President for the second time in six days.

[contextly_sidebar id=”toOvdP1F9sq1vwJaXUdRmjwnA02BEtSU”]After Prof. Oquaye’s first swearing-in last Sunday, the Majority Leader, Osei Kyei Mensah-Bonsu, made similar suggestions saying future Speakers of Parliament who may have to act as President should only need to take only the Oath of Secrecy.

Speaking on the floor of Parliament today [Saturday], Mr. Iddrisu made reference to Section 3 of the Oaths Act which is against the repetition of Oaths.

“Must the Speaker of Parliament repeat the Oath of Allegiance? My position is, Section 3 of the Oaths Act of 1972 is against the repetition of oaths. Just within the span of less than 10 days, the same Speaker of Parliament who swore an earlier Oath of Allegiance and swore one just a few days ago is being made to swear another oath of allegiance. In my view, that is legally needless and at best, unnecessary. Mr. Speaker, this Parliament must rise to the calling that under article 93 of the constitution, the power to legislate and make laws is ours and we must jealously protect and safeguard it,” the Majority Leader submitted.

Section 3 of the Oaths Act says: “No person who has duly taken the Oath of Allegiance or the Judicial Oath shall be required again to take that oath on appointment to any other office or on any other occasion…  No person shall be required to take any oath on appointment to any office unless that oath is different from or in addition to an oath duly taken by him in respect of any other appointment.”

The swearing-in is mandated by Article 60 (11) and (12) of the 1992 Constitution and has been necessitated by President Nana Akufo-Addo’s trip to Addis Ababa for the AU Summit.

The Vice President, Dr. Bawumia, is also currently in the United Kingdom on medical leave after being taken ill last week.

The Speaker will be clothed with Presidential powers until Wednesday, 31st January.

Upset MPs

Member of Parliament for Builsa South, Dr. Clement Apaak, expressed his displeasure with the summoning of MPs for the second swearing-in of the Speaker of Parliament in less than a week to Citi News.

According to Dr. Apaak said the processes prescribed by law were inconveniencing several MPs who had made other plans.

He said bluntly this current arrangement was unsustainable.

“As I speak to you, myself and many of my colleagues have engagements and activities in our constituencies and we are to leave, and yet we are expected to come back to the House at 8:30 am to swear in the Speaker as President. I don’t think it is sustainable.”

Controversy over swearing-in

The law concerning the swearing-in was breached by a former Speaker of Parliament, Doe Adjaho in 2014, when he refused to take the oath of office as acting President at a point.

Both President Mahama and his Vice Kwesi Amissah-Arthur had traveled outside the country at the time.

This compelled the Managing Director of Citi FM, Samuel Atta-Mensah, and a United States-based Ghanaian lawyer, Prof. Kwaku Asare, to file a suit at the Supreme Court, to among other things, seek an interpretation of Article 60 (12) of the 1992 Constitution, which requires that the Speaker takes the oath of office each time he is to act as President.

Supreme Court

The Supreme Court, in a unanimous decision, declared that the Speaker of Parliament, Edward Doe Adjaho, violated Article 60 (11)-(12) of the 1992 Constitution when he declined to be sworn in to act as President.

The apex court Speaker of Parliament shall always, before assuming the functions of the Office of President when the President and the Vice-President are unable to perform their functions, take and subscribe to the oath set out in relation to the Office of President”.

Uhuru Kenyatta has vowed to overcome Kenya’s divisions after being sworn in for a second term as president, at a ceremony boycotted by the opposition.

Speaking after his inauguration in the capital Nairobi, he said he would try to incorporate some of the opposition’s ideas “in the spirit of inclusivity”.

But elsewhere in the city, police clashed with opposition supporters.

Opposition leader Raila Odinga, who boycotted an election re-run last month, mocked Tuesday’s “coronation”.

Mr Kenyatta was officially re-elected with 98% of the vote on 26 October but just under 39% of voters turned out.

The original election on 8 August was held again after being annulled by the Supreme Court on grounds of irregularities

What did Kenyatta say exactly?

Embarking on his second and last term in office, he promised to act as “the custodian of the dreams of all” Kenyans.

Without specifying whether he would reach out to Mr Odinga, he said: “We may have chosen different candidates and different visions, but each one of us voted for a better life.

“To my competitors, and in the spirit of inclusivity, I will endeavour to incorporate some of their ideas. The election was not a contest between a good dream and a bad dream. It was a contest between two competing visions.

“I will devote my time and energy to build bridges, to unite and bring prosperity to all Kenyans.”

How did the inauguration unfold?

Spectators inside Nairobi’s Kasarani sports stadium were entertained by music and dance performances, while the military paraded.

However, there were scenes of chaos outside when people without seats tried to rush in and were driven back by police with tear gas and batons, with some officers on horseback.

Big screens had been promised so that tens of thousands of people could watch the ceremony from outside the stadium but no screens were provided, AFP news agency reports.

Which foreign leaders attended?

Ethiopian Prime Minister Hailemariam Desalegn and Rwandan President Paul Kagame were among a number of African leaders at the inauguration.

Israeli Prime Minister Benjamin Netanyahu was also expected in Nairobi but for a later event in the presidential palace, the Jerusalem Post reports.

Why was the election re-run?

Chief Justice David Maraga said the August election had not been “conducted in accordance with the constitution” and declared it “invalid, null and void”.

The Supreme Court ruled that the result had been “neither transparent nor verifiable”.

But Mr Odinga urged his supporters to boycott the second vote because he said no reforms had been made to the electoral commission since the original poll.

Correspondents say the election dispute has left Kenya deeply divided.

About 50 people are reported to have been killed in violence since the August ballot.

Burning tyres

There were confrontations between police and opposition supporters in the suburb of Doonholm.

Angry protesters lit tyres, barricaded roads and threw stones at the police and some ruling party supporters. “No Raila, no peace,” they shouted as police lobbed tear gas canisters to disperse them.

“We do not recognise Uhuru Kenyatta,” one protester holding a sling loaded with a stone told me. Another protester said he was angry that the police had blocked access to the venue where the opposition had planned to hold a rally.

Mr Odinga told the BBC that they wanted to mourn the death of their supporters who were allegedly killed by police over the past week-and-a-half. The police have denied shooting and killing any opposition supporters.

According to Mr Odinga, Mr Kenyatta was elected by “just a small section of the country”.

In the opposition stronghold of Kisumu, in the west of the country, local people told BBC News they were not happy with the inauguration.

“I am going to peacefully accept and move on but I won’t recognise this presidency,” said one man.

A woman said Mr Kenyatta had not won fairly. “So we feel that it’s not time to move on,” she said. “It will not be an easy thing to do.”

Foreign Secretary Boris Johnson, who is in The Gambia, has said he is “very pleased” the West African state intends to rejoin the Commonwealth.

His visit, the first to The Gambia by a British foreign secretary, comes weeks after long-time ruler Yahya Jammeh went into exile after losing elections.

Mr Jammeh took The Gambia out of the Commonwealth in 2013, calling it a neo-colonial institution.

New President Adama Barrow had promised a return to the 52-nation grouping.

Before leaving for Banjul, Mr Johnson said: “We will ensure this happens in the coming months.

“The strength of our partnerships show that Global Britain is growing in influence and activity around the world.”

The Commonwealth secretariat said it welcomed the news, saying the formal process of rejoining would have to be agreed by the 52 heads of government.

“When The Gambia left the Commonwealth in 2013, the heads of government… noted its decision with regret. We looked forward to the country’s eventual return because it was part of our very close knit family and our doors have always remained open,” a spokesman said.

Last week, the European Union promised The Gambia an aid package of nearly £65m ($81m) – almost three years after freezing its assistance to the West African nation.

Mr Barrow, who was sworn in last month, has also said The Gambia will reverse its move to withdraw from the International Criminal Court (ICC).

In a statement on Monday, the government said it had written to UN chief Antonio Guterres to inform him of its decision “to discontinue the withdrawal notice”.

A former Gambian information minister had referred to the court last year as “an International Caucasian Court for the persecution and humiliation of people of colour, especially Africans”.

The move is a blow to Africa’s anti-ICC lobby – which includes South Africa, Namibia and Burundi.

At the annual African Union summit held this month, leaders called for a mass walk-out from the ICC, but faced opposition from other countries, including Nigeria, Senegal and The Gambia.

‘Return from 22 years in exile’

The Foreign Office said as well as holding talks with Mr Barrow, Mr Johnson would visit the UK-funded Medical Research Council and speak to Chevening scholars and workers and employers in the tourism industry.

The West African state is a popular holiday destination for Britons. Thousands had to be evacuated last month because of security concerns when Mr Jammeh was refusing to hand over power after losing December’s elections.

Mr Barrow, whose swearing-in was held in neighbouring Senegal, is to be inaugurated as president in a ceremony at the national stadium on Saturday.

Several heads of state are expected to attend. Local dignitaries may include former Vice-President Alhagie Saihou Sabally, who local media said had returned to the country on Monday after 22 years in exile.

Mr Jammeh, who took power in coup in 1994, is now in exile in Equatorial Guinea after West African leaders deployed troops to The Gambia to ensure he left power.

Mr Johnson will go on to Ghana for talks with President Nana Akufo-Addo on Wednesday.

Referring to him and Mr Barrow, Mr Johnson said: “Their elections highlight the continuing strengthening of democracy in West Africa.”

The newly appointed Ministers will ensure that the New Patriotic Party (NPP) government led by President Nana Akufo Addo succeeds, Senior Minister, Osafo-Maafo has said.

He made the comment on behalf of his colleagues at their swearing in ceremony  at the Flagstaff House on Friday, January 27, 2017.

“On behalf of the freshest Ministers, I want to say a very big thank you to his excellency for giving us an opportunity to serve. We know his vision, we know his excellency wants to make a difference and on behalf of my colleagues I want to assure him that we will give him the support to make him excellent.We shall support you and make sure Akufo-Addo’s government succeeds and succeeds very well,” Osafo Maafo said.

President Nana Addo swore in 12 of the 13 nominees who have been vetted and approved by Parliament. The only nominee who could not be sworn-in, is the Minister-designate for Foreign Affairs, Shirley Ayorkor Botchwey, who is currently in Addis Ababa, Ethiopia, and will be sworn it at the Ghanaian Embassy in the Ethiopian capital on Saturday, according to President Akufo-Addo, as he visits that country.

The 13 approved nominees, are part of the first batch of 36 nominees tot be approved, alongside ten other regional minister-nominees also expected to be vetted.

The swearing-in ceremony took place at the Presidency on Friday evening, where President Akufo-Addo charged the new ministers to deliver on the commitments the New Patriotic Party made on the campaign trail. He impressed on the new ministers not to fail Ghanaians who he said expects the government to protect the public purse and ensure value for money.

President Nana Akufo-Addo has sworn in 12 of the 36 persons he named as ministers for various portfolios after their approval by Parliament’s Appointments Committee.

The swearing-in ceremony took place at the Flagstaff House today [Friday] evening, where President Akufo-Addo charged the new ministers to deliver on the commitments the New Patriotic Party made on the campaign trail ahead of its election victory.

He also impressed on the new ministers not to fail Ghanaians who, he said, expected the government to protect the public purse and ensure value for money.

The 12 ministers sworn in were among the first batch of 13 out of 36 nominees, who appeared before Parliament’s Appointments Committee between January 20 and January 24 to be vetted.

The Minister-designate for Foreign Affairs, Shirley Ayorkor Botchway, is part of the 13 approved by Parliament but is currently in Addis Ababa, Ethiopia, and will be sworn in at the Ghana embassy in the Ethiopian capital tomorrow [Saturday], according to President Akufo-Addo, as he visits that country.

Late approval of nominees

Parliament’s approval of five of the Ministerial nominees was delayed because of concerns raised y the Minority in Parliament.

The latest to be approved were Senior Minister Nominee; Osafo Maafo; Energy Minister Nominee, Boakye Agyarko, Education Minister Nominee, Matthew Opoku Prempeh; Minister Nominee for Health, Kwaku Agyeman-Manu and Owusu Afriyie Akoto, Minister Nominee for Agriculture.

The Minority Leader, Haruna Iddrisu, had explained that, his side needed some “additional information” on statements Osafo Maafo and Boakye Agyarko both made before the Committee during the vetting.

He said Mr. Agyarko provided some “inaccurate” information relating to the “debt associated with the Electricity Company of Ghana (ECG) and the Volta River Authority (VRA).”

But Citi News’ Duke Mensah Opoku reported that Mr. Agyarko subsequently withdrew some of his comments, prompting the committee to approve him by consensus.

He added that Mr. Osafo-Maafo, however, stood by his comments but provided additional information to support his claim and was therefore recommended for approval by consensus.

They were eventually approved around 7: 30 pm on Friday evening.

Mr. Barrow was sworn in today [Thursday], at The Gambia’s Embassy in Senegal Dakar, where he took the oath of office.

The ceremony was administered by Sheriff Tambadou, president of the Gambian Bar Association.

Mr. Barrow commended the ECOWAS, AU and other international bodies for their support in protecting the will of the Gambian people.

Mr. Barrow in his inaugural speech also instructed the heads of the military in The Gambia to recognise him as the new President, or risk being considered as renegades.

“My right as the winner to be sworn in and assume the office President is constitutionally guaranteed and irreversible. I hereby make a special appeal to ECOWAS, AU and the UN, particularly the Security Council to support the government and the people of The Gambia in enforcing their will and restore their sovereignty and constitutional legitimacy.”

He also called on Yahaya Jammeh to remain loyal to the constitution of The Gambia, and promised to be a President for all Gambians.

“This is a victory for the Gambian nation. Power belongs to the people in The Gambia. This is a day no Gambian will ever forget; first time since The Gambia became independent that it’s changed a government through the ballot box,” Barrow said.

“The capacity to effect change through the ballot box has proven power belongs to the people in The Gambia. Violent change is banished forever from the political life of this country. All Gambians are therefore winners. There is no loser in this election.”

The small West African state now has two men claiming to be president.

Its parliament voted earlier this week to extend Yahya Jammeh’s rule by 90 days, while he challenges his election defeat at the hands of Mr Barrow, a former estate agent, in the courts.

Regional forces, led by Senegal, have threatened to enter the country to oust Mr Jammeh.

The Gambia, popular with European tourists because of its beaches, has never had a smooth transfer of power since independence from Britain in 1965.

Whiles the swearing-in was taking place, the AFP News Agency reported that, Nigeria’s air force was flying over The Gambia, as regional troops prepare to force Yahya Jammeh to quit after his December election defeat.

The National Organizer of the opposition National Democratic Congress (NDC), Kofi Adams has revealed that attacks by members of the New Patriotic Party on loyalists of his party and state institutions have worsened after President Nana Addo Dankwa Akufo-Addo was sworn into office.

This he said was because Akufo-Addo who is also the leader of the NPP failed to condemn the attacks and call the people perpetrating such act to order.

Some youth believed to be sympathizers of the NPP have recently been on rampage; taking over some state properties and institutions including the Ghana Ports and Habours Authority, the Ashaiman assembly and tollbooths.

Two NDC loyalist died after election

According to Kofi Adams, two of NDC loyalists have lost their lives through such attacks.

He said, “we [NDC] have buried two people as a result of post-election violence in Sefwi Wiawso and Dunkwa. They were NDC people who were attacked NPP members after the elections.”

The NDC Organiser further expressed disappointment at the acting National Chairman of the NPP, Freddy Blay for justifying the attacks.

Kofi Adams said the NPP’s security group, known as the Invisible Forces beat up a police officer on duty at the Flagstaff House.

“You have these people move not just to toll booths and other places but even to the flagstaff house, beat up uniformed persons and tear up their clothes and then claim they [Invisible forces] are in charge.” “I heard their acting National Chairman saying people are clearing goods without paying duty and so they have to go and protect those things. I am not aware of Customs officer who is not working to make the Invisible forces go and protect the place,” Kofi Adams said.

Dr. Mahamudu Bawumia, was on Saturday, January 7, sworn into office as Vice President of the Republic of Ghana.

He becomes the 6th Ghanaian to occupy the high office since Ghana begun democratic governance in 1992, and he will serve alongside the newly sworn-in President, Nana Addo Dankwa Akufo-Addo.

Clothed in an all-white overall apparel, popularly known as “Agbada”, he took the oath of allegiance and oath of office administered by the Chief Justice, Justice Georgina Theodora Wood.

He subsequently signed the oath book to confirm his dedication to the service of the country for the next four years.

Dr. Bawumia, a banker, economist and a former Deputy Governor of the Bank of Ghana, joined mainstream politics in 20o8 as the running mate to the New Patriotic Party flagbearer, Nana Akufo-Addo.

In spite of their loss to the National Democratic Congress (NDC) candidate, John Mahama that year, the two again contested in the 2016 Presidential elections, where they won convincingly against the incumbent NDC candidate.

They polled 53.85.% of the total valid votes cast, against the NDC’s 44.4%.

THE OATH OF ALLEGIANCE

I, Mahamudu Bawumia, do (in the name of the Almighty God swear) (solemnly affirm) that I will bear true faith and allegiance to the Republic of Ghana as by law established; that I will uphold the sovereignty and integrity of Ghana; and that I will preserve, protect and defend the Constitution of the Republic of Ghana. (So help me God).

THE OATH OF THE VICE-PRESIDENT

“I, Mahamudu Bawumia, having been elected to the office of Vice-President of the Republic of Ghana, do (in the name of the Almighty God swear) (solemnly affirm) that I will be faithful and true to the Republic of Ghana; that I will at all times preserve, protect and defend the Constitution of the Republic of Ghana; and I dedicate myself to the service and well-being of the people of the Republic of Ghana and to do right to all manner of persons.”

“I further (solemnly swear) (solemnly affirm) that should I at any time break this oath of office, I shall submit myself to the laws of the Republic of Ghana and suffer the penalty for it. (So help me God).”

 

‘About the New Vice President’

53-year-old Bawumiah is the son of Alhaji Mumuni Bawumia, lawyer and politician, a Mamprugu Royal and Paramount Chief of the Kperiga Traditional Area who served as Chairman of the Council of State from 1992 to 2000.

Twelfth of his father’s 18 children, Bawumia attended the Sakasaka Primary school in Tamale, and gained admission to Tamale Secondary School in 1975.

After graduating from Tamale Secondary School, he went to the United Kingdom where he studied banking and obtained the Chartered Institute of Bankers Diploma (ACIB). He also obtained a First Class Honours Degree in Economics at Buckingham University in 1987 and subsequently obtained a master’s degree in Economics at Lincoln College, Oxford, and then a Ph.D. in Economics at the Simon Fraser University, Canada in 1995.

From 1988 to 1990, Bawumia worked as a lecturer in Monetary Economics, and International Finance at the Emile Woolf College of Accountancy in England. He also served as an economist at the Research Department of the International Monetary Fund in Washington, DC, USA.

Between 1996 and 2000, Bawumia served as an Assistant Professor of Economics at Hankamer School of Business, Baylor University, Texas, USA.

Bawumia returned to Ghana in 2000 to work as an economist at the Bank of Ghana. He rose from Senior Economist to Head of Department, and subsequently as Special Assistant to the Deputy Governor of the Bank in June 2006.

Former Vice President, Kwesi Amissah-Arthur, says he is grateful to former President John Mahama for the opportunity to serve in government.

Mr. Amissah Arthur, who served with John Mahama from 2012 when the latter had to take up the Presidency post following the demise of President Evans Atta-Mills, euologized Mahama for his commitment to the transformation of Ghana.

In a Facebook post on Saturday, January 7, ahead of the swearing in of President-elect Nana Akufo-Addo, Mr. Amissah-Arthur  said, “it was brilliant working with him [Mahama].

Amissah-Arthur was until his service as Vice President, the Governor of the Bank of Ghana.

John Mahama and Kwesi Amissah Arthur were unanimously declared as the National Democratic Congress’ duo to contest for the December 2016 presidential elections.

They lost the elections to 3-time contestant and flagbearer of the New Patriotic Party, Nana Akufo-Addo and his running mate, Dr Mahamudu Bawumiah.

Mahama polled 44.4% of the valid votes cast, while Akufo-Addo polled 53.8% votes, representing a resounding victory for the NPP candidate, who set the record of being the first to unseat an incumbent President in a democratic election in Ghana’s history.
