Lawyer for Exton Cubic Limited, Reindorf Twumasi Ankrah has served notice of a suit against the state over what he describes as the unlawful seizure of Ibrahim Mahama’s Engineers and Planners (E&P) vehicles and mining equipment.

Vehicles and equipment belonging to Exton Cubic’s sub-contractor, Ibrahim Mahama’s Engineers and Planners (E&P), were impounded in the Nyinahin township on orders from the Ashanti Regional Minister, Simon Osei Mensah, following suspicions the mining company was operating illegally.

[contextly_sidebar id=”6d1Hw7e9L2ZB26ZaOp7zNWgmHThrJUkL”]Mr. Ankrah believes the state wrongfully interfered with their client’s right to prospect on the Nyinahin Bauxite Concession of Tano Offin forest reserve when their vehicles and equipment were seized.

He argued in a statement that the recent frustrations to halt its exploration of the concession which resulted in the seizure of trucks have caused their client “financial loss.”

“ We have been instructed by our client that the seizure and detention of the said trucks has not only adversely affected our client’s business operations but has occasioned and continues to cause our client, financial loss.”

“In the light of the foregoing, our client has instructed us to serve you notice of its intention to institute legal proceedings against the State as a result of the wrongful interference by state officials with our client’s right to prospect on its concession and also a breach of its right to administrative justice,” the statement said.

The mining company had earlier served notice of suing the police and some authorities in the Ashanti Region over the seizure.

Equipment seizure costing us $40,000 daily – Exton Cubic

A few days ago, the company had revealed that the seizure of their vehicles and mining equipment costing the company over $40,000 daily.

According to Exton Cubic, the losses started on August 20, when the vehicles were impounded in the Nyinahin township.

At a press conference on Thursday, the company’s Public Relations Officer, Samuel Gyamfi, reiterated the company’s assertion that the impounding and detaining of its officers was unlawful.

“The company is losing over $40,000 a day due to this unlawful act and as we have told you, we are going through the legal process with our lawyers and very soon, the authorities concerned will be written to and we will make our position clear to them.”

Mr. Gyamfi maintained that “… what they have done to us is not fair. What they have done to us is not allowed or permitted by law and expect that the right things will be done.”

The National Organizer of the National Democratic Congress (NDC), Kofi Adams, has clarified that he worked to acquire the five vehicles that were seized, and later released by the Criminal Investigations Department (CID).

Speaking on the Point Blank segment of Eyewitness News, Mr. Adams said : “I worked for the vehicles. I worked and acquired them. If anybody wants to check they can check further.”

[contextly_sidebar id=”mIn59bi0lhApgdnovTNHE108EbkeWULH”]The vehicles; two land cruisers and three pick-ups, were seized following allegations that some officials of the previous government had misappropriated some state assets including vehicles.

But they were later released after the CID established that the vehicles did not belong to the state.

Two others to be sued for defamation

Kofi Adams, who sued a Deputy General Secretary of he NPP, Nana Obiri Boahen for alleging that he stole the five vehicles from the state, said two others will also be dragged to court for defamation.

“I know Lawyer Obiri Boahen has been served and I am told he has entered appearance. We are looking for the other two persons to serve, but we are not getting them. I am sure tomorrow my lawyers will file for substituted service. They are David Asante and Abronye DC,” said Kofi Adams.

How the seizure occurred

Mr. Adams, who earlier narrated how the seizure occurred, explained that before he traveled to the UAE in January, some six officials claiming to be National Security personnel visited his House in an attempt to seize the cars in his absence.

Kofi Adams said he managed to stop them when he was called at a funeral grounds, and later confirmed that the men were not ordered to carry out the act by the National Security Minister.

He said he found it strange to receive a call whiles outside the country later, that the same six men with others, had returned to seize his five vehicles.

Mr. Adams  at the time, could not state emphatically if he personally purchased the five cars alleged to have been seized from his home by national security operatives.

When the Host of Citi Eyewitness News, Richard Sky, asked whether he owned all the vehicles, Mr. Adams said “I am the owner of the two land cruisers and a pick-up. They are registered in my name. If something is registered in your name don’t you own it?” he asked.

The National Organiser of the opposition National Democratic Congress (NDC), Kofi Adams, has alleged that about sixteen men believed to be military personnel, and others from the National Security, have seized five vehicles from his home.

Although details of why the incident happened are sketchy, Mr. Adams, who was also the 2016 National Campaign Coordinator for the NDC, confirmed this on Citi Eyewitness News today, [Wednesday].

According to him, he was informed about the incident by an occupant of the house because he is attending a function in the United Arab Emirates (UAE).

He explained that, before he traveled to the UAE on Sunday, some six officials claiming to be National Security personnel visited the House on Saturday in an attempt to seize the cars in his absence.

He said he managed  to stop them when he was called at a funeral grounds, but managed to confirm that the men were not ordered to carry out the act by the National Security Minister.

He said he found it strange to receive a call whiles outside the country today [Wednesday], that the same six men with others, had returned to seize his five vehicles.

“I had to travel to Dubai for the function, so I left Ghana on Sunday, only to receive a call that sixteen military persons and some police officers together with four of the six who came the last time and a DVLA officer with a machine, came to the house, got into the yard, and insisted on getting the vehicles out. The DVLA official had a system that could check the genuineness of the registration when you enter the number of the vehicle; he did so according to the Youngman who was at home then, and everything clearly indicated that these were vehicles that had been properly registered and did not even belong to the state.”

“So the advice was that they needed to go back, but it looks as if the taste for seizing vehicles was so high, so they insisted the Youngman must bring the keys for them to do a test on a particular one. He told them he won’t do that; but one of them used the rear side of his AK-47 to hit him, and so he was frightened. Once he was walking into the room to pick the keys, they followed him forcefully, and whether he was picking the keys, they picked the other keys and tried each car to find out which one fitted and drove everything away.”

Mr. Adams could however not confirm whether he personally purchased the cars by himself, except to say that he owns them since they are registered in his name.

There are unconfirmed reports that some of the previous government’s officials, may have misappropriated some state assets. Meanwhile authorities at the Ministry of Defence have denied sanctioning any soldier to carry out such an assignment.
