A Native American tribe is suing Amazon and Microsoft for infringing data-processing patents it is holding.

The patents were assigned to the Saint Regis Mohawk Tribe by technology company SRC Labs, and it will receive a share of any award.

Tribal sovereignty means that the patents cannot be reviewed by the Patent Trial and Appeal Board.

A similar deal has drawn criticism from US lawmakers, who claim it is a loophole to avoid patent scrutiny.

Democratic US senator Claire McCaskill drafted a bill this month, in response to another attempt to transfer patents to the same tribe.

In that case, it was pharmaceutical giant Allergan, and a patent for dry-eye medication.

Ms McCaskill said at the time. “Congress never imagined tribes would allow themselves to be used by pharmaceutical companies to avoid challenges to patents, and this bill will shut the practice down before others follow suit.”

The tribe issued a statement questioning why the legislation targeted Native American tribes but not other sovereign governments or state universities.

John Tothill, a partner at law firm Dehns, said the US appeal board was frequently used to revoke patents.

“Microsoft or Amazon could pre-empt this action by applying to have the patents revoked,” he said.

“It is a way of playing the system, if you like, and trying to block potential litigation.

“I am assuming that passing the patents on like this stops that because the US federal government does not have rights over the sovereignty of Native Americans.”

Neither Amazon nor Microsoft have responded to requests for comment.

The acting Executive Secretary of the Lands Commission, Dr Wilfred K. Anim-Odame, has made a plea to government to allow it retain part of its internally-generated funds (IGF).

The commission, he says, has inadequate funds to discharge its mandate of land administration and, therefore, requires the intervention of the government.

Dr Anim-Odame made the appeal when the Parliamentary Select Committee on Lands and Natural Resources paid a working visit to the commission on July 15, 2014.

He said land service delivery was very expensive and the continuous reliance on annual budgetary support alone was inadequate to achieve an effective and efficient land administration.

He therefore urged the committee to lobby Parliament to allow the Lands Commission to retain 40 per cent of its IGF and in addition keep six per cent of non-tax revenue generated from the Stamp Duty Act.

Plans of the Commission

Dr Anim-Odame also stated that the lands commission had developed a blueprint on the re-engineering of business processes and taken steps to establish the necessary structures that would offer the public an opportunity to access the services of the commission through a one-stop-shop.

He said it had become very necessary after the merger to collapse the individual divisional operational procedures into a singular workflow for land service delivery within the Lands Commission.

“In doing so, we seek to significantly reduce the turnaround time for land title registration and other land services as well as reduce the cost of land service delivery,” he said.

“At the one-stop-shop, Ghanaians will submit their land and other related documents for processing, plan preparation, Stamp Duty and registration and receive final services from the same office without hopping from one office to another,’ he added.

Mr Anim-Odame also added that the commission was working hard to improve its corporate image and management was fully committed to a strategy that would give it a new identity.

The Select Committee

The Chairman of the Parliamentary Select Committee, Mr Amadu Seidu, stated that the committee had already taken the request to Parliament.

He said the committee was now waiting for the new Lands and Natural Resources Minister to assume office before deciding on the way forward with him.

He also assured the Lands Commission that the committee was committed to fighting for the retention of part of its IGF.

“Even if you don’t get the 40 per cent you are asking for, we will make sure you get something reasonable,” he said.

Staff of the Korle Bu Teaching Hospital have petitioned President John Mahama over alleged misuse of funds by the board and management of the hospital.

The senior staff of the hospital are, among other things, accusing the board and management of the hospital of spending more than GhȻ1million on luxury vehicles.

The staff claim although the Acting Chief Executive of the hospital, Albert Okpoti Botwe, already has a vehicle for his official use, the board has given the green light for him to buy the latest Audi A6 car for his personal use.

The petition further said Mr Botwe allegedly ordered nine brand new cars all totaling more than GhȻ1million.

Payment for the vehicles, according to the petition to the President, were made from the hospital’s internally generated funds which are meant for the purchase of items that go into direct patient care.

President of the Senior Staff Association of the Korle Bu Teaching Hospital, Charles Ofei-Palm, said such misuse of funds has led to poor infrastructural developments at the hospital leading to some incidents of avoidable deaths.

He cited for instance a sickle cell patient who died painfully two months ago because the hospital did not have common tools like needles to treat his condition.

He said there was also shortage of non-drug consumables.

Some staff in operating theaters are compelled to buy their own surgical gown caps in order to conduct surgical operation, the petition sent the President said.

The petition also questions the Acting Chief Executive’s interest in allowing a GhȻ10,000 monthly salary to a board member (Godwin Ahianyo) even after the Health Minister, Hanny Sherry Ayittey, directed that the payments be stopped.

The Korle Bu staff are therefore demanding a dissolution of the board, the return of the Audi A6 to the dealers and a forensic audit into the use of funds by the Acting CEO, Rev. Albert Okpoti Botwe.

Meanwhile the Acting Chief Executive of Korle Bu, Albert Okpoti Botwe has denied the allegations of the workers.

He said  the board would be organising a press conference Wednesday afternoon to explain the issues.
