Ghana is to pay tech giant, Google, an amount of $400,000 every year for embedding the company’s online map into the country’s newly designed National Digital Property Addressing System, Ghana Post GPS.

This was revealed by the Managing Director of Ghana Post, James Kwofie on Friday, at a press conference organized by the Ministry of Communications following criticisms of the digital address system.

Mr. Kwofie made the revelation when he was giving the breakdown of the amount spent on the system which was earlier announced to be $2.5 million.

The Google license fee at the moment is $400,000 per year – that is the enterprise package,” he added.

GHc3.5 million blown on publicity

He added that, an amount of GHc3.5 million was also spent on publicizing the system.

“Publicity like I said, is GHc3.5 million, and there are very expensive firewalls, we can’t say how many, but that also cost a lot of money,” he added

Background

President Akufo-Addo about two weeks ago launched the National Digital Property Addressing System, also known as the Ghana Post GPS in Accra, aimed at providing an effective means of addressing every location and place in the country, using an information technology application.

The app, which government said cost the country $2.5 million has been criticized by some experts in the technology space as well as some civil society organizations.

For instance, president of policy think tank, IMANI Ghana, Franklin Cudjoe, described the system as amateurish and not new.

He also questioned the security implications of the data received by the system.

“I’ve read quite a number of reviews by industry watchers, and some of the comments they’ve made are not necessarily helpful – to think that you could input just any data and generate an address in itself sounds amateurish. There are basic web portals where you input any kind of data it could reject it, especially when you are filling forms. And to hear that obviously, that it is something with this app is quite troubling,” Franklin Cudjoe added.

No data breach

But speaking at the press conference, Nana Osei Afrifa, Chief Executive Officer for Vokakom, the company that designed the app, assured that the data accepted by the system is safe.

He added that, ample measures have also been put in place to forestall any data breach.

The Member of Parliament for the Ningo-Prampram Constituency, has welcomed a decision by the National Communications Authority (NCA), to slash by 50 percent fines it imposed on some radio stations cited for non-renewal of their licenses.

He described the new move by the NCA as “refreshing.”

The National Democratic Congress (NDC) legislator had earlier accused the NCA of contravening certain constitutional provisions with the sanctions imposed on 131 radio stations.

The NCA in September sanctioned 131 stations for several infractions, and at the time gave 34 radio stations the option to pay or be taken off air; a decision which was criticized by groups, particularly the NDC minority in Parliament.

Whiles the first 30-day ultimatum given to the stations has elapsed, and some stations have been taken off-air, the NCA in what appears to be an act of leniency, has lessened the fines and also relaxed other penalties.

The stations have now been given additional 30 days to pay up or risk being shutdown after the 50% slash.

This was after the Minister of Communications, Ursula Owusu-Ekuful, defended the sanctions, following her appearance in Parliament, where Sam George had vehemently objected her views.

Sam George in a statement said the review of the fines is a good step aimed at protecting free speech.

“It is refreshing to read the release from the Ministry of Communications on the fines by the NCA. I must commend the Ministry for its initial actions aimed at mitigating the enormity of the sanctions. They are the first good steps aimed at protecting free speech,” he said.

It is refreshing to read the release from the Ministry of Communications on the fines by the NCA. I must commend the Ministry for its initial actions aimed at mitigating the enormity of the sanctions. They are the first good steps aimed at protecting free speech.

However, I still believe that as the Ministry’s statement suggests, there is room for more dialogue and negotiations. One key issue would be the apparent retrospective nature of the fines. It is important as a cardinal rule of natural justice that penalties are not applied retrospectively. I believe that with the good faith shown by the Ministry, this issue too would be resolved amicably during discussions with the Ministry.

Let us continue to build a conducive environment for Ghanaian businesses to thrive even as the businesses respect their obligations to the State. It is my hope that the affected radio stations would take advantage of the current dispensation to engage the Ministry further to settle whatever outstanding issues may exist.

In an act of leniency, the Ministry of Communications and the National Communications Authority (NCA), have slashed the fines for the sanctioned commercial FM Broadcasting stations by 50 percent.

The stations have thus been given additional 30 days to pay the slashed fines.

They have 30 days from 20th October, 2017, to pay the 50% reduced penalties or have their authorizations revoked,” a statement from the NCA said.

“It is the expectation of the Ministry and the Authority that all defaulting FM stations will take advantage of this opportunity and ensure compliance within the shortest possible time,” the NCA added.

For the 34 sanctioned stations that had their licenses revoked because their authorizations had expired, they have been given 10 days to petition the Minister of Communications, Ursula Owusu-Ekuful

“The stations in this category have the option to petition the Honourable Minister for Communications for a review of the revocation of their Authorisation within 10 days from Friday, 20th October 2017. After receipt of their petitions, they will be reviewed on a case by case basis, following which the Minister will determine the applicable sanctions.”

The Minister of Communication, has already revealed that the NCA has received a number of petitions from both commercial and community radio stations over the sanctions.

But according to her, the fact that the NCA has received the petitions does not mean the affected stations would be reinstated, but their request would be reviewed on case by case basis.

Another category of stations, the Community and Institutional FM Broadcasting Stations, have had the pecuniary penalties which were imposed on them waived.

“In addition to this, these stations are to regularise their operations; pay their outstanding indebtedness (Annual Regulatory and Spectrum fees) and submit renewal applications and all outstanding documentation as applicable within thirty (30) days from the date of this release, Friday, 20th October, 2017. Failure to do so will result in the revocation of their authorisations,” the statement added.

Break down of 97 fined stations

According to the NCA, eleven (11) radio stations have been requested to pay application fees for renewal of Authorisation, and also pay a fine in accordance with the NCA’s gazetted Schedule of Penalties for failure to apply 3 months before the expiry of Authorization within 30 days.

Two (2) radio stations have been asked to submit renewal application within 30 days.

Sixteen (16) radio stations have been asked to submit renewal application, pay application fees, and pay a fine in accordance with the Authority’s gazetted Schedule of Penalties within 30 days.

Twenty‐four (24) radio stations have been asked to submit omitted documents and pay a fine in accordance with the Authority’s gazetted Schedule of Penalties within 30 days.

Fifteen (15) radio stations will have their Authorisation processed after payment of fines in accordance with the Authority’s gazetted Schedule of Penalties.

One (1) radio station has been asked to settle its outstanding indebtedness before renewal of Authorization is considered.

Twenty (20) radio stations have been asked to settle their Provisional Authorization (renewal) fees which have been invalidated due to non‐payment within sixty days – to pay interest on due amount.

Eight (8) radio stations have been asked to pay a fine in accordance with the NCA’s gazette Schedule of Penalties before the authority conducts inspection as requested by the stations.

Land acquisition leading to prolonged litigation is a major challenge faced by developers and institutions in the country. There have been instances where one piece of land has been sold to several people.

Surprisingly, all most of the people manage to produce documentation to prove ownership. Some people sometimes employ land guards to protect the said piece of land.

Some people have lost their lives through land disputes. Others have also sustained various degrees of injury due to same.

Some very important national projects have faced challenges because of land disputes.

Another legal battle over Achimota School land is looming as the authorities of the school head to the High Court to battle a family laying claims to portions of the land.

The school authorities insist that the Nii Ako Nortei Family, which is claiming 172.68 acres of the school land, have no title to the land and hence could not lay claims to the territory which is part of the school land acquired by the colonial government on December 16, 1921.

“The land does not belong to them. They have no right to claim that if the land was not being used for the purpose for which it was acquired, it should be returned to them.”

“This is no different from the way people are grabbing government properties and land,” a not-too-happy Headmistress of the School, Ms Beatrice Adom, told the Daily Graphic.

The Achimota school has, therefore, filed an ex-parte motion ostensibly to freeze a High Court judgement that gave the 172.68 acres to the Nii Ako Nortei Family. In a related development, the court has served notice on all the litigants to appear before it on June 9, 2014 when it will hear the matter brought before it.

The Achimota School has reportedly been under siege from the activities of land developers, some of whom have allegedly encroached on huge tracts of land belonging to the school. The situation, the headmistress said, was affecting teaching and learning in the school.

A visit to the school showed numerous residential facilities springing up. For instance, the school farms have been taken over by people the school authorities describe as encroachers.

History

The Achimota School land was acquired in 1921 and according to a document that purportedly sealed the deal, the owners were paid 4,000 Pounds.

The document, dated June 29, 1922, reads, “We the undersigned claimants for the compensation under the Public Lands Ordinance in respect of the above mentioned land hereby agree to accept the sum of four thousand pounds in full satisfaction of all claims which we now have or may hereafter have against the Government of the said Colony for aforesaid.”

The document was signed by representatives of what appear to be the allodial owners – the Oku We and Owoo families.

Nii Ako Nortei Family in Court

However, the Nii Ako Nortei Family took the Land Commission to court claiming ownership of portions of the land.

The plaintiff had claimed that the Osu Stool and its subjects had since 1922 remained in adverse possession of the land using it for purposes including farming and permanent residential facilities but the government failed to take any action against it.

It also contended that given the fact that the land had not been utilised for the purpose for which it was acquired, the Osu Stool had the right of pre-emption or first acquisition under Article 20(6) of the 1992 Constitution.

In its judgement dated July 28, 2011, the court, presided over by Justice Anthony Oppong, ruled that the claims by the Osu Stool that its subjects had built permanent places of abode on the Achimota land without any protest from government remained uncontradicted.

“Indeed by the conduct or inaction of the government, the subjects of Osu have been encouraged to believe that their title to the land has not been extinguished in my view, this court will not interfere in any way that might disturb the right of the people of Osu to occupy the land.”

“In other words, the Government of Ghana has sat down unconcerned for the subjects of Osu to develop mansions and to even grant a good chunk of the land to other developers who have constructed permanent structures on the land.”

“In my view, what the plaintiffs and their subjects have done on the land for so many years, over 80 years, was adverse and inconsistent with the acquired rights of the government who failed to do anything by way of protest or raising the least objections,” the court ruled.

The court, however, maintained that plaintiff’s claims with respect to Article 20(6) was misconceived and palpably wrong in law as the provision referred to compulsory acquisition that happened after the coming into effect of the 1992 Constitution.

The Nii Ako Nortei Family subsequently had a Writ of Possession from the Courts issued on April 24, 2014 to take over the 172.68-acre land.

Headmistress speaks

The decision of the court is not sitting well with the Achimota School Headmistress who stated that the Lands Commission was wrong in not involving the school in the legal process.

“Not until last Wednesday, we didn’t know anything about this case. The land belongs to the school and not the Lands Commission,” she said.

Ms Adom said the Achimota School land grabbing tendency had been going on for a while now. She said it was time to save the land from being completely taken over without any space left for future expansion.

“People are sitting down unconcerned. This is a government property and we should protect national assets and not allow individuals to grab them anyhow.

“If we sit down and allow people to take away government lands, posterity will judge us. Where will our children go to school if we are to give away this land to so-called ultra modern estate developers who are even bent on destroying the Achimota Forest,” she asked.
