According to the defence counsel, led by Augustine Asafo Adjei, this would aid them to put up an informed defense for their client.

The application therefore put a halt to the continuation of the cross-examination of the victim, Evelyn Boakye, expected to take place today.

The case was hence adjourned to Thursday, March 23, for the prosecution to file their statement with the ruling expected in the afternoon for hearing to continue.

Jihad Chabaan is alleged to have pushed the victim’s face into blended pepper on Sunday, February 26.

He has since been suspended by Management of Marwako.

The Police granted Mr. Chaaban a bail of GHc 20,000 with two sureties, and as part of his bail conditions, he is expected to report to the Tesano District Police Station every Tuesday and Friday.

According to a source close to her family, she has been experiencing suicidal tendencies.

She is said to have been receiving treatment over the past few days. But she was admitted yesterday [Thursday] when her situation worsened with serious abnormalities after she left court leading to her admission.

Meanwhile, a lawyer for the assault victim, Francis Xavier Sosu, has indicated he intends to file a civil lawsuit against Mawarko Fast Foods after an Accra Magistrate Court on Thursday, granted bail to Jihad Chabaan, the supervisor who has been charged with assault.

Mr. Chabaan is alleged to have dipped Evelyn’s face into blended pepper at the Abelemkpe branch of the fast food chain. The Management of Marwako suspended the supervisor after the allegations emerged.

The Lawyer noted that the suit and any related actions will be on the instruction of the victim and her family.

The Police granted Mr. Chaaban bail to the sum of GHc 20,000 with two sureties, and as part of his bail conditions, he is expected to report to the Tesano District Police Station every Tuesday and Friday.

The magistrate court adjourned the case to March 20, 2017, to allow the defence counsel continue the cross-examination of the victim.

“We are doing this on the express instruction of the victim and her family who want us to assist them to ensure that they get justice in this matter.”

The lawyer for Jihad Chaaban, later denied claims that his client and the management of Marwako Fast foods, were intimidating potential witnesses in the trial.

During proceedings in court on March 8, the prosecution argued that, the accused and Marwako’s management were threatening to dismiss staff members who had been invited by the police to serve as witnesses in the case.

Chaaban’s lawyer, Augustine Asafo Adjei, rubbished such claims as false, noting that the police had said it had already concluded investigations before the court hearing.

Mr. Asafo Adjei also asserted that, during the court proceedings, the investigator looking into the case stated categorically that there was no external interference.

Mr. Chaaban was remanded into police custody on Wednesday by an Accra Magistrate Court and during proceedings, the prosecutor argued that the accused and Marwako management were threatening to dismiss staff members who had been invited by the police to serve as witnesses in the case.

But Mr. Chaaban’s lawyer, Augustine Asafo Adjei, rubbished such claims as false, noting that the police has said it has already concluded investigations.

Mr. Asafo Adjei also asserted that, during the court proceedings, the investigator looking into the case stated categorically that there was no external interference.

Speaking to Citi News‘ Fred Djabanor, he said: “So the issue is, if that is even true, which people are they going to parade as witnesses before the court? Who was there to come and testify? The police have said they have investigated that matter. What the police have said is that they have completed investigations.”

“That assertion by the police is false. See how they disgraced themselves before the court where the investigator who conducted the investigation is also saying another thing, then the commander comes in to say another thing… the investigator who is supposed to be doing the investigation said the person didn’t interfere.”

Mr. Chabaan, who is a Supervisor at the Abelemkpe branch of the Marwako Restaurant, is said to have grabbed the head of the 25-year-old Ghanaian female employee and dipped her face in blended pepper.

The Minister has given the Labour Department a week to conclude the investigations.

The Minister visited the Abelemkpe branch of Marwako Fast Foods in Accra, today [Tuesday], after the alleged assault on one Evelyn Boakye.

The Employment Minister was at the restaurant together with the Minister for Gender, Children and Social Protection, Otiko Afisa Djaba.

Her Lebanese supervisor is alleged to have forced her face into blended pepper.

Following public outrage and subsequent arrest of the suspect, Mr. Baffour Awuah said the Labour Department’s investigation would run alongside the Police investigation.

“We will respect the laws of this country and we will allow the police to do the criminal aspect of the case, but the labour issues in there will be investigated by the labour department of our sector. It is not just about the criminality, but also labour issues; worker employee associations.”

The Lebanese supervisor at the centre of the assault, Jihad Chaaban, has formally been charged with assault by the Police.

He was processed for court earlier on Tuesday, to enable the police present the facts of the case, but the process was deferred because the Abeka Magistrate Court did not sit. He is currently on bail.

Mr. Baffour Awuah added that, the outcome of the investigation will determine the ministry’s course of action

“We will at this stage not conclude as to whether the case is over or not. For us, it has just even begun because we are just going to do the investigation,” the Minster said.
