The Abeka district court has adjourned its judgment in the case where a Lebanese supervisor, Jihad Chaaban is facing trial for assaulting an employee, Evelyn Boakye.

The court’s decision follows an announcement by lawyers for the accused person that the two parties had reached a settlement in the case.

According to the magistrate, the adjournment was necessary to enable her to study the terms of settlement and decide whether to go on with her judgment or not.

Jihad Chaaban, was reported in February to have allegedly grabbed the neck of Evelyn Boakye and pushed her face into a jar of blended pepper. According to the prosecution, he accused her of fidgeting with the blender.

Ms Boakye was an employee at the Abelenkpe Branch of Marwako Restaurant.

Chaaban was charged with offensive conduct by calling the victim a prostitute and intentionally and unlawfully causing harm and assault.

He however, pleaded not guilty to the charges.

Jihad Chaaban, the Marwako Fast Food Supervisor has informed the Abeka District Court that he would be calling two witnesses to testify for him.

Ending his cross- examination, Chaaban disagreed with prosecution’s assertions that it was his fault that the blended pepper splashed on Ms. Evelyn Boakye’s face.

According to Chaaban, Ms. Boakye, a female employee who is accusing him of splashing blended pepper in her face, told him that she had pain in her eyes after chopping onions in the restaurants’ kitchen.

[contextly_sidebar id=”mJ6YmRSZjeltTczTzRsS7clJ3LjRId2m”]The Supervisor also denied that it was through his “pushing and pulling” of the victim’s head to take a look into the blended that led to the splashing of the pepper on her (victim)’s face.

He however admitted that he gave money to one Ali a worker of the Restaurant to accompany the victim to the pharmacy to purchase medicine for Ms. Boakye’s eyes.

Chaaban further admitted that Ms. Boakye had never demanded money from him since she began work at the Restaurant.

According to him, he however heard that Abigail, an employee of the restaurant and the victim were planning to demand money from him (Chaaban).

The Supervisor maintained that he gave two cautioned statements to the Police without any compulsion.

The accused person explained that, the Police however did not give him the chance to explain himself adding that he was also not given an Arabic Interpreter at the Police Station before those two statements were taken.

Hearing has been adjourned to June 15.

Chaaban, the 26 year old Supervisor has been put before the court for allegedly dipping the face of Ms. Boakye into blended pepper at the Abelemkpe Branch of Marwako Restaurant.

The accused is standing trial over offensive conduct, intentionally and unlawfully causing harm and assault.

He has denied the charges and is on bail. Chabaan on February 28, this year, allegedly assaulted the victim for fidgeting with the Restaurant blender and working slowly.

Due to the conduct of the victim, Chaaban is alleged to have grabbed the head of the victim and dipped her face in a blender full of blended pepper and other ingredients.

Lawyers for Jihad Chaaban, the Abelenkpe Branch Supervisor of Mawarko Restaurant, a Lebanese food chain in Ghana, who’s facing trial for assaulting a Ghanaian female employee, have served notice they may file a submission of no case despite being directed to open their defence.

A submission of no case is an application seeking to be acquitted without having to present a defence in a case. If a judge does not accept the submission, the case continues and the defence must present their case.

Jihad Chabaan, who is accused of showing the face of the caterer into blended pepper has been charged with assault.

Speaking to journalists after today’s [Wednesday] hearing, lead lawyer for the accused, Hulio de Medeiros, said the admission was a confirmation of their belief that their client was innocent.

“The investigator said that this was an accident. In view of that, we intend to bring a submission of no case. You will agree with us that we have said time again that this was an accident. Our client never intended to put pepper in he girl’s eyes. This is what we call an occupational hazard. It happens in our offices, it happens in our factories, in happens in the restaurants,” he said.

An Accra magistrate court has remanded into police custody the Lebanese Supervisor at the center of the Marwako Restaurant assault case, Jihad Chaaban.

The magistrate, Victoria Ghansah, gave the ruling after an application by the prosecution on Wednesday, March 8, 2017.

The prosecutor argued that, the accused and the company had started interfering in the case, by threatening to dismiss staff members who had been invited by the police to serve as witnesses in the case.

The prosecutor also added that, the remand was necessary, because the police could vouch for the security of the accused person.

The Lebanese national, who is a Supervisor at the Abelemkpe branch of the Marwako Restaurant, is said to have grabbed the head of his Ghanaian female staff, and dipped her face in blended pepper.

Jihad is also alleged to have subsequently locked her up with the burning and hurting eyes, preventing the other worried colleagues from helping her.

The 25-year old lady in an interview with Citi News, said she did not do anything wrong to provoke the attack.

But Mr. Chaaban in an apology letter said he did everything possible to get help for the victim after the incident. He however disputed claims that he locked up the victim after he forced her face into the blended pepper.
