An Accra District Court has summoned the pathologist conducting an autopsy on Member of Parliament for Abuakwa North, J.B Danquah-Adu, over delays in submitting his report.

The court issued the order after it was forced to adjourn the case involving two persons suspected to have murdered the late MP.

[contextly_sidebar id=”2jXYvulUYNebqFn4Tns9OCTLY7N40UPG”]The prosecution during the hearing of case today [Friday], told the court it was facing difficulties accessing the pathology report of the victim, hence the delay in prosecuting the matter.

The pathologist, Dr. Adusei, faced a similar fate a couple of weeks ago in the suit having to do with the murder of Major Maxwell Mahama, due to the delay of a pathology report.

J.B Danquah Adu was murdered in his apartment in 2016 at Shiashie.

Two suspects, Daniel Asiedu and Vincent Bosso, were subsequently arrested and charged with murder following the incident.

Facts

The facts of the case, as presented by DSP Amegah, were that the deceased MP lived with his family in a one-storey house at Shiashie, near East Legon, a suburb of Accra, whilst Asiedu and Bosso lived at Agbogbloshie, also in Accra.

About 11:40 p.m. on February 8, 2016, the MP arrived home in his private car driven by his driver.

The driver had handed over the ignition keys of the car to Danquah-Adu and left for home, after which the MP retired to bed in a room located on the first floor of his house.

At about 1 a.m. on the same night, Asiedu and Bosso, armed with a catapult, a cutter and a sharp knife, went to the legislator’s house.

Bosso is said to have assisted Asiedu to enter the house by scaling the fence wall on the blind side of a security man who was fast asleep.

On entering the house, Asiedu picked a ladder and climbed onto a porch on the top floor and entered the MP’s bedroom through a window, whilst Mr. Danquah-Adu was sleeping.

Whilst Asiedu was searching the room, the MP woke up and held him. There ensued a struggle, during which Asiedu stabbed the MP in the right chest above the breast.

The MP consequently held the knife, and Asiedu pulled it through the MP’s hand, making a deep cut in his palm.

The legislator, who bled profusely, fell by his bed, after which Asiedu stabbed him several times on his right chest and neck.

On realizing that the MP was dying, Asiedu left the room and took with him three iPhone smart phones.

Meanwhile, the struggle between the MP and Asiedu had drawn the attention of the security man in the house, who alerted other security men in the neighbourhood.

Having been alerted to the impending danger, Bosso took to his heels, leaving Asiedu behind.

However, Asiedu managed to descend from the top of the house and jumped over the electric fencing on the walls of the house into an adjoining house and escaped.

The two suspects arrested in connection with the murder of the former Member of Parliament for Abuakwa North, are still in prison custody almost 24 hours after charges against them were dropped at an Accra High Court.

On Tuesday, the Court ordered that, the two be discharged after the State Attorney, Sefakor Batse, ruled that the trial will not continue.

[contextly_sidebar id=”eCCKPVaHgllORgH1XHfKWgEe6pjKIST3″]The two were standing trial for robbing and killing the former MP for Abuakwa North, J.B. Danquah, at his residence at Shiashie in Accra.

Speaking to Citi News, the Public Relations Officer of the Ghana Prisons Service ,Vitalis Ayeh, said the suspects will be released to the Police if officials at Nsawam Prisons receive the final clearance document from the court.

“The process from the Court is that, if somebody is discharged, they should come to the prisons and pick their properties, and again they should come with a discharge warrant from a court of competent jurisdiction directing the prison authorities to release them from prison custody. As at Monday, when they returned, the discharge warrant had not come. We are waiting for it … We understand it is on its way coming. As soon as we get it and we are satisfied that it is coming from a court of competent jurisdiction, we release them to go.”

He explained that the two suspects would have been discharged by the court as soon as the judgement was passed if it was “just a normal remand case.”

How J. B Danquah was killed

The Abuakwa North legislator was on Tuesday, February 9, 2016, stabbed to death at his Shiashie residence in Accra.

Two days after his murder, the then Accra Regional Police Command, led by COP George A. Dampare, arrested a prime suspect, Daniel Asiedu, who allegedly confessed to committing the crime.

Vincent Bosso was later arrested as having conspired with Asiedu to commit the crime.

Court proceedings

In the course of the trial, the prosecution tendered in a post-mortem report of the MP, Forensic DNA Report, Blood stained T-shirt of Asiedu, a knife used by Asiedu, the three iPhones of the deceased, Asiedu’s pair of slippers which he left at the crime scene, his prison records, and radiology report determining his age, his medical report, all as evidence to prosecute him.

Investigations into the case involving the two suspects arrested in connection with the murder of  the former Member of Parliament for Abuakwa North, J.B Danquah, will be re-opened.

This was revealed by the Attorney General, Gloria Akuffo, in an interview with Citi News.

Speaking to Citi News, the AG explained that, the case was dropped to allow for further investigations into some aspects of it.

The AG clarified that, the suspects will be re-arrested after investigations into the case re-opens.

“You will recall that, the case had been tendered before I took office. I had made an undertaking to the people of Ghana that I will look at everything on our desk and this matter is one of those. I have together with my officials here taken a hard look at the docket and we have come to the decision that there are aspects of the matter that require further investigations, and to be able to do that, then we need to discontinue because we cannot reopen investigations when the case is on trial, so what has necessitated the withdrawal by the entering of a nolle prosequoi is to enable us conduct further investigations into aspects of the matter.”

How J. B Danquah was killed

President Nana Akufo-Addo has eulogized his uncle J.B Danquah who died some 52 years ago.

The President, at a wreath laying ceremony in honour of his uncle today [Saturday], said the NPP and Ghanaians in general will forever hold on to the principles introduced by J.B Danquah.

Danquah stood as a presidential candidate against Nkrumah in April 1960 but lost the election. He was a member of the Big Six.

On 3 October 1961, he was arrested under the Preventive Detention Act on the grounds of involvement with alleged plans to subvert the CPP government.

He was released on 22 June 1962, and later elected president of the Ghana Bar Association.

But Danquah was again arrested on 8 January 1964, for allegedly taking part in a plot against the President. He suffered a heart attack and died while in detention at Nsawam Medium Prison on 4 February 1965.

After the overthrow of the CPP government in February 1966 by the National Liberation Council (NLC), Danquah was given a national funeral and rehabilitated.

A lawyer defending two suspects in the murder of J. B Danquah, MP for Abuakwa, has asked a District court to compel the Police to provide him with medical report on one of his clients, Daniel Asiedu’s age.

Mr Augustine Obuor noted that when Asiedu was arrested he told the Police that he was 18 years old but the Police disagreed.

[contextly_sidebar id=”N3xaUYPRALCTYwGNkpvoRApRfMjAEtSh”]According to Mr Obuor,the Police are still keeping a report which indicated that that the accused is a minor and so there would be no need to appear in court.

However counsel said if the report indicated otherwise, it would give Asiedu the opportunity to prepare for his defence during the committal proceeding and the trial.

“If the accused person is 18 years he is still a young offender and needs to enjoy certain rights under the Juvenile Justice Act. The prosecution is bound to provide documents per the procedure of the trial,” he said.

Superintendent of Police Francis Baah said Asiedu did not tell the Police that he was 18 years during his arrest.

He said the Police had done wide range of investigations and their outcome indicates that Asiedu was not 18 years old.

According to the prosecution the Police had gone to Nigeria where he attended school, the hospital where Asiedu was born, looked through his weighing card and talked to his father and other relations.

He said prosecution did not have to serve the defence with a piece meal adding as at the time Asiedu was “writing his statement the age he gave us was 19”.

Mr Baah said the medical report confirmed that Asiedu was above 18 year old.

The court adjourned the matter to October 19 for continuation of submissions on Asiedu’s Medical report.

Asiedu  and Vincent Bosso are  being held for murder of the Late MP, which occurred on February 9, at his Shaishie residence.

Bosso has been charged with abetment of crime.

The facts as presented by Mr Baah are that on February 8, at about 2340 hours the deceased came home in his private vehicle driven by his driver Samuel Berko Sarkodie.

Prosecution said the driver having brought his master home handed over the keys to him and left for his residence at Kasoa while the deceased then retired to his bedroom upstairs.

He said at about 0100 hrs, Asiedu and Bosso, both armed, went to the house of the deceased and Asiedu after entering the house picked up a ladder and climbed to the porch of the top floor and entered the bedroom of the deceased through the window while the deceased was sleeping.

“Asiedu began to search the room and the deceased woke up and held him. Asiedu resisted and stabbed the deceased on the right chest above the breast. The deceased held the knife and Asiedu pulled the knife through the deceased hands creating a deep cut in his palm, “prosecution said.

Prosecution said the deceased who was bleeding profusely fell by his bed helpless and Asiedu stabbed him several times on the right chest and neck.

Realizing that the deceased was almost dead, Asiedu left him and took away his three iphones.

The prosecutor said the struggle that ensued between the deceased drew the attention of the security man who alerted other security men within the vicinity

Mr Baah said Bosso realising danger took to his heels leaving Asiedu behind.

Prosecution said Police investigations led to the arrest of accused persons who stated that their aim of going to the deceased house was to steal.
