Some employees of Jai Mai Communications Limited, a company owned by the deported Indian Businessman, Ashok Sivram, are threatening to embark on a demonstration against what they consider an unfair treatment of their boss.

The about three hundred employees say his absence is negatively affecting the operations of the company and by extension their livelihood.

Speaking to Citi News, Spokesperson for the employees, Richard Ankrah, said they are awaiting clearance from the Police to embark on their protest.

“Our next action is that by Friday we are embarking on a protest. We are waiting for the permission of the Police as well. We have written to them and we are waiting that they will give us the permission to do a peaceful demonstration to plead with the government to kindly grant him the visa and the residence permit as well.”

Background

The GIS, following an order by the Interior Ministry in June 2017, deported Mr. Sivaram on the premise that he had forged his marriage certificate in an application for citizenship, which led his lawyer to contest his deportation by seeking judicial review.

The High Court, which first heard the case, upheld the businessman’s application and quashed his deportation order on July 31 on the grounds that the Interior Minister exceeded his jurisdiction.

The applicant, after the failure of the GIS to comply with the first order, sought an order from the court in September the same year to compel them to comply with the first order.

The High Court once again ordered the GIS to restore the Residence and Work Permit of Mr. Sivaram within seven days, and also ordered the GIS’s assigns, agents and servants to desist from harassing him until his application before the Service was duly processed.

The GIS, represented by the Attorney General’s office, after the second case, filed a stay of proceedings at the High Court which was subsequently dismissed.

They went ahead to appeal the ruling in the Court of Appeal which was also dismissed leading them to the Supreme Court.

The Supreme Court however upheld GIS’s position and quashed the ruling of the High court which had compelled the Immigration Service to restore the work and residence permits of Mr. Ashok Kumar.

Immigration Service justifies deportation

The Ghana Immigration Service has since defended its decision to repatriate Mr. Sivaram from Ghana.

According to GIS, Mr. Ashok was living in the country illegally because his work and residence permits had expired since December 15, 2017.

Indian businessman, Ashok Sivaram, has been extradited for the second time from Ghana by officials of the Ghana Immigration Service.

This follows a Supreme Court ruling where the Justices unanimously overturned a high court ruling which ordered the residential and work permits of Mr. Sivaram to be restored after the Immigration Service and the Interior Ministry deported him.

They also indicated that the judge exceeded her jurisdiction.

Citi News sources at the Ghana Immigration Service revealed that he was deported on Sunday after officials of the service stormed his residence.

Meanwhile, workers of his company Jai Mai Communication Limited on Monday staged a demonstration, protesting the deportation.

According to them, this could lead to job losses, a situation they fear will impact on them negatively.

Background

The Court of Appeal has dismissed an application of a stay of execution by the Attorney General in the case where the residence and work permits of an Indian Businessman, Ashok Sivaram are under contention.

According to the court made up of three justices, the application and argument by the AG were unmeritorious, hence their decision to dismiss it. The decision by judges brings to four, the number of times the state has lost in its bid to have the businessman thrown out of the country.

The state has been seeking a stay of execution after it was ordered by the High Court to within seven days restore the work and residence permit of the Indian Businessman.

Background

The court on July 31, 2017, quashed the deportation of Mr. Sivaram by the Interior Minister, Ambrose Derry.

According to the court, the Interior Minister exceeded his jurisdiction by determining fraud against the Indian businessman without recourse to the court.

The High Court in September ordered the Immigration service to restore the work and residence permit of Mr. Sivaram within seven days, after months of failing to do so, despite a decision quashing his deportation due to its illegal nature.

But Mr. Sivaram, since his return to the country, has not been given a visa despite a court order.

The Indian businessman has also petitioned President Nana Akufo-Addo to call the Minister of Interior and the Comptroller of the Ghana Immigration Service to order over what he termed as harassment by the two.

Mr. Sivaram said he was constantly being harassed by officials of the Ghana Immigration Service, and he believes his frustrations are part of a grand scheme to transfer interests in his company, Jai Mai Communications Limited, to his business partner.

The Comptroller-General of the Ghana Immigration Service, Kwame Asuah Takyi, has however rejected accusations that he is conniving with the Interior Minister to frustrate the Indian businessman.

An Indian businessman, Ashok Kumar Sivaram, has sued the Comptroller of the Ghana Immigration Service (GIS) Kwame Takyi, for contempt.

In an application for committal for contempt, lawyers for the businessman contend that, the head of the Immigration Service has failed to comply with orders of the High Court instructing the service to restore the residence and work permit of their client.

An Accra High Court has dismissed an application praying it for a stay of execution of an earlier judgment ordering the Immigration Service to restore the work and residence visa of Indian businessman, Ashok Kumar Sivaram.

The Presiding judge, Justice Naa Adoley Azu, explained that her decision was to prevent Mr. Ashok from being at the mercy of the Immigration Service, while dealing with his legal issues in Ghana.

She also dismissed the Attorney General’s argument that the non-granting of the stay application will amount to interference of the work of the Immigration Service as statutory bodies are not above the law.

[contextly_sidebar id=”XBP4iDWJLIeZPetQvDU7SCDTXIVO6yak”]Justice Azu also questioned the argument by the Attorney General to the effect that security of the nation would be at stake if the stay of execution was not granted.

The Attorney General represented by Jasmine Armah, arguing the application, told the court that if the stay is not granted, it will serve as a precedence for others to use the court to get legally revoked permits overturned.

She added that the restoration order will also be a direct interference with the work of the Immigration Service.

On his part, lawyer for the businessman, Gary Nimako, objected to the application, arguing that the Attorney General has not demonstrated in any way the irreparable damage it would have to deal with, if the stay was not granted as per law.

The High Court last week ordered the Immigration service to restore the work and residence permit of Mr. Sivaram within seven days, after months of failing to do so, despite a decision quashing Mr. Ashok’s deportation.

Argument for adjournment

The Attorney General’s representative, Jasmine Armah, before going ahead to move her application on Friday, prayed for an adjournment of the case because she had not seen and read the affidavit in opposition filed by the respondents, and served on her office on the 28th of September.

She also told the court that she needed instructions from the AG before responding to the affidavits

Her prayer was objected to by the opposing lawyer, who indicated that the application was incompetent hence the move by the Attorney General.

He later withdrew his affidavit forcing the Attorney General to go ahead with the case.

The Attorney General has filed an application at the High Court to stay execution of the judgment ordering the Ghana Immigration Service, to restore the work and residence visa of Indian Businessman Ashok Kumar Sivaram.

According to the Attorney General, it has filed an appeal against the decision quashing the deportation order, and wants the restoration order put on hold till the Court of Appeal makes a determination of their case.

It also stated as part of their case that, if the restoration order is allowed to stand, it will serve as precedence for others to use the court to get legally revoked permits overturned.

An Accra High Court has ordered the release of the residence and work permit of Indian businessman, Ashok Kumar Sivaram.
 
Mr. Sivaram’s residence and work permits, were withdrawn as a result of a deportation which was later declared illegal by a High Court.

According to the court, presided over by Justice Naa Adoley Azu, after the quashing of the deportation order by the High Court, it was the responsibility of the Immigration and the Interior Minister to ensure the old order was restored which they failed hence her decision.

Justice Azu further added that, her order should be complied with within seven days, explaining that the state authorities should desist from harassing Mr. Sivaram during the period.

Application for mandamus

In his application, which named Mr. Takyi and Mr.  Dery as respondents, the businessman is prayed for the restoration of his residence and work permit, which was withdrawn by the GIS following his deportation on June 1, 2017, on the basis that his deportation was quashed by the High Court on July 31, 2017.

He is also praying for an order restraining the two, their agents, servants or anyone acting on their authority from “making any attempt to deport him from Ghana’’ or “harassing him until his application is determined.’’

Mr. Sivaram claimed that, the GIS had refused to accept the money he paid as the requisite fee for his application for visa on arrival, which he claimed was a “deliberate attempt to decline his application.’’

He therefore wants the court to declare the purported action by the GIS as “unfair, unreasonable and not supported by law’’ and order for the GIS to accept the money, and process his application for visa on arrival.

Meanwhile, the Comptroller-General of the Ghana Immigration Service, Kwame Asuah Takyi has rejected accusations that he is conniving with the Interior Minister Ambrose Dery, to frustrate an Indian businessman.

“He has misled the public. He has thrown dust into the eyes of the public. What would the Minister of Interior, honorable Ambrose Dery, gain by interfering in the business of a foreign expatriate… why should he?” Mr. Takyi asked in a Citi News interview.

The Asutifi North District Assembly in the Brong Ahafo Region has expressed its determination to increase its internally generated funds through effective revenue collection.

The assembly also says it is retraining its revenue collectors to enable to effectively carry out their duties.

The District Chief Executive (DCE) Anthony Mensah made these disclosures in an address to Assembly members, Head of Departments (HODs), Traditional authorities, Civil Society Organizations (CSOs) and a cross section of the public at the first ordinary meeting of the third session of the sixth assembly in Kenyasi.

He called for support and collaboration from all stakeholders of the assembly to help make the task a reality to enable the assembly close the revenue gaps.

On education, he said the assembly paid GHC104,000 into the accounts of Gyamfi Kumanini Senior High/Technical School as a commitment to provide bursaries for 200 indigenous first year day students of the school for 2016/2017 academic year.

He said his outfit will provide more infrastructures to ensure that the Kenyasi Health Centre was upgraded to a District Hospital to efficiently serve the health needs of residents.

On Water and Sanitation, Mr. Mensah commended IRC-Ghana, Safe Water Network and Conrad N. Hilton Foundation for selecting the district to pilot the Full WASH Coverage programme aimed at improving the living standards of residents by providing Water and Sanitation facilities for a 13 year period in consonance with Sustainable development Goal Six (SDG6).

He however lamented effective and efficient solid waste disposal was a huge challenge to the assembly due the unavailability of a final disposal site and therefore appealed to stakeholders to help in the processes and negotiations with the chiefs and opinion leaders of Ntotroso Traditional Area for a piece of land for the purpose and pledged to procure more skip containers to augment the existing ones to enhance the assembly’s waste management efforts.

The Presiding Member (PM),  Ebenezer Kwaku Addo for his part called on Assembly members, Head of Departments and Stakeholders to support the assembly in it’s develop agenda and provide the necessary facilities to upgrade the health centre to a district hospital.

A High Court in Accra has ordered for the immediate release of the Indian Business man Ashok Kumar Sivaram who was arrested upon returning to the country following an order by the court quashing his deportation by the interior minister.

According to the court presided over by Justice Ackah Boafo the detention of the Ashok was unlawful and undermines the courts earlier order overturning his deportation on Monday.

The Judge further asked the Indian national to deposit his passport with officials of the Immigration Service of the applicant and report to any designated officer of the Service on Tuesday for his stay to be regularized.

Mr.  Sivaram who returned to the country on Wednesday  was immediately arrested and kept in detention by officials of the immigration service at the airport until his release by the court today (Friday).

Explaining their decision to detain Ashok Kumar Sivaram, lawyer for the    Immigration Service Peter Claver Nantuo told the court the plaintiff in the case arrived in the country without a visa hence their action.

When further pressed by the judge to explain why Mr.  Sivaram had been in custody for forty eight hour without being charged, the lawyer could not give any reasons for the action.

Background

An Indian business man sued the Interior Minister and the Comptroller General of Immigration for unlawfully approving his deportation on grounds that he obtained a fake marriage certificate to enable his stay in the country.

The suit revealed that the “the Applicant was deported from Ghana on the said morning of 1st June 2017 without any notice to him or being offered the opportunity to be heard on the allegation of forgery leveled against him.”

The court upon hearing the arguments of both sides on Monday delivered a judgment quashing the action taken by the two state officials, describing it has unlawful and breach of the fundamental human rights of the plaintiffs.
