Lawyer for Exton Cubic Limited, Reindorf Twumasi Ankrah has served notice of a suit against the state over what he describes as the unlawful seizure of Ibrahim Mahama’s Engineers and Planners (E&P) vehicles and mining equipment.

Vehicles and equipment belonging to Exton Cubic’s sub-contractor, Ibrahim Mahama’s Engineers and Planners (E&P), were impounded in the Nyinahin township on orders from the Ashanti Regional Minister, Simon Osei Mensah, following suspicions the mining company was operating illegally.

[contextly_sidebar id=”6d1Hw7e9L2ZB26ZaOp7zNWgmHThrJUkL”]Mr. Ankrah believes the state wrongfully interfered with their client’s right to prospect on the Nyinahin Bauxite Concession of Tano Offin forest reserve when their vehicles and equipment were seized.

He argued in a statement that the recent frustrations to halt its exploration of the concession which resulted in the seizure of trucks have caused their client “financial loss.”

“ We have been instructed by our client that the seizure and detention of the said trucks has not only adversely affected our client’s business operations but has occasioned and continues to cause our client, financial loss.”

“In the light of the foregoing, our client has instructed us to serve you notice of its intention to institute legal proceedings against the State as a result of the wrongful interference by state officials with our client’s right to prospect on its concession and also a breach of its right to administrative justice,” the statement said.

The mining company had earlier served notice of suing the police and some authorities in the Ashanti Region over the seizure.

Equipment seizure costing us $40,000 daily – Exton Cubic

A few days ago, the company had revealed that the seizure of their vehicles and mining equipment costing the company over $40,000 daily.

According to Exton Cubic, the losses started on August 20, when the vehicles were impounded in the Nyinahin township.

At a press conference on Thursday, the company’s Public Relations Officer, Samuel Gyamfi, reiterated the company’s assertion that the impounding and detaining of its officers was unlawful.

“The company is losing over $40,000 a day due to this unlawful act and as we have told you, we are going through the legal process with our lawyers and very soon, the authorities concerned will be written to and we will make our position clear to them.”

Mr. Gyamfi maintained that “… what they have done to us is not fair. What they have done to us is not allowed or permitted by law and expect that the right things will be done.”

Brong Ahafo Regional Minister, Kwaku Asomah-Cheremeh has issued a stern warning to persons who are in unlawful possession of state vehicles and equipment in the region to surrender them to their respective organizations or face the law.

He disclosed the Regional Coordinating Council will introduce measures to prevent the misuse of government properties and equipment.

Mr. Asomah-Cheremeh served the notice when he took delivery of impounded heavy duty government vehicles that were private hands.

The vehicles include four graders,  one buldozer, four tipper trucks and three pay loaders belonging to the Ministry of Local Government and Rural Development (MLGRD) supplied to Metropolitan, Municipal and District Assemblies (MMDAs) to assist them in construction and infrastructural development.

The vehicles were allegedly stolen by some officials and supporters of the former National Democratic Congress (NDC) right after they lost power in the 2016 general elections. The

The Minister lamented the lack of proper documentation for the vehicles.

He commended the regional police command and individuals in the region for their vigilance in ensuring that the vehicles were returned to the state.

“These equipment would have gotten missing but for the timely intervention of the Ghana Police Service and the vigilance of some individuals, we would not have seen the equipment today. The colours might have been changed; registration numbers would have gone off substituting same for new registration numbers. Thankfully, the police in collaboration with the RCC and for us at the RCC, we do not have any documentation covering these equipment,” he lamented.

The Brong Ahafo Regional Crime Officer, Supt. Nana Kwaku Duah who led the team to impound the vehicles told Citi News the exercise was based on a tip off by some vigilant citizens and staff of the BARCC.

He said their investigations led them to Nkoranza, Kenyasi, Hwidiem, Sunyani, Kukuom, Goaso and Akomada in the Offinso North District of Ashanti Region to impound the vehicles.

Supt. Kwaku Duah said the person behind the scheme was in police custody awaiting trial.

He said efforts were being made to transport the remaining three from Goaso and Akomada to the regional capital.

According to him, the current logistical challenges makes it difficult for the Police to fight crime effectively and as well protect its men.

[contextly_sidebar id=”KjXo2zBKboqntyda1r3SGvjzoyx34GHm”]About five policemen have been shot in line of duty over the last three months, with the recent one being the killing of a police constable at Lapaz in Accra on Thursday.

The Police administration has offered GH10,000 to any person who provides information on the arrest of the two suspects responsible for the incident.

Speaking to Citi News’ Franklin Badu Jnr, the IGP called for more support for the police to protect its officers against criminals.

“We are always working in danger. We very much appreciate it. This is not peculiar to Ghana alone and it behooves us to manage this situation to the best of our abilities. The people of our country are peace loving people that is why they have enacted laws and they have asked us to champion in ensuring that there is peace in the society so that they can go about their business; and we the champions if things like these can be done to us then what cannot be done to the ordinary person?” he asked.

“…And that is why we are not going to leave any stone unturned in getting to the bottom of this case. It also calls to fore the evaluation of our officer safety needs and this what we are going to do. In certain countries police officers do not bear arms at all, and now they are changing their attitudes towards some of these situations. It is true that we have some logistical challenges and this is what we are going to address,” Mr. Apeatu said.

A number of police officers have lost their lives in gun battle with suspects. On Thursday, two armed men were shot in broad day light at Lapaz in Accra when they attempted foiling a robbery attack.

Barely a month ago, a Policeman believed to be in his 30s was also shot dead by two armed men. The officer, Michael Kporye, was shot in the face and in the chest at Tulaku near Michel Camp, in the Greater Accra Region.

A few weeks later, Lance Corporal Kwaku Mensah, who was stationed at Anwiankwanta in the Bekwai Municipality, sustained several gunshot wounds when gunmen attacked a vehicle he was traveling on.

The vehicle was attacked by gun-wielding robbers at about 10 pm.
