The embattled Deputy General Secretary of the opposition National Democratic Congress (NDC), Koku Anyidoho has been granted bail after spending two nights in the custody of the Bureau of National Investigations (BNI).

Mr Anyidoho was released by the Criminal Investigations Department (CID), the agency handling the case, in the presence of his father, Major General Henry Kwami Anyidoho and his lawyers.

CitiNewsroom’s Fred Djabanor reported that the conditions under which he was released are immediately not known.

Mr Anyidoho was picked up at the International Press centre on Tuesday for making comments deemed treasonable.

Police have since been given permission to seize all electronic devices belonging to Mr Anyidoho by a High Court.

The court gave permission for all electronic gadgets including laptops, iPhone and iPads, believed to hold information related to the charge to be seized to aid the police investigations.

Mr Anyidoho landed in hot waters when, in an interview on Accra-based Happy FM, he called for the overthrow of President Nana Akufo-Addo over the ratification of the controversial defence cooperation agreement between Ghana and the US.

He said the overthrow will be in the form of a “civilian coup d’etat”.

The host of the show on which the comments were made, Kwame Affrifa, had also been invited by the police to aid in their investigations.

Support from Mahama

A former President, John Mahama, made recent comments on social media which suggest he did not approve of the way Mr. Anyidoho was taken into custody by the police.

On Wednesday, Mr Mahama criticised the Police for what he described as their ‘high-handed’ responses to “innocent” Ghanaians who massed up at the Police Headquarters on Tuesday night in solidarity with the arrested NDC national executive.

In a Facebook post, the former President chided Akufo-Addo government for the manner in which Mr Anyidoho was arrested and later charged with treason.

He, however, did not make mention of the comments made by Mr Anyidoho which have been widely condemned.

Mr Mahama later visited Mr Anyidoho at the BNI headquarters.

The Police Criminal Investigations Department (CID), has officially written to Accra-based Happy FM to produce an official copy of a recording in which the Deputy General Secretary of the National Democratic Congress (NDC), Koku Anyidoho, is believed to have made comments deemed treasonable.

The host of the show on which the comments were made, Mr Kwame Affrifa, has also been invited by the police to aid in their investigations.

Mr. Anyidoho was picked up at the International Press centre on Tuesday to assist the police with investigations and spent last night in the custody of the police after being charged with treason.

His Oyarifa residence in Accra was also searched, before he was moved from the police headquarters and sent to an unknown location after he was refused bail.

[contextly_sidebar id=”2iHtzN73hUZKmVTbtcGtM2eilTdSoOId”]It is still unclear where Mr. Anyidoho is being held currently, as his lawyers demand answers from the police.

Koku Anyidoho, in an interview on Accra-based Happy FM, indicated that President Akufo-Addo will be overthrown because of the ratification of the controversial defence cooperation agreement between Ghana and the US.

The deal was ratified by Parliament despite the resistance of some sections of the public, which Anyidoho believes, will spark a “social revolution” in the country.

“There will be a civilian coup d’état. There will be a social revolution. We [NDC] are starting it on Wednesday. The movement is starting on Wednesday. Nana Addo will have sleepless nights. He will suffer diarrhea. He said he wanted to be president, but we will make sure he will be fed up on the seat,’’ he added.

‘External forces’ blocking Anyidoho’s bail – Lawyer

Meanwhile, Anyidoho’s lawyer, Victor Kojogah Adawudu, is suspecting that the influence of some ‘external forces’ is responsible for the refusal to grant his client bail.

According to Adawudu, although the charge of treason brought against Anyidoho is a bailable offence, the security agencies have refused to grant his client that option.

“…we felt that there might be some interference coming from somewhere,” he said on the Citi Breakfast Show on Wednesday.

Anyidoho has since been widely condemned for the comments.

Members of the NDC stormed the CID head office yesterday to demand his release.

Mr. Anyidoho according to NDC officials is currently in the custody of the Bureau of National Investigations (BNI) after security officials searched his house for weapons.

“The current position of the law is that every offense in this country is bailable. Before then, the criminal procedure code specified some offences that cannot be granted bail. The reason why they won’t grant you bail is that they want to keep you in custody to stand trial and to be able not to also interfere with the investigation of the police.”

“Now when this piece of legislation was in our books, my friend and colleague, Martin Kpebu took this matter up to the Supreme Court…and the Supreme Court said that piece of legislation is unconstitutional. It said all offence with magnitude being great or not is bailable…So when somebody comes and says that we don’t have instruction to bail, they have to give us reason. We know what the laws says…that is where the departure and we did not understand and we felt that there might be some interference coming from somewhere,” Adawudu added.
