Indicted High Court Judge, Paul Dery has filed a new lawsuit against the Chief Justice, Georgina Theodora Woode and two others over the Judicial Corruption scandal.

He is seeking, among a litany of reliefs, a declaration that the Chief Justice lacked jurisdiction to inquire into the petition for his removal, presented to then-President John Mahama, based on the Criminal Offences Act, 1960 (Act 29).

[contextly_sidebar id=”Ox4mcfubfiFD32tjwyqVLiUk4vxVOwG2″]Paul Dery is also seeking an order nullifying the petition as he argues it is vitiated by fraud perpetrated by the Defendants.

He also wants the courts to guarantee full insurance or security on legal fees and cost incurred during his legal battles.

Two others mentioned as parties to the lawsuit are the head of the Tiger Eye PI, Anas Aremeyaw Anas and the Attorney General.

The Paul Dery’s legal travails begun after the screening of Anas Aremeyaw Anas’ judicial bribery scandal video and press releases by the Judicial Council on the matter announcing the suspension of the judges involved.

Paul Dery was one of the twelve High Court justices indicted in the video and has since been using the court to discredit the work by the investigative journalist and also to clear his name.

In his suit, he also maintains that Anas via Tiger Eye PI did not have the capacity to carry out private investigations into the perceived corruption in the Judicial Service as he had not obtained any licence and/or permit from the Minister of Interior in accordance with the provisions of the Police Service Act, 1970 (Act 350) and the Police Service (Private Security Organizations) Regulations, 1992 (L.I. 1571).

  • A declaration that the 2nd Defendant lacks jurisdiction to enquire into the 1st Defendant’s petition in purported exercise of her functions under Article 146(3) & (4) of the 1992 Constitution since the said petition alleges the commission of the offence of corruption under section 239(1) of the Criminal Offences Act, 1960 (Act 29).
  • A declaration that the Committee provided for under Article 146(4) of the 1992 Constitution to enquire into any petition pursuant to Article 146(5) of the Constitution, lacks jurisdiction to enquire into any petition if the petition alleges the commission of a criminal offence under the Criminal Offences Act, 1960 (Act 29), or any penal statute for that matter.

Investigative journalist, Anas Aremeyaw Anas, has dared High Court Judge, Justice Paul Derry, to face him with the panel of judges selected by the Chief Justice, rather than resorting to the International Human Rights Court in Abuja to seek redress.

The embattled high court judge, took to the courts, and subsequently to the International Human Rights Courts, praying it to among other things, find Anas Aremeyaw guilty for invading privacy and thereby breaching ethical standards in journalism.

[contextly_sidebar id=”dbYUdOQcIdhgI6KGdICSTwLH4onYfcuG”]Speaking at the Distinguished Lecture Series organised by the Department of Communication Studies of the Central University Miotso Campus, on the topic, “Putting the pieces together: The aftermath of the judiciary exposé”, the ace Journalist defended his line of work which hinged on Naming, Shaming and Jailing.

He noted that, following the expose that led to the interdiction of more than thirty high court and lower court judges, he is facing about seventy two lawsuits which according to him, ‘’ has challenged me for greater things to happen and the impact of my work is what matters.”

There has been concerns about his work with many who have been indicted citing unprofessionalism and breach of journalistic ethics.

However, according to him, his style of journalism is rather saving the country from the hands of people who otherwise would have milked the state coffers dry.

He added that, the way forward “lies on us because at least, we know that judges are great people; but we also know that they can be questioned when they go wrong”.

“Ten years from today; if the judiciary gets back to the position it was, all of us must be blamed. If we all keep a constant eye, we all will have a problem free or minimized corrupt judiciary,” he said.

Speaking on the sidelines of the Public Lecture, the President of Central University, Professor Kwesi Yankah, lauded the efforts of Anas Aremeyaw, for changing the face of journalism not only in Ghana; but also on the continent, and also for keeping a check on corruption in Ghana.

Fresh lawsuit at Ecowas court

Three embattled Ghanaian judges have filed a suit at the court of the Economic Community of West African States (ECOWAS), citing alleged violations of their human rights in Ghana.

Justice Paul Dery, Justice Mustapha Habib Logoh and Justice Gilbert Ayisi Addo, in a joint suit, named the Ghana Government, the Chief Justice of Ghana, the Ghana Judicial Council and the Attorney General of Ghana as the first, second, third and fourth respondents, respectively.

By the suit, the three justices are seeking the enforcement of their human rights which have been allegedly violated by the Ghana Government.

They are among other things seeking an order from the court to direct the Ghana Government to “pay with interest full salaries and allowances which it unlawfully suspended since January, 2016 – arising out of a petition by Tiger Eye PI/Anas Aremeyaw Anas’ for their removal from office.”

Embattled High Court Judge, Justice Paul Dery has threatened to petition the Inspector General of Police, Bank of Ghana and the Financial Intelligence Centre to investigate the activities of ace journalist, Anas Aremeyaw Anas and his Tiger Eye PI firm.

Justice Dery argued that because the court has declared Tiger Eye PI as a dummy corporation that is non-existent in the country’s laws, it is necessary for them to be investigated and dealt with in accordance of the law if found culpable of fraud.

“…the Supreme Court was very clear in its mind that Anas Aremeyaw Anas breached the fundamental law of the land, the 1992 Constitution of Ghana. Anas Aremeyaw Anas has no respect for the law. He acts as and when he pleases as long as it satisfies his selfish interest.”

“Anas Aremeyaw Anas uses a dummy corporation as a vehicle to perpetuate fraud on the citizens of Ghana and the International community. What Anas Aremeyaw Anas does not want Ghanaians in particular and the whole world in general to know is that the Supreme Court of Ghana by its judgment on Thursday, 27th October, 2016 declared that Tiger Eye PI is not a company registered under the laws of Ghana,” he said in a statement.

Justice Dery in the statement also alleged fraud against the company and its activities and promised to drag Anas to court pay all monies paid to him by the state for his investigations.

Judicial corruption scandal

The statement comes on the back of his protracted legal battle with Anas over the method he used for his judicial corruption expose last year.

Anas and his team captured Justice Dery and some other judges on video allegedly taking bribes to compromise judgment.

Below are excerpts of the statement:

Since Anas Aremeyaw Anas has disclosed plans after the judgment of the Supreme Court on 27th October, 2016 to appear before the Committee in his usual hood after the socalled “final showdown”, I have no problem with that.

However, I also want the public to know my intentions. They are as follows:

  1. I would file a complaint against Anas Aremeyaw Anas to the Inspector General of Police to investigate the activities of the dummy corporation, Tiger Eye PI.
  2. I would file another complaint with the Bank of Ghana and Financial Intelligence Centre to investigate the circumstances under which a dummy corporation, Tiger Eye PI, opened an account with Zenith Bank (Ghana) Ltd.
  3. To institute a public interest litigation to recover all monies from Anas Aremeyaw Anas, which he acquired from the government of Ghana by the use of the fraudulent and dummy corporation, Tiger Eye PI as a vehicle in a gargantuan money laundering scheme.
  4. To advice the shareholders of all private companies that Anas Aremeyaw Anas defrauded by the use of the dummy corporation, Tiger Eye PI to take steps to recover their monies. 5. To inform all foreign embassies in Ghana that Anas Aremeyaw Anas is a fraudster for he has been using a dummy corporation, Tiger Eye PI, as a vehicle in a money laundering scam.

Embattled high Court Judges, Paul Uuter Dery and Mustapha Habib Loggo, have sued the Ghana Journalist Association (GJA) for conferring best journalist of the year award on Anas Arememay Anas.

The two judges claimed the award is an endorsement of unethical journalism and pray the Court strips Anas of the award and the GJA charged for contempt.

[contextly_sidebar id=”VsUp1VCL7F3ljSpSejdnPapESvVqjgck”]Justice Dery had earlier petitioned the GJA asking it to withdraw the award from the investigative journalist because in his view, Anas’ judicial corruption piece that won him the award is under contention.

He threatened that failure to heed to his call will result in a law suit.

But Affail Monney prior to the suit told Citi News, the association won’t yield to such demands, and is thus ready to defend its actions in court.

He explained that “Anas doesn’t need any superfluity of proof to show his international solidity and his national competence when it comes to investigative journalism and he has received a litany of awards for what he has done.”

“He is one of the best investigative journalists the world has ever produced. In the wisdom of the association, Anas stood out, nationally and internationally as the best. As far as we are concerned, what happened has been consigned to history,” he added.

An order nullifying the award pursuant to clause 2 of article 1 of the 1992 constitution.

An order directed at the Ghana Journalist Association to withdraw the award from Anas Aremeyaw Anas.
