{"id":94998,"date":"2015-02-27T13:36:02","date_gmt":"2015-02-27T13:36:02","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=94998"},"modified":"2015-02-27T15:01:56","modified_gmt":"2015-02-27T15:01:56","slug":"supreme-court-cancels-district-assembly-elections","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=94998","title":{"rendered":"Supreme Court cancels District Assembly Elections"},"content":{"rendered":"<p style=\"text-align: justify;\">The Supreme Court has directed the Electoral Commission [EC] to call off the much publicized District Assembly elections\u00a0which was <span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2014\/12\/10\/district-assembly-elections-set-march-2015\/#sthash.APXEBEp2.dZ16XfgS.dpbs\" target=\"_blank\"><strong>scheduled for\u00a0March 3, 2015<\/strong><\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">[contextly_sidebar id=&#8221;DGzRUY1Axp6F9i2zQwACudEQI3q0mPL6&#8243;]The EC was <span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/02\/09\/fisherman-sues-ec-district-assembly-elections\/\" target=\"_blank\"><strong>dragged to court<\/strong><\/a><\/span> by an aspiring Assembly man, Benjamin Eyi Mensah, represented by lawyer\u00a0Alex Afenyo Markin.<\/p>\n<p style=\"text-align: justify;\">According to Eyi Mensah, a fisherman,\u00a0<span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/02\/12\/district-assembly-elections-limbo-ec-finally-receives-writ\/#sthash.ZDTbMvE0.dpbs\" target=\"_blank\"><strong>he was denied an opportunity<\/strong><\/a><\/span> to file his nomination despite meeting all conditions to contest\u00a0but the EC closed nominations before the maturation of the Constitutional Instrument (CI) 85.<\/p>\n<p style=\"text-align: justify;\">The Justice William Atuguba led panel of judges ruled in favour of the fisherman on Friday and declared the impending election as &#8220;unconstitutional.&#8221;<\/p>\n<p style=\"text-align: justify;\">According to the Supreme Court, the law on which the EC wanted to hold the election, CI 85 is\u00a0not in force as at the time nominations were closed.<\/p>\n<p style=\"text-align: justify;\">&#8220;CI 85 cannot take retrospective effect,&#8221;
