{"id":94709,"date":"2015-02-26T18:11:51","date_gmt":"2015-02-26T18:11:51","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=94709"},"modified":"2015-02-26T18:18:21","modified_gmt":"2015-02-26T18:18:21","slug":"supreme-court-orders-ec-to-stop-advertising-assembly-election","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=94709","title":{"rendered":"Supreme Court orders EC to stop advertising assembly election"},"content":{"rendered":"<p>The Supreme Court\u00a0 has ordered the Electoral Commission (EC) to stop running \u00a0adverts of the upcoming district assembly elections but is set to rule on the substantive case on Friday.<\/p>\n<p>According to the court, it was not right for the Commission to continue advertising the election when there\u00a0 is a case currently challenging the legality of the processes before\u00a0 the\u00a0 conduct of the election which has been slated for <a href=\"http:\/\/4cd.e16.myftpupload.com\/2014\/12\/10\/district-assembly-elections-set-march-2015\/#sthash.APXEBEp2.dZ16XfgS.dpbs\"><span style=\"color: #666699;\"><strong>Tuesday \u00a0March 3rd 2015.<\/strong><\/span><\/a><\/p>\n<p>Benjamin Eyi Mensah, who wanted to contest in the upcoming district assembly elections filed a case seeking to <span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/02\/25\/supreme-court-adjourns-ec-fisherman-case-to-thursday\/#sthash.phDBHFj4.JYgeWzRq.dpbs\" target=\"_blank\"><strong>annul the organization<\/strong><\/a><\/span> of the elections.<\/p>\n<p>According to him, he was denied an opportunity to file his nomination despite meeting all conditions to be registered as a candidate because the EC closed nomination before the maturation of Constitutional Instrument (CI) 85.<\/p>\n<p>Lawyer for the plaintiff, Alex Afenyo Markin told the court the EC had breached the constitution because there was no law which allowed for nominations to be opened and closed for district \u00a0assembly elections.<\/p>\n<p>Addressing the court, Lead \u00a0Lawyer for the EC James Quarshie Idan said the CI 85 which the plaintiffs were basing their case was not meant to empower the EC to conduct election but rather to give backing to the demarcation of electoral area on his clients relied on the section 11 of PNDC which deals with the organization of public elections in the country.<\/p>\n<p>He further told the court that his client relied in section 11 of PNDC LAW 284, which according to him gave them the powers to organize and conduct elections in the country.<\/p>\n<p>&#8211;<\/p>\n<p>By: Fred Djabanor\/citifmonline.com\/Ghana<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court\u00a0 has ordered the Electoral Commission (EC) to stop running \u00a0adverts of the upcoming district assembly elections but is set to rule on the substantive case on Friday.
