{"id":8229,"date":"2014-03-24T13:05:18","date_gmt":"2014-03-24T13:05:18","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=8229"},"modified":"2014-03-24T14:54:25","modified_gmt":"2014-03-24T14:54:25","slug":"hassan-ayarigas-case-lacks-merit-lawyer","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=8229","title":{"rendered":"Hassan Ayariga\u2019s case lacks merit \u2013 Lawyer"},"content":{"rendered":"<figure id=\"attachment_8235\" aria-describedby=\"caption-attachment-8235\" style=\"width: 1024px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/4cd.e16.myftpupload.com\/wp-content\/uploads\/2014\/03\/ayari.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-8235\" alt=\"Mahama Ayariga\" src=\"http:\/\/4cd.e16.myftpupload.com\/wp-content\/uploads\/2014\/03\/ayari.jpg\" width=\"1024\" height=\"683\" srcset=\"https:\/\/citifmonline.com\/wp-content\/uploads\/2014\/03\/ayari.jpg 1024w, https:\/\/citifmonline.com\/wp-content\/uploads\/2014\/03\/ayari-300x200.jpg 300w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption id=\"caption-attachment-8235\" class=\"wp-caption-text\">Mahama Ayariga<\/figcaption><\/figure>\n<p>Eric Osei Mensah, Counsel for the Peoples National Convention (PNC) treasurer has asked an Accra Fast Track High Court to strike out a defamation suit brought against his client by Hassan Ayariga.<\/p>\n<p>He argued in court on Monday March 24, 2014 that the PNC 2012 Presidential candidate&#8217;s lawsuit lacked merit because he failed to provide sufficient evidence indicating that Mr. David Apasera defamed him in a media publication that he Hassan Ayariga embezzled 1.6 million cedis meant for the party&#8217;s 2012 campaigns.<\/p>\n<p>According to Mr. Eric Osei Mensah, the rules in defamation application require that a complainant should provide sufficient particulars of the exact words in the media which are deemed defamatory.<\/p>\n<p>Again, he said Mr. David Apasera was not served any affidavit in opposition to his response regarding Mr. Hassan Ayariga&#8217;s lawsuit.<\/p>\n<p>He therefore described Mr. Hassan Ayariga&#8217;s lawsuit as one which lacked merit and pleaded with \u00a0the court to dismiss the case.<br \/>\nBut Mr. Chris Ackumey, lawyer for Hassan Ayariga \u00a0disagreed with this\u00a0submission and said his client met all the requirements of defamation.<\/p>\n<p>He made reference to Order 57 rule 2 of CI 47 to buttress his point.<\/p>\n<p>He also cited paragraph 9 of his client&#8217;s writ to justify his statement that Mr. Hassan Ayariga satisfied all the rules of defamation.<br \/>\nThe presiding judge, His Lordship Justice Ofori Atta adjourned the case to April 4.<\/p>\n<p>&nbsp;<\/p>\n<p>By: Abdul Karim Naatogmah\/citifmonline.com\/Ghana<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Eric Osei Mensah, Counsel for the Peoples National Convention (PNC) treasurer has asked an Accra Fast Track High Court to strike out a defamation suit brought against his client by Hassan Ayariga.
