{"id":79931,"date":"2015-01-07T05:34:06","date_gmt":"2015-01-07T05:34:06","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=79931"},"modified":"2015-01-07T06:14:00","modified_gmt":"2015-01-07T06:14:00","slug":"nayele-sentence-prosecutor-could-have-done-better-lawyer","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=79931","title":{"rendered":"Nayele sentence: Prosecutor could have done better &#8211; Lawyer"},"content":{"rendered":"<p>A lawyer and a former senior Crown Prosecutor in the United Kingdom (UK), Godwin Adjei-Gyamfi has criticised the performance of the prosecutor and the investigator in the Nayele Ametefeh cocaine case saying that he &#8220;could have done better.&#8221;<\/p>\n<p>Nayele Ametefeh was, on Tuesday, <a href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/01\/06\/nayele-sentenced-8-years-prison\/\" target=\"_blank\"><span style=\"color: #666699;\"><strong>sentenced to 8 years and 8 months<\/strong><\/span><\/a> in jail by a court in London\u00a0after being found guilty of carrying cocaine into the country.<\/p>\n<p><a href=\"http:\/\/4cd.e16.myftpupload.com\/wp-content\/uploads\/2014\/12\/nayele-new-pic1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-76278 aligncenter\" src=\"http:\/\/4cd.e16.myftpupload.com\/wp-content\/uploads\/2014\/12\/nayele-new-pic1.jpg\" alt=\"nayele new pic\" width=\"470\" height=\"308\" srcset=\"https:\/\/citifmonline.com\/wp-content\/uploads\/2014\/12\/nayele-new-pic1.jpg 470w, https:\/\/citifmonline.com\/wp-content\/uploads\/2014\/12\/nayele-new-pic1-300x196.jpg 300w\" sizes=\"auto, (max-width: 470px) 100vw, 470px\" \/><\/a><\/p>\n<div>But the former prosecutor believes that the prosecution&#8217;s performance might have contributed to the sentence that was handed down to the defendant in the case.<\/div>\n<div><\/div>\n<div>[contextly_sidebar id=&#8221;xQqqKjj1ThBBBa5In1eDcffa5Pe6VPqs&#8221;]&#8221;There is no doubt in my mind that the prosecutor and the investigator did not do a yeoman&#8217;s job. You would have expected that the prosecutor would have at least investigated her background to assess whether she has any assets. You would have expected the investigator to have communicated with the authorities in Ghana, prior to her being arraigned. The whole case could have been investigated much much better, which, in my mind would have increased the sentence,&#8221; he said.<\/div>\n<div><\/div>\n<div>He however believes that the sentence given by the judge to Ms Ametefeh was fair but admitted that the defence put out by her lawyer may have influenced the judge&#8217;s final decision.<\/div>\n<div><\/div>\n<div>&#8220;Her lawyer put forward that she is a vulnerable person because she has companions in the ruling elite and therefore could not go back to Ghana. He also said that she has been duped by powerful people. She also talked about her children. The judge indicated that he found her to have played a significant role [instead of a leading role] and had she gone to trial, she would have received a sentence of 13 years,&#8221; he explained.<\/div>\n<div><\/div>\n<div>He noted that the starting point for sentencing a person who played a significant role in such a crime is &#8220;11 years with a category range of nine to thirteen years. &#8220;One would receive one third of the 13 off, which would work out to be about 9 years. If you take the nine years less the personal circumstances that her lawyer stated, it works out to be the right sentence that the judge\u00a0 has given.&#8221;<\/div>\n<div><\/div>\n<div>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-79568\" src=\"http:\/\/4cd.e16.myftpupload.com\/wp-content\/uploads\/2015\/01\/UK-COURT.jpg\" alt=\"UK COURT\" width=\"620\" height=\"330\" srcset=\"https:\/\/citifmonline.com\/wp-content\/uploads\/2015\/01\/UK-COURT.jpg 620w, https:\/\/citifmonline.com\/wp-content\/uploads\/2015\/01\/UK-COURT-300x160.jpg 300w\" sizes=\"auto, (max-width: 620px) 100vw, 620px\" \/><br \/>\nNayele Ametefeh&#8217;s sentence includes community service and it is expected that she will serve half of her sentence in jail.<\/p>\n<p>[contextly_sidebar id=&#8221;6SoKiT6rgQFb8smnLiQU5qAkIPRRLZyu&#8221;]The forensic analysis on the cocaine showed a 79% purity and the street value is estimated at about 1.8 million Pounds.<\/p>\n<p>She admitted in her <a title=\"\u2018Cocaine woman\u2019 to appear before UK court via video link\" href=\"http:\/\/4cd.e16.myftpupload.com\/2014\/11\/27\/cocaine-woman-appear-uk-court-via-video-link\/\" target=\"_blank\"><span style=\"color: #666699;\"><strong>first appearance via video link<\/strong><\/span><\/a> that she is <a title=\"Nayele Ametefe pleads guilty in UK court\" href=\"http:\/\/4cd.e16.myftpupload.com\/2014\/11\/27\/nayele-ametefe-pleads-guilty-in-uk-court\/\" target=\"_blank\"><span style=\"color: #666699;\"><strong>guilty of the charges<\/strong><\/span><\/a> leveled against her;
