In an interview with citifmonline.com<\/strong>, a member of KKD\u2019s legal team, Gary Nimako said, \u201cWe are seeking for the bail from the Human Rights court because the District court can\u2019t grant our client bail.\u201d<\/p>\n KKD’s lawyers among the several reasons in the bail application argued that, even though there were two other persons in the room during the alleged rape incident, the facts of the prosecutor do not state that “any one of them heard noise from the so-called victim in a who of diapproval of the alleged sex that took place.”<\/p>\n They also argued that the facts do not show “there was any physical or verbal threat of harm or physical restraint used to compel the victim to have sex with the accused, yet, the prosecution contends the use of force.”<\/p>\n \u201cWe will go back to the District court for the main case but this court can\u2019t grant him bail that is why we have begun filing processes at the Human Rights court for his bail. So we want the court to hear the bail application on 7th<\/sup> January, 2015,\u201d lawyer Nimako explained.<\/p>\n He also revealed to citifmonline.com<\/strong> that the Attorney General (AG) has been\u00a0served a copy of the application and they are seeking her advice on where the case should be tried.<\/p>\n
