{"id":63503,"date":"2014-11-10T05:01:32","date_gmt":"2014-11-10T05:01:32","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=63503"},"modified":"2014-11-10T04:44:05","modified_gmt":"2014-11-10T04:44:05","slug":"supreme-court-can-overrule-speakers-decision-mp","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=63503","title":{"rendered":"Only Supreme Court can overrule Speaker\u2019s decision &#8211; Former AG\u00a0"},"content":{"rendered":"<p>A former Attorney General and Member of Parliament (MP) for Sekondi, Papa Owusu Ankomah has said that the Speaker of Parliament, Edward Doe Adjaho&#8217;s decision not to be sworn-in as acting President can only be overturned by the Supreme Court.<\/p>\n<p style=\"text-align: justify;\">The Speaker has on two occasions <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2014\/11\/07\/doe-adjaho-refuses-sworn\/\" target=\"_blank\">refused to take the constitutionally mandated oath of presidency<\/a><\/strong><\/span>\u00a0in the absence of both President Mahama and his vice, Kwesi Amissah-Arthur.<\/p>\n<p style=\"text-align: justify;\">The decision has attracted varied opinions from legal minds, including a private legal practitioner, Kwame Akuffo who described the Speaker&#8217;s decision as \u201c<span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2014\/11\/06\/speakers-refusal-to-be-sworn-in-completely-absurd-kwame-akuffo\/\" target=\"_blank\"><strong>completely absurd<\/strong><\/a><\/span>.\u201d<\/p>\n<p style=\"text-align: justify;\">[contextly_sidebar id=&#8221;UyQMHArkNEG0PbrzuJ74EPcfcC0UmSbl&#8221;]But the former Attorney General argued that the speaker\u2019s decision is now law.<\/p>\n<p style=\"text-align: justify;\">Owusu Ankomah opined that \u201cwhen the Speaker and Chief Justice consult and the Speaker takes a decision; for me for purposes of Parliament, what the speaker says is the law so\u2026unless and until the Supreme Court decides otherwise.\u201d<\/p>\n<p style=\"text-align: justify;\">He told <strong>Citi News<\/strong> that the framers of the Constitution did not anticipate that such instances could happen in the country hence the seeming confusion over the issue.<\/p>\n<p style=\"text-align: justify;\">He said \u201cthe Constitution certainly did not anticipate that the speaker will take an oath and it will be for the period of the administration of the President.
