Samuel Atta Akyea, counsel for former President\u00a0Jerry John Rawlings \u2013 in a case in which the former\u00a0president is seeking to place an injunction on the\u00a0launching of a book by Professor Kwaku Danso-Boafo,\u00a0Ghana\u2019s immediate past High Commissioner to the\u00a0United Kingdom \u2013 has told an Accra Fast Track High\u00a0Court that the final draft on the two parties\u2019 agreement\u00a0to settle the matter out of court, was almost ready.<\/p>\n
He told the court, presided over by Justice L.L.\u00a0Mensah, that the draft was ready except for \u00a0a few paragraphs which needed to be looked at again.<\/p>\n
Counsel for Rawlings consequently prayed the\u00a0court to adjourn the matter for both parties to return to\u00a0court on Friday, October 24, 2014 to finalize the\u00a0out-of-court settlement.<\/p>\n
The case has been consequently adjourned to the\u00a0said date.<\/p>\n
The professor was represented by Alex Quartey.\u00a0Mr. Atta Akyea had told the court at the last hearing\u00a0that they were close to settlement and asked for an\u00a0adjournment.<\/p>\n
The defendant wanted to launch a book entitled, \u201cJJ\u00a0Rawlings and the Democratic Transition in Ghana,\u201d\u00a0which the former president is seeking to have the court\u00a0place an injunction on.<\/p>\n
The book was initially scheduled to be launched on\u00a0August 20, 2014, but Mr Rawlings wanted the event\u00a0cancelled altogether, accusing Professor Danso-Boafo of\u00a0bad faith for reneging on an earlier agreement reached\u00a0on the book.<\/p>\n
Mr. Rawlings, in his affidavit in support of the\u00a0motion, stated that Prof. Danso-Boafo had undertaken\u00a0to wait for him (Rawlings) to review the book and correct\u00a0all factual inaccuracies in it but \u201chas breached his\u00a0own solemn undertaking with me and has published it\u00a0with the view to launching it\u201d<\/p>\n
The plaintiff believes the professor had not extended\u00a0due courtesy due him relating to the said agreement\u00a0and had only dropped a special invitation inviting him\u00a0to the launch of the unapproved book.<\/p>\n
The defendant, in his affidavit in opposition of Mr\u00a0Rawlings\u2019 claims, said the book was not intended to\u00a0and does not bring Jerry Rawlings and his family into
\ndisrepute, but was rather authored from an \u201cintellectual\u00a0perspective and fair analysis of historical events\u00a0which occurred during the plaintiff\u2019s (Rawlings\u2019) public\u00a0life from military rule through transition to democracy\u00a0and written in a very objective light.\u201d<\/p>\n
Prof. Danso-Boafo\u2019s affidavit said the author, after\u00a0completing the book, gave Jerry Rawlings a copy to\u00a0proof read but the former president, after keeping the
\ncopy for well over two years, had not been able to\u00a0point out a single sentence he finds unacceptable in the\u00a0book.<\/p>\n
