{"id":262701,"date":"2016-10-28T13:06:32","date_gmt":"2016-10-28T13:06:32","guid":{"rendered":"http:\/\/citifmonline.com\/?p=262701"},"modified":"2016-10-28T13:06:32","modified_gmt":"2016-10-28T13:06:32","slug":"obey-your-own-rules-high-court-to-ec","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=262701","title":{"rendered":"Obey your own rules \u2013 High Court to EC"},"content":{"rendered":"<p>An Accra High Court has asked Ghana\u2019s Electoral Commission to adhere to its own rules in the conduct of the 2016 general elections.<\/p>\n<p>The court made the remark when it gave a judgment in a case brought by the Progressive People\u2019s Party (PPP) which was challenging the disqualification of its flagbearer, Dr. Papa Kwesi Nduom form this year\u2019s presidential race.<\/p>\n<p>The EC disqualified the PPP flagbearer because according to it Nduom\u2019s nomination forms were not properly completed.<\/p>\n<p>But lawyers of the PPP argued in court that the EC did not give them the chance to correct the errors on their flagbearer&#8217;s nomination forms.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-262666 aligncenter\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/10\/nduom-and-running-mate.jpg\" alt=\"nduom-and-running-mate\" width=\"659\" height=\"370\" \/><\/p>\n<p>They had also prayed the court to stop the EC from going ahead with balloting of presidential candidates on the ballot paper.<\/p>\n<p>Meanwhile the court presided over by Justice Eric Kyei Baffour on Friday ordered the EC to give the PPP the chance to make the necessary corrections on the nomination forms.<\/p>\n<p><strong>Citi News<\/strong>\u2019 Fred Djabanor reported that \u201caccording to the judge, the regulations, C.I. 94 [the law governing the conduct of the 2016 elections] states clearly that if there is an error within the nomination period or nomination day, any candidate must be afforded the opportunity to correct his error.\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-262687 aligncenter\" src=\"http:\/\/citifmonline.com\/wp-content\/uploads\/2016\/10\/ppp-victory-11.jpg\" alt=\"ppp-victory-11\" width=\"800\" height=\"533\" \/><\/p>\n<p>\u201cThe judge further said the EC failed to state clearly what a nomination period was and that what they only did was to just use two days for acceptance of nominations. He said the EC also failed to define what a nomination day and nomination period was\u2026hence the EC couldn\u2019t disqualify Dr. Nduom based on that,\u201d added Djabanor.<\/p>\n<p>&#8211;<\/p>\n<p>By: Godwin A.
