{"id":215450,"date":"2016-05-19T13:17:29","date_gmt":"2016-05-19T13:17:29","guid":{"rendered":"http:\/\/citifmonline.com\/?p=215450"},"modified":"2016-05-19T13:17:29","modified_gmt":"2016-05-19T13:17:29","slug":"supreme-court-stops-zanetors-case-at-high-court","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=215450","title":{"rendered":"Supreme court stops Zanetor&#8217;s case at High Court"},"content":{"rendered":"<p>The Supreme Court has ordered for a stay of proceedings in the case at the High Court where the National Democratic Congress&#8217; (NDC) Parliamentary nominee for the Klottey Korle Constituency, Dr. Zanetor Rawlings, is being challenged by the incumbent MP, Nii Armah Ashitey.<\/p>\n<p>The order follows an application by\u00a0 Dr. Zanetor Rawlings, challenging the capacity of an Accra High Court to hear\u00a0 the suit challenging her eligibility.<\/p>\n<p>According to the ruling, which was a four to one decision, the trial judge at the High Court erred in deciding on the case, a\u00a0matter of constitutional\u00a0interpretation, which is\u00a0solely the mandate\u00a0of the Supreme Court.<\/p>\n<p>[contextly_sidebar id=&#8221;4fM9xHhZJR5wn3Sqog56J0yMIrLRq5pI&#8221;]The apex court also indicated that it will carry out its duties by interpreting the said constitutional provision.<\/p>\n<p><strong>Zanetor&#8217;s Supreme Court suit <\/strong><\/p>\n<p>Dr. Zanetor was seeking for an order of prohibition directed at the trial judge, Mr. Justice Kwaku T. Ackah Boafo from further hearing the matter.<\/p>\n<p>According to her suit, the trial judge erred in law when he wrongfully assumed the jurisdictional role to \u00a0interpret\u00a0Article 94 (1) (a) of the 1992 Constitution.<\/p>\n<p>Her lawyers contended that the function of the interpretation of the Constitution was done by the Supreme Court and not the High Court in the matter at stake.<\/p>\n<p>Dr. Zanetor Rawlings has since her election been fighting a legal tussle where the \u00a0incumbent NDC MP,\u00a0for the constituency, Nii Armah Ashitey, is challenging her locus and capacity to represent the party in the 2016 parliamentary elections.<\/p>\n<p>In his suit Mr. Ashitey claims Dr. Rawlings was not qualified to contest the primary since she was not a registered voter.<\/p>\n<p><strong>Zanetor Rawlings \u00a0is now registered\u00a0<\/strong><\/p>\n<p>Meanwhile Zanetor Rawlings in April \u00a0quickly registered when the Electoral Commission opened the register for new voters in the limited registration exercise.<\/p>\n<p>But lawyer for the incumbent MP, Gary Nimako, has said the <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/citifmonline.com\/2016\/04\/29\/zanetors-smart-registration-wont-save-her-lawyer\/\">sudden registration<\/a><\/strong><\/span> by Dr. Zanetor \u00a0Rawlings in the limited voters\u2019 registration exercise, will not exonerate her from any wrongdoing or bring the case to a close.<\/p>\n<p>&#8211;<\/p>\n<p>By: Fred Djabanor\/citifmonline.com\/Ghana<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court has ordered for a stay of proceedings in the case at the High Court where the National Democratic Congress&#8217; (NDC) Parliamentary nominee for the Klottey Korle Constituency, Dr. Zanetor Rawlings, is being challenged by the incumbent MP, Nii Armah Ashitey.
