{"id":139512,"date":"2015-07-31T10:34:09","date_gmt":"2015-07-31T10:34:09","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=139512"},"modified":"2015-07-31T10:36:08","modified_gmt":"2015-07-31T10:36:08","slug":"court-strikes-out-west-blue-case-against-government","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=139512","title":{"rendered":"Court strikes out West Blue case against government"},"content":{"rendered":"<p>An Accra Fast Track Court has struck out the West Blue case brought against the government.<\/p>\n<p>A private freight forwarder,\u00a0Michael Kweku Djan was seeking an injunction to\u00a0stop government from contracting West Blue Ghana limited to manage its single window policy.<\/p>\n<p>[contextly_sidebar id=&#8221;BOUapyl3yOoKLJj64Qlx4RDCS0eWyvOu&#8221;]The suit was premised on a May 12, 2015 letter from the Chief of Staff directing the Minister of Finance, Seth Terkper to solely engage the West Blue consulting for the purposes of the single window implementation project.<\/p>\n<p>The plaintiff wanted the court to declare that \u201cthe single-sourcing of the National Single Window and Risk Management System Project in favour of West Blue Ghana Limited is a breach of Section 40 of the Public Procurement Act, 2003 (Act 663).\u201d<\/p>\n<p>He also contended that\u00a0West Blue could not claim to have exclusive expertise in providing Single Window services because the five Destination Inspection Companies (DICs) currently operating in Ghana, whose contracts would not be renewed after August, had all shown over their years of operation in Ghana that they possess practical expertise.<\/p>\n<p>On Monday, the\u00a0Attorney General (AG) <strong><span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/07\/27\/ag-challenges-authority-of-high-court-in-west-blue-case\/\" target=\"_blank\">challenged the jurisdiction<\/a><\/span><\/strong> of an Accra High Court to hear\u00a0the case.<\/p>\n<p>The case was subsequently adjourned to July 28 to allow the lawyer of the applicant to respond to the preliminary objection raised by the AG.<\/p>\n<p>When they appeared in court on July 28, the court set Friday, July 31 <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/07\/28\/court-sets-friday-to-rule-on-west-blue-case\/\" target=\"_blank\">to rule on the application<\/a><\/strong><\/span>\u00a0to strike out the case and on Friday, it was struck out.<\/p>\n<p><strong>Background<\/strong><\/p>\n<p>The government is solely engaging West Blue Consulting for the implement the single window project in Ghana.<\/p>\n<p>The\u00a0single-window system\u00a0is a\u00a0trade facilitation\u00a0which enables cross-border traders to submit regulatory documents at a single location.<\/p>\n<p>The documents include customs declarations, applications for import\/export permits, and other supporting documents such as certificates of origin and trading invoices.<\/p>\n<p>This is aimed at increasing the efficiency through time and cost savings for traders in their dealings with government authorities for obtaining the relevant clearance and permits for moving cargoes across national or economic borders.<\/p>\n<p>But some indutry players have kicked against the decision because according to them,\u00a0the process under which West Blue was handpicked to implement this national single window platform was erroneous.<\/p>\n<p>This informed Mr. Djan&#8217;s decision to sue the government over the matter.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>By: Fred Djabanor\/citifmonline.com\/Ghana<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An Accra Fast Track Court has struck out the West Blue case brought against the government.
